License Agreement for Yandex Pro for Mobile Devices

 

Before using the program, please read the terms and conditions of the below license agreement.

Any use of the program means that you fully and unconditionally accept the terms and conditions of this license agreement.

If you do not accept the license agreement in full, you may not use the program for any purpose.

 

1. General Provisions

1.1. This License Agreement (the "License") sets terms of use for Yandex Pro (previously “Taximeter”) for mobile devices (the "Program") and is concluded between any person using the Program (the "User") and YandexGo UB LLC, being a body authorized to grant the rights to use the Program (the "Rightholder").

1.2. By copying the Program, installing it on his/her mobile device or using the Program in any way, the User expresses his/her full and unconditional consent to all the terms and conditions of this License.

1.3. The Program is only permitted to be used under the terms and conditions of this License. If the User does not accept the terms and conditions of the License in full, the User may not use the Program for any purpose. The Program is prohibited to be used in violation of (failing to fulfill) any of the terms and conditions of the License.

1.4. The User may use the Program under the terms and conditions of this License for personal non-commercial purposes at no cost. It is only possible to use the Program under terms and in ways not covered by this License based on a separate agreement with the Rightholder.

1.5. It is only possible to use the Program under terms and in ways not covered by this License based on a separate agreement with the Rightholder.

The Rightholder may unilaterally amend the said documents (inter alia, any parts thereof) with no special notice. New versions of the documents will come into effect once published, unless they stipulate otherwise.

1.6. The Rightholder and the User hereby agreed that as far as the Program was concerned they would mutually deem e-documents signed with a basic e-signature identical to paper documents signed with a handwritten signature.

1.6.1. The Program is, among other things, an information system operated by the Rightholder.

1.6.2. To sign an e-document with an e-signature as and when stipulated by certain functions of the Program, the User will use numerical, alphabetic, symbolic or combined codes the Rightholder generated and the User received as a message to the phone number the User specified in the Program. Such codes represent the e-signature key.

1.6.3. The User shall respect confidentiality of codes (e-signature keys) he or she received.

1.6.4. The User will enter a respective code in a special form in the Program. The Parties acknowledge that all e-documents the User will generate, use and send to the Rightholder via program functions in a session (the period of validity of a respective code) will be signed so with the User's e-signature.

1.6.5. The User warrants that his/her personal data specified in the Program are reliable. Based on these data, the User will determine whether an e-document signed with an e-signature as specified above is signed by the User.

1.7. When the User is a representative of the Rightholder's Partner, provisions of cl. 1.6.1 – 1.6.5 of this License will apply insofar as they do not conflict with agreements and contracts between the Rightholder and such partner of the Rightholder.

1.8. The User will authorize the Rightholder to use information he/she provided in the Program by including such information in the Rightholder's database and further use of such database by any means.

1.9. This License and all relations associated with the use of the Program shall be subject to the laws of the Netherlands, and any claims or actions arising out of or in connection with this License or the use of the Program shall be submitted to and reviewed by courts at the Rightholder’s location.

1.10. The Rightholder may send information messages to Users. When using the Program, the User also gives his/her consent to receive advertising and informative messages. The User may unsubscribe from advertising messages by addressing the help desk or following instructions specified in an advertising message received.

1.11. Depending on the User’s region, any or all functions of the Program can be inaccessible or limited. Functions are deemed to be inaccessible (limited) to the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions of these Terms and the documents specified in cl. 1.5 governing inaccessible (limited) functions of the Program will not apply until such functions become explicitly accessible to the User. The User will be provided information on program functions accessibility in a certain region upon request sent to the Rightholder.

 

2. Rights to the Program

2.1. The exclusive right to the Program is vested in the Rightholder.

 

3. License

3.1. The Rightholder shall, free of charge and under an ordinary (non-exclusive) license, grant to the User the non-transferable right to use the Program in all countries of the world in the following ways:

3.1.1. To use the Program as intended, wherefore to copy and install (reproduce) it on the User's mobile device(-s). The User may install the Program on an unlimited number of mobile devices. When installed on mobile devices, each copy of the Program is assigned an individual number automatically reported to the Rightholder.

3.1.2. To reproduce and distribute the Program for non-commercial purposes (free of charge).

 

4. Limitations

4.1. Except when used in the scope and in the ways expressly stipulated by this License or applicable laws, the User may not modify, decompile, disassemble, decrypt, and perform any other actions with the object code of the Program meant to obtain information on the implementation of algorithms used in the Program, create derivative works using the Program, and otherwise use (allow to use) the Program, without the Rightholder’s written consent.

4.2. The User may not reproduce and distribute the Program for commercial purposes (inter alia, for a fee), inter alia, as part of software product collections, without the Rightholder’s written consent.

4.3 The User may not distribute the Program in any form other than the form received, without the Rightholder’s written consent.

4.4. The Program shall be used (inter alia, be distributed) under the name: Yandex Pro. The User may not change the name of the Program, change and/or delete the copyright notice or other references to the Rightholder.

 

5. Terms of Use of Certain Functions of the Program

5.1. Some functions of the Program can only be performed with access to the Internet. The User will independently obtain and pay for such access under terms and as per tariffs of its telecom or Internet provider.

5.2. Some functions of the Program will only be available to the User who has concluded a separate agreement with the Rightholder or a body providing access to such functions of the Program.

