Welcome to Yango Market platform ("Platform") owned and managed by Yango Market Israel Ltd. ("Company", "Yango").

On this page, you will find the terms of use for users of Yango Market services. Please, note that a performance of any action in the application or on the platform means your consent to the Terms of Use and that you shall abide by these terms.

These Terms of Use are written in a masculine gender for the convenience of use only and are equally applicable to both genders.

The company may make amendments to the Terms of Use at its sole discretion. Amendments to the Terms of Use shall enter into force once they are published on the platform, by law, with no preliminary notification being necessary. Please note that material amendments to the Terms of Use will be accompanied by preliminary notification on the main page of the platform. Your continued use of the platform and the services provided thereon after the amendments to the Terms of Use have taken effect will mean your consent with and acceptance of such new Terms of Use.

Amendments to the Terms of Use shall take legal effect once they are published on the platform, so you should check for updates of the Terms of Use and the Privacy Policy from time to time.

 

1. Terms

“The Platform” — Yango Market Platform is a digital retail platform owned and managed by Yango Market Israel Ltd. The use of the Platform is possible on devices with an IOS operating system or with an Android operating system only that allows access to the Yango Market database. The database is an information and reference system containing information about the goods, intended for potential buyers (consumers) of the goods.

“User” — Anyone who uses the Platform and/or performs any action on the platform, including an individual who makes a purchase on the platform and uses the Yango Market service. By actually acting on the platform, the user declares that he has read these terms of use, that he agrees to their instructions, that the purchase process on the platform will be subject to the conditions detailed in these terms of use, and that the user or anyone on the user behalf will not have any claim against the Company or anyone on its behalf, including any of its employees or affiliated companies, except for claims related to the Company's express commitment according to these Terms of Use. .

“Product” or “Seller's products” — the variety of products and goods that exist on the Platform and are offered for purchase on the Platform by the Seller, including electrical products, consumer products, household products, and consumable products and other good, offered by the Seller in the Yango Market service. Yango is not the seller of the goods offered on the platform.

“Seller” — means an entity which offers users the chance to buy products and goods remotely, using the Yango Market Platform and service. For clarification, Yango Market is not the Seller of the Products and is not an entity authorized by the Seller to accept and satisfy the requirements of Users about the Products.

“Store” — a designated area within the Platform where the Seller can display the variety of products and goods that are offered to the User to order.

“Services” — means the services for organizing the delivery of goods and products purchased by the User from the Sellers on the Platform, which are provided to the User by Yango Market .

“Order” — means selecting and purchasing products on the Platform, while implementing actions performed by the User that are aimed for, according to the matter:

  • An agreement with Yango Market for the provision of services for organizing delivery of the selected products and goods,
  • A purchase agreement for the relevant products and goodswith the Seller.

“Yango Market” — Yango Market Israel LTD, Registration No: 516495199, official address: 20 Lincoln St. Tel Aviv Yafo.

The Terms of Use may contain phrases or terms that are undefined in section 1. In such a case, these terms will be interpreted according to the text of the Terms of Use. In the absence of an unambiguous interpretation of the term in the terms of use, the term should be interpreted as defined: first - on the platform, and secondly - in accordance with the legislation of the State of Israel.

 

2. General Provisions

2.1. By using the Yango Market Platform, the User agrees with these Term of use, as well as with the following documents governing the use of the Platform:

2.2. The services and/or some of them are "location-based services" using positioning software (GPS) for the determination of your location. Please, note that some services may not be provided without the user's consent for the use of that software, therefore, the user grants their consent for Yango to use positioning software to send an order to the address specified by the user. It should be noted that on the platform you can see a variety of products and stores, however, due to the location-based services, the ability to order from a particular store depends on its geographic location and its partnership with the platform.

2.3. When registering and/or placing an order, the User should provide their personal data such as phone and/or e-mail address, as well as data on their location or place where the user wants to order delivery. Payment an order will be made by credit card only. Yango may revise the Platform policy and the provision of details and define additional methods of identification for signing up to the Platform.

2.4. When the User uses the Platform, personal information is processed on the conditions and for the purposes specified in the Privacy Policy.

2.5. The use of the platform is intended exclusively for private and personal purposes, and the sale of products and services on the platform is not intended for wholesale or reselling business (purchase of a certain number of products on the platform with the aim to sell them to other customers). Do not copy, use, or convey any content from the platform to others for copying or utilization for purposes other than for private and personal use.

2.6. The user may use the platform and the services in accordance with the terms of use only. Do not use or allow others to use the platform and the services in violation of the terms of use.

2.7. The company may make amendments to the Terms of Use at its sole discretion. Amendments to the Terms of Use shall enter into force once they are published on the platform, by law, with no preliminary notification being necessary. Please note that material amendments to the Terms of Use will be accompanied by preliminary notification on the main page of the platform. Your continued use of the platform and the services provided thereon after the amendments to the Terms of Use have taken effect will mean your consent with and acceptance of such new Terms of Use.

2.8. The company sends users marketing pushes (the "Pushes") to elevate user experience in the application according to the activity in the application as well as part of the activity updates and sales promotions. When useing the application, you agree to receive Pushes from the company through the application as stated above. You can stop receiving the above-mentioned by closing this option through the device settings on Android or IO.

2.9. If a product offer on the Platform is shown with a discount, then the amount of such discount is determined automatically based on the information provided by the seller (store) about the new and old prices by subtracting the new price from the old one, determining the amount of the discount as a percentage of the old price and rounding the final discount value to the integer numbers according to general mathematical rules.2.10. Yango Market reserves the right, at its discretion, to restrict and/or block access of a user to the platform and/or take any other measure in case of discovery of several private accounts used by the User or a violation of these Terms of Use and/or of the provisions of the law, damage to the rights and interests of third parties and/or the company, concerns for public safety or in the case of the company's legal obligations. Moreover, if the Seller or Yango Market detects that the User has made orders to obtain commercial gain, for resale, revealing acts of purchase or resale by the User of a large number of Goods, Yango Market reserves the right to restrict or completely block access to the use of the Platform for such a Buyer.

2.11. The User is responsible for the safety and confidentiality of the registration data (login and password). All actions performed on the Platform using the User's login and password are considered to have been performed by the User.

2.12 Any use of the Platform by a minor (under 18) requires the consent of the minor’s parent or legal guardian. If such consent is not received, the minor may not use the Platform.

 

3. Purpose of the Platform, & Service Description

3.1. The Platform connects Users and Sellers, in which the users are given the opportunity to buy the products offered by the Sellers on the platform and also provides relevant information (according to the search results) about the Products offered by the Sellers. The information about the Products on the platform is provided by the sellers, including but not limited to, information on product prices, their characteristics, and instructions for use. The seller is responsible for providing accurate and up-to-date information about his products as well as any information required by law.

3.2. When placing an order for the services for organizing the delivery of Products and goodson the Platform, the User concludes:

3.2.1. an agreement for the provision of Services for organizing the delivery of Products and goods with Yango Market.

3.2.2. as well as sale and purchase agreements for the relevant Goods with the Sellers.

Within the framework of the sale and purchase agreement for the Products and goods concluded on the Platform, the User enters into direct contractual relations with the Seller from which he purchases the Products.

Within the framework of the agreement concluded on the Platform for the provision of services for organizing the delivery of Goods, the User enters into a direct contractual relationship with Yango Market.

3.3. Before placing an Order on the Platform, the User undertakes to familiarize himself with all the conditions for the provision of Yango Market Services, as well as the purchase of Products and goods, and information about the Seller on the Platform. At the same time, obvious errors, including typos, made in the description of the Goods or the description of the Service, are not legally binding.

3.4. The essential conditions of the sale and purchase agreement for the Goods concluded by the User with the Seller are indicated in the description of the Goods published on the Platform, provided by the Seller in the form of placing an Order on the Platform.

3.5. The essential conditions of the agreement for the provision of services for organizing the delivery of the Products and goodsconcluded by the User with Yango Market are indicated in the order form on the Platform and in these Terms of Use.

3.6. By placing an Order, the User agrees that the Seller can assign the execution of the sale and purchase agreement for the Goods to a third party while remaining responsible for its execution to the User, and also agrees that Yango Market can assign the execution of the agreement for the provision of services of organizing the delivery of the Goods to a third party remaining responsible for its execution to the User.

3.7. The User gives Yango Market consent to the processing of the User's personal information, as this term is defined in the Privacy Policy, to provide the functionality of the Platform, to transfer the User's personal information to Yango Market partners who post product offers on the Platform, and their authorized representatives for further processing such information in order to provide the User with the functionality of the Platform for searching and familiarizing himself with product offers, sending requests to such partners for the purchase of the relevant goods, as well as for Yango Market to receive the User's personal information from third parties, including the specified Yango Market partners, Yango Market affiliates (in terms of de-identified information), in order to provide the User with the functionality of the Platform to receive (including based on search results) product offers and information relevant to the interests of the User. The User also gives Yango Market consent to Yango Market transferring the User's personal information to Yango Market affiliates to provide the User with personalized services of such persons and target promotional materials.