5.3. When the Program, inter alia, its certain functions, described in and governed by the Terms of Use of the Driver Card Generator (https://yandex.com/legal/drivers_termsofuse_bv), is used, the User will permit the Rightholder to process the User's personal information as this term is defined in the Privacy Policy (https://yandexgo.com/legal/yandexgo_privacy_notice) to make sure functions of the Program will be available, to transfer the User's personal information to the Rightholder's partners for them to further process such information and make sure functions of the Program will be available, and for the purposes specified in the Terms of Use of the Driver Card Generator as well as to obtain the User's personal information from third parties for the same purposes.

The Rightholder will only transfer and/or receive the User's personal information needed for the said purposes. The Rightholder's will process the User's personal information and other information the User will download and provide through the Program as per the Privacy Policy (https://yandexgo.com/legal/yandexgo_privacy_notice).

The provisions of this clause having to do with the processing of the User's personal and other information by the Rightholder will apply to materials and information the User received in using the Service and its functions.

The permit referred to in this clause will apply to information the User will specify in the Program and the Rightholder will receive from third parties, inter alia, the last name, first name, patronymic, address; the number of the main identity document and the driving license; the vehicle registration certificate, information on when (including date of expiry) and by what body the said documents were issued; information needed to prevent fraud in relation to the Rightholder and the way the Program will be used, including photos, information on the right to drive a vehicle to transport passengers and luggage by a passenger taxi, information on traffic-related offenses and other breaches of laws (including arrears / enforcement proceedings available in public registries). The Rightholder may process such personal information with or without automation tools, and by any means, inter alia, by collecting, recording, systemizing, accumulating, storing, clarifying (updating, modifying), extracting, using, transferring (providing, accessing), depersonalizing, blocking, deleting, and destructing.

Where the applicable laws prescribe, the User's permit referred to in this clause will be deemed to be granted in writing, signed with the User's e-signature as per clauses 1.6 - 1.6.5 of this License with necessary details the User specified as stipulated such form of permit. Such permit will be valid while it is necessary to provide the User with functions of the Program and within 3 (three) years after, unless the applicable laws stipulate any other (shorter or longer) period.

5.4. The User is hereby notified, understands and agrees that, when the Program is used to provide the User with functions of the Program, the Rightholder will automatically receive the following information: the User's device operating system, browser version and ID, Program functions statistics, device location data, and any other technical information.

 

6. Liability under the License

6.1. The Program is provided as is. The Rightholder provides no guarantees of error- and trouble-free operation of the Program or its certain components and/or functions, fitness of the Program for specific goals and expectations of the User, and provides no other guarantees, which are not expressly stated in this License.

6.2. The Rightholder will not be held liable for any direct or indirect consequences of any use of or inability to use the Program and/or any damage inflicted on the User and/or third parties as a result of any use of, failure or inability to use the Program or its certain components and/or functions, inter alia, due to possible errors or failures in the operation of the Program, except as expressly stipulated by the laws.

6.3. All questions and claims related to the use of / impossibility to use the Program and possible disregard of laws and/or third-party rights by the Program shall be forwarded via the feedback form.

 

7. Updates / New Versions of the Program

7.1. This License covers all future updates / new versions of the Program. When the User agrees to install an update / new version of the Program, he/she accepts the terms and conditions of this License for respective updates / new versions of the Program, if there is no other license agreement for the update / new version of the Program.

 

8. Amendments to this License

8.1. This License Agreement may be unilaterally amended by the Rightholder. User notices of amendments made to this License will be posted at: https://yandex.com/legal/yandexpro_mobile_agreement. The said amendments to the terms and conditions of the License will come into effect once published, unless otherwise specified in the relevant publication.

Лицензионное соглашение на использование программы Yandex Pro для мобильных устройств

 

Перед использованием программы, пожалуйста, ознакомьтесь с условиями нижеследующего лицензионного соглашения.

Любое использование Вами программы означает полное и безоговорочное принятие Вами условий настоящего лицензионного соглашения.

Если Вы не принимаете условия лицензионного соглашения в полном объёме, Вы не имеете права использовать программу в каких-либо целях.

 

1. Общие положения

1.1. Настоящее Лицензионное соглашение («Лицензия») устанавливает условия использования программы Yandex Pro (ранее – Таксометр) для мобильных устройств («Программа») и заключено между любым лицом, использующим Программу («Пользователь»), и ООО «YandexGo UB» («Правообладатель»).

1.2. Копируя Программу, устанавливая её на свое мобильное устройство или используя Программу любым образом, Пользователь выражает свое полное и безоговорочное согласие со всеми условиями Лицензии.

1.3. Использование Программы разрешается только на условиях настоящей Лицензии. Если Пользователь не принимает условия Лицензии в полном объёме, Пользователь не имеет права использовать Программу в каких-либо целях. Использование Программы с нарушением (невыполнением) какого-либо из условий Лицензии запрещено.

1.4. Использование Программы Пользователем на условиях настоящей Лицензии в личных некоммерческих целях осуществляется безвозмездно. Использование Программы на условиях и способами, не предусмотренными настоящей Лицензией, возможно только на основании отдельного соглашения с Правообладателем.

1.5. Пользуясь Программой, Пользователь соглашается с тем, что неотъемлемыми частями настоящей Лицензии являются следующие документы, условия которых в полной мере распространяются на использование Программы:

Указанные документы (в том числе любые из их частей) могут быть изменены Правообладателем в одностороннем порядке без какого-либо специального уведомления, новая редакция документов вступает в силу с момента их опубликования, если иное не предусмотрено новыми редакциями документов.

1.6. Правообладатель и Пользователь настоящим согласовали, что в рамках Программы они взаимно признают электронные документы, подписанные простой электронной подписью, равнозначными документам на бумажных носителях, подписанным собственноручной подписью.

1.6.1. Программа, в том числе, представляет собой информационную систему, оператором которой является Правообладатель.

1.6.2. Для подписания электронного документа электронной подписью в рамках и в случаях, предусмотренных определенными функциями Программы, Пользователь использует числовые, буквенные, символьные или комбинированные коды, сформированные Правообладателем и полученные Пользователем в виде сообщения на номер телефона, указанный Пользователем в Программе. Такие коды являются ключом электронной подписи.

1.6.3. Пользователь обязан соблюдать конфиденциальность в отношении полученных кодов (ключей электронной подписи).

1.6.4. Пользователь вводит соответствующий код в специальную форму в Программе. Стороны признают, что все электронные документы, сформированные, используемые и направляемые Правообладателю Пользователем посредством функций Программы в рамках одной сессии (периода времени действия соответствующего кода), являются подписанными таким образом электронной подписью Пользователя.

1.6.5. Пользователь гарантирует, что указанная им в Программе информация о себе является достоверной. На основе указанной информации Пользователь определяет, что электронный документ, подписанный с использованием электронной подписи в порядке, указанном выше, подписан именно Пользователем.

1.7. В случае, когда Пользователь является представителем партнёра Правообладателя, положения пунктов 1.6.1 – 1.6.5. настоящей Лицензии применяются в части, не противоречащей соглашениям и договорам между Правообладателем и таким партнёром Правообладателя.

1.8. Пользователь предоставляет Правообладателю право использовать информацию, предоставленную Пользователем в рамках Программы, путем включения такой информации в базу данных Правообладателя и дальнейшего использования такой базы данных любым способом.

1.9. К настоящей Лицензии и всем отношениям, связанным с использованием Программы, подлежит применению право Нидерландов и любые претензии или иски, вытекающие из настоящей Лицензии или использования Программы, должны быть поданы и рассмотрены в суде по месту нахождения Правообладателя.

1.10. Правообладатель вправе направлять Пользователям информационные сообщения. Используя Программу, Пользователь также дает свое согласие на получение сообщений рекламно-информационного характера. Пользователь вправе отказаться от получения сообщений рекламного характера путем соответствующего обращения в службу поддержки или следуя инструкциям, указанным в полученном сообщении рекламного характера.

1.11. В зависимости от региона Пользователя все или некоторые функции Программы могут быть недоступны или ограничены. Функции считаются недоступными (ограниченными) для Пользователя из определенного региона, если такой Пользователь не может ими воспользоваться в явном виде. Применение любых технических и программных методов обхода данных ограничений запрещено. Положения настоящей Лицензии и указанных в п.1.5 документов, регулирующие недоступные (ограниченные) для Пользователя функции Программы, не применяются до тех пор, пока Пользователю такие функции не станут доступны в явном виде. Информация о доступности функций Пользователя в определенном регионе предоставляется Пользователю по его запросу, направленному Правообладателю.

 

2. Права на Программу

2.1. Исключительное право на Программу принадлежит Правообладателю.

 

3. Лицензия

3.1. Правообладатель безвозмездно, на условиях простой (неисключительной) лицензии, предоставляет Пользователю непередаваемое право использования Программы на территории стран всего мира следующими способами:

3.1.1. Применять Программу по прямому функциональному назначению, в целях чего произвести ее копирование и установку (воспроизведение) на мобильное (-ые) устройство (-ва) Пользователя. Пользователь вправе произвести установку Программы на неограниченное число мобильных устройств. При установке на мобильное устройство каждой копии Программы присваивается индивидуальный номер, который автоматически сообщается Правообладателю.

3.1.2. Воспроизводить и распространять Программу в некоммерческих целях (безвозмездно).

 

4. Ограничения

4.1. За исключением использования в объемах и способами, прямо предусмотренными настоящей Лицензией или законодательством Российской Федерации, Пользователь не имеет права изменять, декомпилировать, дизассемблировать, дешифровать и производить иные действия с объектным кодом Программы, имеющие целью получение информации о реализации алгоритмов, используемых в Программе, создавать производные произведения с использованием Программы, а также осуществлять (разрешать осуществлять) иное использование Программы, без письменного согласия Правообладателя.

4.2. Пользователь не имеет право воспроизводить и распространять Программу в коммерческих целях (в том числе за плату), в том числе в составе сборников программных продуктов, без письменного согласия Правообладателя.

4.3. Пользователь не имеет права распространять Программу в виде, отличном от того, в котором он ее получил, без письменного согласия Правообладателя.

4.4. Программа должна использоваться (в том числе распространяться) под наименованием: Yandex Pro. Пользователь не вправе изменять наименование Программы, изменять и/или удалять знак охраны авторского права (copyright notice) или иное указание на Правообладателя.

 

5. Условия использования отдельных функций Программы

5.1. Выполнение некоторых функций Программы возможно только при наличии доступа к сети Интернет. Пользователь самостоятельно получает и оплачивает такой доступ на условиях и по тарифам своего оператора связи или провайдера доступа к сети Интернет.

5.2. Некоторые функции Программы доступны только Пользователю, заключившему отдельное соглашение с Правообладателем или лицом, предоставляющим доступ к таким функциям Программы.

5.3. При использовании Программы, в том числе её отдельных функций, описание которых также содержится и регулируется Условиями использования сервиса по формированию карточки водителя (https://yandex.com/legal/drivers_termsofuse_bv), Пользователь дает Правообладателю согласие на обработку персональной информации Пользователя, как этот термин определен в Политике конфиденциальности (https://yandexgo.com/legal/yandexgo_privacy_notice), для целей предоставления функциональных возможностей Программы, на передачу Правообладателем персональной информации Пользователя партнёрам Правообладателя для дальнейшей обработки такой информации в целях предоставления функциональных возможностей Программы и в целях, определенных в Условиях использования сервиса по формированию карточки водителя, а также на получение персональной информации Пользователя от третьих лиц для тех же целей.