The User agrees that the personal information provided by the User to Yango Market when using the Platform may be transferred by Yango Market:

  • to the Seller with which the User enters into a sale and purchase agreement for the Products and goods;
  • to a third party attracted by Yango Market for the purpose of executing an agreement for the provision of services for organizing the delivery of the Products to the User;
  • to credit institutions participating in transactions performed by the User using payment cards when paying for the Products on the Platform, in order to confirm, at the request of the credit institution, the implementation of such transactions.

Yango Market may share with the entities indicated above and/or receive from these entities personal details of the user that are required only for the specified purposes indicated above. The processing of the User's details by Yango Market as well as other information on behalf of the User on the platform, is carried out according to the conditions of these Terms of Use above and the Privacy Policy.

The User is hereby notified, understands and agrees that when using the Platform to provide the User with the functionality of the Platform, the following impersonal information is automatically transmitted to Yango Market: the type of operating system of the User's device, the version and identifier of the browser, statistics on the use of the Platform's functions, and other technical information.

The User agrees that Yango Market has the right to store the above personal information of the User, as well as the personal information of the recipient of the Order specified by the User during the period of use by the User of the Platform and at least three years from the date of the last use of the Platform by the User.

The User guarantees that he has the right to provide the specified consent to (for) third parties (recipients of the Order) and is responsible if there will be a violation of thiswarranty, which causes losses to Yango Market, in the amount of such losses and legal costs of Yango Market, or costs of Yango Market for settling the claims of third parties when such claims are related to the violation by the User of the warranty specified in this clause.

3.8. By placing an order on the Platform, the User agrees to receive (i) emails/push notifications that Yango Market may send to the User: after placing the Order; in case of its change; before the date of delivery of the goods, in case of cancellation of the Order by the store, in other cases affecting the execution of the Order or timely informing about its status, (ii) messages (SMS) to the phone number specified by the User, as well as (iii) a call to the phone number specified By the User, with a proposal to evaluate the quality of the Platform and the Seller and/or inform about the reasons for the change of the Order/delivery date by the User.

3.9. By placing an Order, the User confirms that (a) he is fully familiar with the provisions of these Terms of Use, (b) fully understands these Terms, as well as the subject and conditions of the agreement concluded with Yango Market for the provision of services for organizing the delivery of the Products and goods, as well as the sale and purchase agreement with the Seller, c) he fully understands the meaning and consequences of its actions concerning the conclusion and execution of agreements concluded on the Platform.

3.10. Yango Market has the right to block the User's ability to place an Order in the event of repeated cancellation of the Orders made by the User, as well as in case of violation of these Rules.

3.11. The User is obliged to provide reliable information about himself and the recipient of the Order when placing an Order on the Platform. The indication by the User of inaccurate, incorrect, non-existent information is equated by the Seller to the User's evasion from receiving the Order and is the basis for canceling the Order.

3.12. The information on the stock of the Products and goodsavailable on the Platform is specified when the User places an Order and may change at the time of placing the Order due to the technical features of the Platform's operation.

3.13. Yango Market has the right to conduct promotional events on the Platform, which the User becomes aware of through the relevant rules of the promotional event, and/or by visual change of the price of the corresponding Goods on the Platform.

3.14. The appearance of the Goods and/or packaging may be changed by the manufacturer and differ from those shown on the Platform, while the functionality and purpose of the Goods does not change.

 

4. Placing an Order & Conclusion of agreements on the Platform

4.1. Within the framework of one Order, the User has the opportunity to conclude an agreement for organizing the delivery of the Products and goodsof several Sellers by concluding sale and purchase agreements for the specified Products and goodswith them.

4.2. The User shall place an Order by specifying all the data necessary for the execution of agreements between Yango Market and the Seller, including but not limited to: the User's personal information, delivery method, delivery address, full name of the recipient of the order, contact information, payment method.

4.3. The conclusion by the User of an agreement for the provision of services for organizing the delivery of goods and sale and purchase agreements for goods shall be carried out:

at the moment the User clicks the "Pay" button (subject to the confirmation of the Order being sent to the User).

After clicking the "Pay" button, the User has 20 minutes to make payment. In the event that no payment has been made within the specified time period for any reason, agreements with Yango Market and Sellers are not considered concluded.

4.4. The performance by the User of the actions specified in clause 4.3 of the Terms means the full and unconditional consent of the User to the Conditions, as well as the terms of the agreements concluded with Yango Market and the Seller.

4.5. At the moment the User performs the actions specified in clause 4.3 of the Terms (unless otherwise specified in the Terms), mutual obligations arise between Yango Market and the User (within the framework of the agreement for the provision of services for organizing the delivery of Products and goods), the Seller and the User (within the framework of the sale and purchase agreement for the Products and goods).

 

5. Payment for the Order

5.1. A User who places an Order is given the opportunity to pay by means of a credit card owned by the user, for the Services and goods directly on the Platform when placing the Order (for example, by credit card, or or by other methods as available on the Platform).

5.2. Payment is made to the account of Yango Market, which, in terms of accepting funds in payment for the Products and goods, acts on behalf of the relevant Seller with the involvement of an authorized payment processor or an electronic money operator and is the recipient of the payment as an agent of the Seller.

5.3. Yango Market does not guarantee the availability of cashless payment at any time.

5.4. In the cases provided for by the current legislation the cashier's receipt is sent to the e-mail address specified by the User when placing the Order.

 

6. Cancellation of Order & Return of Products

6.1. Cancellation of the order by the Seller

The Seller may cancel the Order in the following cases:

  • if the User has not paid for the Order;
  • if the Seller failed to contact the User/recipient of the Order using the contact information specified by the User in the Order;
  • in other cases when the Seller cannot fulfill the Order;
  • the User's refusal of the Products and goodsin cases stipulated by law;
  • evasion of the User from receiving the Order (Goods).

6.2. Cancellation of the Order by the User

If the User wants to cancel the Order placed on the Platform, to return the Goods included in it, the User shall contact the Seller of the Goods, the information about which is brought to the attention of the User on the Platform.

6.3. Refunds of the cash paid by the User for the Goods are made by the Seller, information about which is brought to the attention of the User on the Platform, on the basis, in the manner and within the terms established by the current legislation.

 

7. The service of Product delivery organization

7.1. The cost of the Services for each Order is determined following the prices indicated when placing the Order on the Platform. The delivery time is indicated on the Platform when placing an Order. Yango Market has the right to update the prices on the Platform from time to time, following the sellers' pricing and at its discretion to change the prices listed on the product page unilaterally.

7.2. For the avoidance of doubt, neither Yango Market nor the third party involved by it to provide the Services (subcontractor) are the sellers of the Goods, unless otherwise explicitly stated in the Order.

7.3. The User is obliged to pay for the Services in the manner prescribed by the Rules.

7.4. Yango Market is not responsible for non-fulfillment or improper fulfillment of obligations for the provision of the Services in any of the following cases:

  • if this was the result of non-compliance with these terms of use by the User;
  • in the absence of the User (the recipient specified by him) at the address of the Order delivery within the period agreed with the User (recipient);
  • if it was not possible to contact the User (recipient) using the data specified when placing the Order to discuss the details and the time of delivery of the Order;
  • if this was the result of force majeure circumstances: natural disasters, suspension of communication routes, snow drifts;
  • if the Consignment, is accepted in closed form and there is no external damage to the packaging;
  • unless the User has taken other actions necessary to receive the Goods at the place of pickup according to the procedure and conditions of delivery indicated on the Platform for certain methods of delivery of the Goods.

 

8. Other terms and conditions

8.1. The user acknowledges that he is legally competent and has reached the age required by the law to carry out transactions provided for in these Terms.

9.2. If Yango Market detects violations of the Rules by the User and/or the User's unfair actions within the framework of the Promotions being held, Yango Market reserves the right to terminate the User's participation in the Promotion and/or cancel the orders placed by the User on the Platform. At the same time, Yango Market independently determines the methods and grounds for recognizing the User's actions as unfair and/or violating these Rules and has the right not to disclose this information to third parties.

8.4. Yango Market is not responsible for:

8.4.1. Temporary disruptions and interruptions in the operation of the Platform and the loss of information caused by them, as well as the safety of information, the correctness and timeliness of its transmission and delivery.

8.4.2. Reliability, quality and speed of the Platform and the safety of the information created, used and received by the User.

8.5. The Agreement is drawn up in English and Hebrew. In the event of any discrepancy, the Hebrew version shall prevail.

בעמוד זה מפורטים תנאי השימוש למשתמשים בשירותי Yango Market. עצם ביצוע פעולה ביישום או בפלטפורמה מהווה את הסכמתך ואישורך לתנאי השימוש והתחייבותך לפעול על פיהם.