Правообладатель передаёт и/или получает лишь ту персональную информацию Пользователя, которая необходима для указанных целей. Обработка Правообладателем персональной информации Пользователя, а также иной информации, загружаемой и предоставляемой Пользователем посредством Программы, осуществляется на условиях Политики конфиденциальности, (https://yandexgo.com/legal/yandexgo_privacy_notice).

Положения настоящего пункта в отношении обработки персональной и иной информации Пользователя Правообладателем распространяются на материалы и информацию, полученные Пользователем в процессе использования Сервиса и его функций.

Указанное в настоящем пункте согласие распространяется на информацию, указанную пользователем в Программе, а также полученную Правообладателем от третьих лиц, в том числе, на фамилию, имя, отчество, адрес; номер основного документа, удостоверяющего личность и документа, удостоверяющего право управления транспортным средством; свидетельство о регистрации транспортного средства, сведения о дате выдачи (и сроке действия) указанных документов и выдавшем его органе; информацию, необходимую для предотвращения мошеннических действий в отношении Правообладателя и порядка использования Программы, в том числе фотографию, сведения о праве осуществления деятельности по управлению транспортным средством для перевозки пассажиров и багажа легковым такси, сведения об имевших место нарушениях правил дорожного движения и иных нарушениях законодательства (в том числе о наличии задолженности/исполнительного производства, информация о которых размещена в открытых реестрах). Такая персональная информация может быть обработана Правообладателем как с использованием средств автоматизации, так и без такого использования, а также любыми способами, включая, сбор, запись, систематизацию, накопление, хранение, уточнение (обновление, изменение), извлечение, использование, передачу (предоставление, доступ), обезличивание, блокирование, удаление и уничтожение.

В случаях, предусмотренных применимым законодательством, указанное в настоящем пункте согласие Пользователя будет считаться данным в письменной форме, подписанным электронной подписью Пользователя в порядке, установленном в пунктах 1.6.–1.6.5 настоящей Лицензии, с указанием Пользователем необходимых реквизитов, установленных для такой формы согласия. Такое согласие будет действовать в течение срока, необходимого для предоставления Пользователю функциональных возможностей Программы, а также в течение 3 (трех) лет после этого, если иной (сокращенный или более длительный) срок не установлен действующим законодательством.

5.4. При использовании Пользователем функционала Программы, связанного с доступом к Сервису «Яндекс.Заправки», предоставляемому ИП ООО «YANDEX ZAPRAVKI» (Регистрационный номер 2480770, адрес: город Ташкент, Юнусабадский район, ул. Шахрисабз, дом 2), Пользователь считается принявшим Условия использования Сервиса «Яндекс.Заправки», размещенные по адресу https://yandex.com/legal/zapravki_termsofuse_uz с дополнениями, указанными в настоящем пункте:

5.4.1. При использовании функционала Программы, связанного с доступом к Сервису «Яндекс.Заправки», авторизация Пользователя на Сервисе «Яндекс.Заправки» осуществляется по учетным данным Пользователя в Программе.

5.4.2. При использовании функционала Программы, связанного с доступом к Сервису «Яндекс.Заправки», Пользователь, в дополнение к согласию, указанному в п. 5.3 настоящей Лицензии, предоставляет Правообладателю согласие на обработку персональной информации Пользователя путем её передачи в ИП ООО «YANDEX ZAPRAVKI» (равно как и получения от ИП ООО «YANDEX ZAPRAVKI») в целях предоставления возможности воспользоваться Сервисом «Яндекс.Заправки».

5.4.3. Во всём остальном при использовании функционала Программы, связанного с доступом к Сервису «Яндекс.Заправки» Пользователь руководствуется положениями Условий использования Сервиса «Яндекс.Заправки».

5.5. Пользователь настоящим уведомлен и соглашается, что при использовании Программы Правообладателю в автоматическом режиме анонимно передается следующая информация: тип операционной системы устройства Пользователя, версия и идентификатор браузера, статистика использования функций Программы, данные местонахождения устройства, а также иная техническая информация.

 

6. Ответственность по Лицензии

6.1. Программа предоставляется на условиях «как есть» (as is). Правообладатель не предоставляет никаких гарантий в отношении безошибочной и бесперебойной работы Программы или отдельных её компонентов и/или функций, соответствия Программы конкретным целям и ожиданиям Пользователя, а также не предоставляет никаких иных гарантий, прямо не указанных в настоящей Лицензии.

6.2. Правообладатель не несет ответственности за какие-либо прямые или косвенные последствия какого-либо использования или невозможности использования Программы и/или ущерб, причиненный Пользователю и/или третьим сторонам в результате какого-либо использования, неиспользования или невозможности использования Программы или отдельных её компонентов и/или функций, в том числе из-за возможных ошибок или сбоев в работе Программы, за исключением случаев, прямо предусмотренных законодательством.

6.3. Все вопросы и претензии, связанные с использованием/невозможностью использования Программы, а также возможным нарушением Программой законодательства и/или прав третьих лиц, должны направляться через форму обратной связи.

 

7. Обновления/новые версии Программы

7.1. Действие настоящей Лицензии распространяется на все последующие обновления/новые версии Программы. Соглашаясь с установкой обновления/новой версии Программы, Пользователь принимает условия настоящей Лицензии для соответствующих обновлений/новых версий Программы, если обновление/установка новой версии Программы не сопровождается иным лицензионным соглашением.

 

8. Изменения условий настоящей Лицензии

8.1. Настоящее лицензионное соглашение может изменяться Правообладателем в одностороннем порядке. Уведомление Пользователя о внесенных изменениях в условия настоящей Лицензии публикуется на странице: https://yandex.com/legal/yandexpro_mobile_agreement. Указанные изменения в условиях Лицензии вступают в силу с момента их публикации, если иное не оговорено в соответствующей публикации.

Dasturdan foydalanishdan oldin quyidagi litsenziya kelishuvining shartlari bilan tanishib chiqishingizni so‘raymiz.

Dasturdan har qanday foydalanish Sizning ushbu litsenziya kelishuvi shartlarini to‘liq va so‘zsiz qabul qilganingizni bildiradi.

Agar siz litsenziya kelishuvi shartlarini to‘liq qabul qilmasangiz, u holda Siz dasturdan biron-bir maqsadda foydalanish huquqiga ega emassiz.

 

1. Umumiy qoidalar

1.1. Ushbu Litsenziya kelishuvi (“Litsenziya”) mobil qurilmalar uchun (“Dastur”) Yandex Pro (ilgari Taksometr) dasturidan foydalanish shartlarini belgilaydi hamda Dasturdan foydalanuvchi har qanday shaxs (“Foydalanuvchi”) va “YandexGo UB” MChJ (“Huquq egasi”) o‘rtasida tuzilgan.

1.2. Dasturdan nusxa ko‘chirish, uni mobil qurilmaga o‘rnatish yoki Dasturdan har qanday tarzda foydalanish orqali Foydalanuvchi Litsenziyaning barcha shartlariga to‘liq va so‘zsiz roziligini ifodalaydi.

1.3. Dasturdan faqat ushbu Litsenziya shartlariga muvofiq foydalanishga ruxsat beriladi. Agar Foydalanuvchi Litsenziya shartlarini to‘liq qabul qilmasa, Foydalanuvchi Dasturdan biron-bir maqsadda foydalanishga huquqiga ega bo‘lmaydi. Litsenziyaning har qanday shartlarini buzgan holda (bajarmagan holda) Dasturdan Foydalanish taqiqlanadi.

1.4. Foydalanuvchining Dasturdan ushbu Litsenziya shartlariga muvofiq shaxsiy, notijorat maqsadlarda foydalanishi bepul amalga oshiriladi. Dasturdan ushbu Litsenziyada ko‘zda tutilmagan shartlar va usullar bilan foydalanish faqat Huquq egasi bilan alohida kelishuv asosida mumkin bo‘ladi.

1.5. Dasturdan foydalanish orqali Foydalanuvchi shartlari Dasturdan foydalanishga nisbatan to‘liq qo‘llaniladigan quyidagi hujjatlar ushbu Litsenziyaning ajralmas qismi bo‘lib hisoblanishiga rozilik bildiradi:

Ko‘rsatilgan hujjatlar (shu jumladan ularning har qanday qismlari) Huquq egasi tomonidan hech qanday maxsus xabar bermasdan o‘zgartirilishi mumkin, hujjatlarning yangi tahrirlari, agar hujjatlarning yangi tahrirlarida boshqacha tartib nazarda tutilgan bo‘lmasa, ular chop etilgan paytdan boshlab kuchga kiradi.

1.6. Huquq egasi va Foydalanuvchi ushbu bilan Dastur doirasida oddiy elektron imzo bilan imzolangan elektron hujjatlarni o‘z qo‘li bilan imzolangan qog‘oz hujjatlarga teng deb o‘zaro tan olishlariga kelishib oldilar.

1.6.1. Dastur, shu jumladan, axborot tizimi bo‘lib, Huquq egasi uning operatori bo'lib hisoblanadi.

1.6.2. Dasturning ayrim funksiyalarida nazarda tutilgan doirada va hollarda elektron imzo bilan elektron hujjatni imzolash uchun Foydalanuvchi Huquq egasi tomonidan shakllantirilgan va Dasturda Foydalanuvchi ko‘rsatgan telefon raqamiga xabar ko‘rinishida kelgan raqamli, harfli, ishorali yoki kombinatsiyalangan kodlardan foydalanadi. Bunday kodlar elektron imzo kaliti bo‘lib hisoblanadi.

1.6.3. Foydalanuvchi olingan kodlar (elektron imzo kalitlari) bo‘yicha maxfiylikni saqlashi shart.

1.6.4. Foydalanuvchi tegishli kodni Dasturdagi maxsus shaklga kiritadi. Taraflar bitta seans doirasida (tegishli kodning amal qilish muddati davomida) Dastur funksiyalari orqali Foydalanuvchi tomonidan shakllantirilgan, foydalaniladigan va Huquq egasiga yuboriladigan barcha elektron hujjatlar shu tariqa Foydalanuvchining elektron imzosi bilan imzolangan bo'lib hisoblanishini tan oladilar.

1.6.5. Foydalanuvchi Dasturda o‘zi haqida ko‘rsatilgan axborotning to‘g‘riligiga kafolat beradi. Ko‘rsatilgan axborot asosida Foydalanuvchi yuqorida ko‘rsatilgan tartibda elektron imzodan foydalanib imzolangan elektron hujjat aynan Foydalanuvchi tomonidan imzolanganligini aniqlaydi.

1.7. Agar foydalanuvchi Huquq egasi hamkorining vakili bo‘lsa, ushbu Litsenziyaning 1.6.1 – 1.6.5 bandlarining qoidalari Huquq egasi va Huquq egasining bunday hamkori o‘rtasidagi kelishuvlar va shartnomalarga zid bo‘lmagan qismida qo‘llaniladi.

1.8. Foydalanuvchi Huquq egasiga Dastur doirasida Foydalanuvchi tomonidan taqdim etilgan axborotdan foydalanish huquqini shunday axborotni Huquq egasining ma‘lumotlar bazasiga kiritish va keyinchalik bunday ma‘lumotlar bazasidan istalgan usulda foydalanish yo‘li bilan beradi.

1.9. Ushbu Litsenziya va Dasturdan foydalanish bilan bog‘liq barcha munosabatlarga nisbatan Niderlandiyaning qonunchiligi qo‘llaniladi va ushbu Litsenziyadan yoki Dasturdan foydalanishdan kelib chiqadigan har qanday shikoyatlar yoki da‘volar Huquq egasi joylashgan joy bo‘yicha sudga berilishi va ko‘rib chiqilishi lozim.

1.10. Huquq egasi Foydalanuvchilarga axborot xabarlarini yuborishga haqli. Dasturdan foydalangan holda, Foydalanuvchi reklama va axborot xabarlarini olishga ham rozilik beradi. Foydalanuvchi qo‘llab-quvvatlash xizmatiga tegishli tarzda murojaat qilish yoki olingan reklama xabarida ko‘rsatilgan yo'riqnomalarga rioya qilish orqali reklama xabarlarini olishni rad etishga haqli.

1.11. Foydalanuvchining mintaqasiga qarab, Dasturning barcha yoki ayrim funksiyalari mavjud bo‘lmasligi yoki cheklangan boʻlishi mumkin. Ma’lum bir mintaqadagi Foydalanuvchi uchun funksiyalar, agar bunday Foydalanuvchi ulardan ochiqdan-ochiq foydalana olmasa, mavjud emas (cheklangan) deb hisoblanadi. Ushbu cheklovlarni chetlab o‘tish uchun har qanday texnik yoki dasturiy uslublardan foydalanish taqiqlanadi. Ushbu Litsenziya va 1.5-bandda ko‘rsatilgan hujjatlarning Dasturning Foydalanuvchi uchun mavjud bo‘lmagan (cheklangan) funksiyalarini tartibga soluvchi qoidalari, bunday funksiyalar Foydalanuvchi uchun ochiqdan-ochiq mavjud bo‘lguncha qo‘llanilmaydi. Ma’lum bir mintaqadagi Foydalanuvchi uchun funksiyalar mavjudligi to‘g‘risidagi axborot Foydalanuvchiga uning Huquq egasiga yuborilgan so‘roviga ko‘ra taqdim etiladi.

 

2. Dasturga bo‘lgan huquqlar

2.1. Dasturga bo‘lgan mustasno huquq faqat Huquq egasiga tegishli.

 

3. Litsenziya

3.1. Huquq egasi oddiy (istisnosiz) litsenziya shartlarida Foydalanuvchiga Dasturdan butun dunyo mamlakatlarida quyidagi usullar bilan foydalanish uchun o‘tkazilmaydigan huquqni bepul beradi:

3.1.1. Dasturdan belgilangan maqsadda foydalanish, shu maqsadda Foydalanuvchining mobil qurilmasi(lar)iga undan nusxa ko‘chirish va o‘rnatish (takror o‘rnatish). Foydalanuvchi Dasturni cheklanmagan miqdordagi mobil qurilmalarga o‘rnatish huquqiga ega. Mobil qurilmaga o‘rnatishda, Dasturning har bir nusxasiga ayrim raqam beriladi, u avtomatik ravishda Huquq egasiga xabar qilinadi.

3.1.2. Dasturni notijorat maqsadlarda takror o‘rnatish va tarqatish (bepul).

 

4. Cheklovlar

4.1. Foydalanuvchi Huquq egasining yozma roziligisiz Dasturda foydalaniladigan algoritmlarning amalga oshirilishi haqida axborot olish maqsadida Dasturning obyekt kodini o‘zgartirish, dekompilyatsiya qilish, assemblerini o‘zgartirish, shifrini ochish yoki boshqa harakatlarni amalga oshirish, Dasturdan foydalanib hosila asarlar yaratish, shuningdek, Dasturdan, Dasturning har qanday tarkibiy qismlari, Dastur tomonidan Foydalanuvchining mobil qurilmasida saqlanadigan xaritalar va boshqa tasvirlar hamda boshqa ma’lumotlardan boshqacha foydalanishni amalga oshirish (amalga oshirish uchun ruxsat berish) huquqiga ega emas, ushbu Litsenziyada yoki Rossiya Federatsiyasining qonun hujjatlarida to‘g‘ridan- to‘g‘ri nazarda tutilgan hajmda va usullar bilan foydalanish bundan mustasno.

4.2. Foydalanuvchi Huquq egasining yozma roziligisiz Dasturni tijorat maqsadlarida (shu jumladan haq evaziga), shu jumladan dasturiy mahsulotlar to‘plamining bir qismi sifatida takror o‘rnatish va tarqatish huquqiga ega emas.

4.3 Foydalanuvchi Huquq egasining yozma roziligisiz Dasturni uni olganidan farqli shaklda tarqatish huquqiga ega emas.

4.4. Dastur Yandex Pro nomi ostida ishlatilishi (shu jumladan tarqatilishi) kerak. Foydalanuvchi Dastur nomini, mualliflik huquqini muhofaza qilish belgisini yoki Huquq egasini ko‘rsatuvchi boshqa alomatlarni o‘zgartirish va (yoki) o‘chirishga haqli emas.

 

5. Dasturning ayrim funksiyalaridan foydalanish shartlari

5.1. Dasturning ayrim funksiyalari faqat Internetga kirish imkoni bo‘lganda bajarilishi mumkin. Foydalanuvchi o‘z aloqa operatori yoki Internetga kirish provayderining shartlarida va tariflari bo‘yicha bunday kirishni mustaqil ravishda oladi va to‘laydi.

5.2. Dasturning ayrim funksiyalari faqat Huquq egasi yoki Dasturning bunday funksiyalariga kirishni taqdim etadigan shaxs bilan alohida kelishuv tuzgan Foydalanuvchi uchun mavjud bo‘ladi.

5.3. Dasturdan, shu jumladan uning, tavsifi haydovchi kartochkasini shakllantirish servisidan foydalanish Shartlarida (https://yandex.com/legal/drivers_termsofuse_bv) keltirilgan va tartibga solinadigan ayrim funksiyalaridan foydalanganda, Foydalanuvchi Huquq egasiga Foydalanuvchining Maxfiylik siyosatida (https://yandexgo.com/legal/yandexgo_privacy_notice) aniqlangan atama mazmunini ifodalaydigan shaxsiy axborotini, Dasturning funksional imkoniyatlari taqdim etilishi maqsadida qayta ishlashga, Huquq egasi Foydalanuvchining shaxsiy axborotini Huquq egasining hamkorlariga Dasturning funksional imkoniyatlarini taqdim etishlari maqsadida bunday axborotni keyingi qayta ishlashlari uchun berishiga va haydovchi kartochkasini shakllantirish servisidan foydalanish Shartlarida belgilangan maqsadlarda, shuningdek, xuddi shu maqsadlarda Foydalanuvchining shaxsiy axborotini uchinchi shaxslardan olishiga rozilik beradi.

Huquq egasi Foydalanuvchining faqat ushbu maqsadlar uchun zarur bo‘lgan shaxsiy axborotini uzatadi va/yoki oladi. Huquq egasi Foydalanuvchining shaxsiy axborotini, shuningdek Foydalanuvchi tomonidan Dastur orqali yuklanadigan va taqdim etiladigan boshqa axborotni qayta ishlashni Maxfiylik siyosati (https://yandexgo.com/legal/yandexgo_privacy_notice) shartlariga muvofiq amalga oshiradi.

Ushbu bandning Foydalanuvchining shaxsiy va boshqa axborotini Huquq egasining qayta ishlashiga oid qoidalari Foydalanuvchi tomonidan Servisdan va uning funksiyalaridan foydalanish jarayonida olingan materiallar va axborotga nisbatan qo‘llaniladi.

Ushbu bandda ko‘rsatilgan rozilik foydalanuvchi tomonidan Dasturda ko‘rsatilgan, shuningdek Huquq egasi tomonidan uchinchi shaxslardan olingan axborotga, shu jumladan familiya, ism, otasining ismi, manzilga; shaxsini tasdiqlovchi asosiy hujjatning va transport vositasini boshqarish huquqini tasdiqlovchi hujjatning raqamiga; transport vositasini ro‘yxatdan o‘tkazish to‘g‘risidagi guvohnoma, ushbu hujjatlarning berilgan sanasi (va amal qilish muddati) va ularni bergan organ to‘g‘risidagi ma‘lumotlarga; Huquq egasiga nisbatan firibgarlik harakatlarining oldini olish uchun zarur bo‘lgan axborotga va Dasturdan foydalanish tartibiga, shu jumladan fotosurat, yo‘lovchilar va bagajlarni yengil taksida tashish uchun transport vositasini boshqarish bo‘yicha faoliyatni amalga oshirish huquqi to‘g‘risidagi ma‘lumotlarga, sodir bo‘lgan yo‘l harakati qoidalarining buzilishi va boshqa qonun buzarliklar to‘g‘risidagi ma‘lumotlarga (shu jumladan ochiq reyestrlarda ma’lumot joylashtirilgan qarzdorlik/ijro ish yurituvining borligiga) nisbatan qo‘llaniladi. Bunday shaxsiy axborot Huquq egasi tomonidan avtomatlashtirish vositalaridan foydalangan holda ham, undan foydalanmasdan ham, shuningdek to‘plash, qayd etish, tizimlashtirish, jamlash, saqlash, aniqlashtirish (yangilash, o‘zgartirish), chiqarib olish, foydalanish, uzatish (taqdim etish, kirishga ruxsat berish), egasizlantirish, bloklash, o‘chirish va yo‘q qilishni ham qo‘shganda har qanday usullar bilan qayta ishlanishi mumkin.

Amaldagi qonun hujjatlarida nazarda tutilgan hollarda, Foydalanuvchining ushbu bandda ko‘rsatilgan roziligi ushbu Litsenziyaning 1.6.–1.6.5-bandlarida belgilangan tartibda Foydalanuvchi bunday rozilik shakli uchun belgilangan rekvizitlarni ko‘rsatgan holda Foydalanuvchining elektron imzosi bilan imzolangan yozma ravishda berilgan deb hisoblanadi. Bunday rozilik, agar amaldagi qonunchilikda boshqa (qisqaroq yoki uzoqroq) muddat belgilanmagan bo‘lsa, Foydalanuvchiga Dasturning funksional imkoniyatlarini taqdim etish uchun zarur bo‘lgan muddat davomida, shuningdek undan keyin yana 3 (uch) yil davomida amal qiladi.

5.4. Foydalanuvchi, "YANDEX ZAPRAVKI "MCHJ XK (ro'yxatdan o'tish raqami 2480770, manzili: Toshkent shahri, Yunusobod tumani, Shahrisabz ko'chasi, 2-uy) tomonidan taqdim etiladigan “Yandex.Zapravki” xizmatiga kirish bilan bog'liq dasturning funktsional imkoniyatlaridan foydalanganda, Internet tarmog‘ida https://yandex.com/legal/zapravki_termsofuse_uz manzil bo‘yicha joylashtirilgan “Yandex.Zapravki” xizmati foydalanish shartlarini ushbu bandda ko'rsatilgan qo'shimchalar bilan qabul qilgan deb hisoblanadi:

5.4.1. “Yandex.Zapravki” xizmatiga kirish bilan bog'liq dasturning funktsional imkoniyatlaridan foydalanganda foydalanuvchining “Yandex.Zapravki” xizmatidagi avtorizatsiyasi, foydalanuvchining dasturdagi ma'lumotlari bo'yicha amalga oshiriladi.

5.4.2. “Yandex.Zapravki” xizmatiga kirish bilan bog'liq dasturning funktsional imkoniyatlaridan foydalanganda, foydalanuvchi ushbu litsenziyaning 5.3-bandida ko'rsatilgan rozilikka qo'shimcha ravishda, “Yandex.Zapravki” xizmatidan foydalanish imkoniyatini berish uchun huquq egasiga "YANDEX ZAPRAVKI "MCHJ XKga o'tkazish (shuningdek "YANDEX ZAPRAVKI "MCHJ XKdan olish) orqali Foydalanuvchining shaxsiy ma'lumotlarini qayta ishlashga rozilik beradi.

5.4.3. Boshqa barcha hollarda, “Yandex.Zapravki” xizmatiga kirish bilan bog'liq dasturning funktsional imkoniyatlaridan foydalanganda foydalanuvchi “Yandex.Zapravki” xizmatidan foydalanish shartlari qoidalariga amal qiladi.

5.5. Foydalanuvchi ushbu bilan Dasturdan foydalanganda Huquq egasiga quyidagi axborot avtomatik ravishda va anonim tarzda uzatilishi to‘g‘risida xabardor qilinadi va bunga rozilik bildiradi: Foydalanuvchi qurilmasi operatsion tizimining turi, brauzer versiyasi va identifikatori, Dastur funksiyalaridan foydalanish statistikasi, qurilmaning joylashgan yeri haqida ma‘lumotlar, shuningdek boshqa texnik axborot.

 

6. Litsenziya bo‘yicha javobgarlik

6.1. Dastur “qanday bo‘lsa shunday” (as is) shartlarida taqdim etiladi. Huquq egasi Dasturning yoki uning alohida komponentlari va (yoki) funksiyalarining xatosiz va uzluksiz ishlashi, Dasturning Foydalanuvchining muayyan maqsadlariga muvofiqligi bo‘yicha hech qanday kafolatlar bermaydi, Ma’lumotlarning ishonchliligi, aniqligi, to‘liqligi va o‘z vaqtida bo‘lishini kafolatlamaydi, shuningdek ushbu Litsenziyada to‘g‘ridan- to‘g‘ri ko‘rsatilmagan hech qanday kafolatlarni bermaydi.

6.2. Huquq egasi Dasturdan (shu jumladan Ma’lumotlardan) foydalanish yoki foydalana olmaslikning to‘g‘ridan-to‘g‘ri yoki bilvosita oqibatlari va (yoki) Foydalanuvchiga va (yoki) uchinchi shaxslarga har qanday foydalanish, foydalanmaslik yoki Dasturdan (shu jumladan, Ma’lumotlardan) yoki uning alohida komponentlari va (yoki) funksiyalaridan foydalana olmaslik natijasida, shu jumladan Dasturning ishlashidagi mumkin bo‘lgan xatolar yoki nosozliklar tufayli yetkazilgan zarar uchun javobgar bo‘lmaydi, qonun hujjatlarida to‘g‘ridan- to‘g‘ri nazarda tutilgan hollar bundan mustasno.

6.3. Dasturdan foydalanish/foydalanish mumkin emasligi, shuningdek, Dasturning qonun hujjatlari va (yoki) uchinchi shaxslarning huquqlarini buzish ehtimoli bilan bog‘liq bo‘lgan barcha savollar va shikoyatlar qayta aloqa shakli orqali yuborilishi kerak.

 

7. Dasturning yangilanishlari/yangi versiyalari

7.1. Ushbu Litsenziyaning amal qilishi Dasturning barcha keyingi yangilanishlari/yangi versiyalariga nisbatan qo‘llanadi. Dasturning yangilanishini/yangi versiyasini o‘rnatishga rozilik bildirgan holda, Foydalanuvchi dasturning tegishli yangilanishlari/yangi versiyalari uchun ushbu Litsenziya shartlarini, agar Dasturning yangilanishi/yangi versiyasi boshqa Litsenziya kelishuvi bilan tartibga solinmasa, qabul qiladi.

 

8. Ushbu Litsenziya shartlariga o‘zgartirishlar

8.1. Ushbu litsenziya kelishuvi Huquq egasi tomonidan bir tomonlama tartibda o‘zgartirilishi mumkin. Foydalanuvchiga ushbu Litsenziya shartlariga kiritilgan o‘zgartirishlar to‘g‘risidagi xabar quyidagi manzil bo‘yicha joylashtiriladi: https://yandex.com/legal/yandexpro_mobile_agreement. Litsenziya shartlariga kiritilgan o‘zgartirishlar, agar tegishli nashrda boshqacha qoida nazarda tutilgan bo‘lmasa, ular Chop etilgan kundan boshlab kuchga kiradi.