תוכן תנאי שימוש זה מנוסחים בלשון זכר מטעמי נוחות בלבד. ההתייחסות הינה לשני המינים כאחד. החברה רשאית לבצע שינויים בתנאי השימוש בכל עת, בהתאם לשיקול דעתה הבלעדי. שינויים בתנאי השימוש יכנסו לתוקף מיום פרסומם בדפי הפלטפורמה, בהתאם להוראות הדין, ללא מתן הודעה מוקדמת. לתשומת לבך כי שינויים מהותיים בתנאי השימוש ילוו בהודעה מוקדמת על כך במסך הבית של הפלטפורמה. המשך שימושך בפלטפורמה ובשירותים הניתנים בה לאחר עריכת השינויים בתנאי השימוש כאמור יעידו על הסכמתך וקבלתך את תנאי השימוש החדשים.

תוקפו של שינוי בתנאי השימוש יחל מרגע פרסומו בפלטפורמה ועל כן עליך להתעדכן בתנאי השימוש ומדיניות הפרטיות מעת לעת.

 

1. מונחים והגדרות

"הפלטפורמה" — פלטפורמת Yango Market הינה אפליקציה קמעונאית בבעלותה ובניהולה של חברת Yango Market ישראל בע"מ. השימוש בפלטפורמה אפשרי במכשירים עם מערכת הפעלה מסוג IOS או עם מערכת הפעלה מסוג אנדרואיד (android) בלבד -שמאפשרים גישה לבסיס הנתונים של Yango Market. בסיס הנתונים מהווה מערכת מידע אינפורמטיבית לגבי מגוון המוצרים שמיועדת למשתמשים ולצרכנים פוטנציאליים.

"המשתמש" — כל מי שמבצע פעולה כלשהי בפלטפורמה, לרבות אדם המבצע רכישה בפלטפורמה ומשתמש בשירות Yango Market. המשתמש מצהיר בעצם ביצוע פעולה בפלטפורמה, כי הוא קרא את תנאי שימוש אלה, כי הינו מסכים להוראותיהם ולכך שתהליך הרכישה בפלטפורמה יהא כפוף לתנאים המפורטים בתנאי שימוש אלה וכי לא תהיה לו או למי מטעמו כל טענה או תביעה כנגד יאנגו או מי מטעמה או מי ממנהליה, עובדיה ו/או חברות הקשורות אליה, למעט טענות הקשורות בהתחייבות מפורשת של יאנגו בהתאם לתנאי שימוש אלה.

"מוצר" או ״מוצרי המוכר״ — מגוון המוצרים אשר קיימים ומוצעים לרכישה בפלטפורמה על ידי העוסק ביניהם מוצרי חשמל, מוצרי צריכה, מוצרים לבית, מוצרים מתכלים, המוצעים על ידי המוכר בשירות יאנגו מארקט. יאנגו איננה המוכרת של הסחורה המוצעת בפלטפורמה.

"המוכר" — עוסק אשר מציע למשתמשים לקנות את מוצריו במכר מרחוק, באמצעות הפלטפורמה ושירות Yango Market. יובהר כי המוצרים הינם בבעלות ובאחריות המוכר, ליאנגו אין אחריות בכל הקשור לדרישות ביחס למוצרים.

"חנות" — אזור ייעודי בפלטפורמה בו המוכר יכול להציג את מגוון מוצרים שהוא מציע למשתמש להזמין באמצעות הפלטפורמה.

"שירות" — שירותי אספקת המוצרים הנרכשים על ידי המשתמש מהמוכר באמצעות הפלטפורמה ומסופקים על ידי שירות Yango Market.

"הזמנה" — פירושה בחירה ורכישת מוצרים בפלטפורמה, תוך ביצוע פעולות על ידי המשתמש שמטרתן לפי העניין :

  • עסקה עם החברה למתן שירותי ארגון ואספקת המוצרים שנבחרו בהזמנה.
  • עסקה עם המוכר לרכישת המוצרים שלו במסגרת הפלטפורמה.

"Yango Market" — יאנגו מרקט ישראל בע"מ, מספר ח.פ 516495199, כתובת רשמית: רח' לינקולן 20 , ת"א-יפו.

תנאי השימוש עשויים להכיל מונחים שאינם מוגדרים בסעיף 1 לעיל. במקרה זה, המונח כאמור יתפרש בהתאם לנוסח תנאי השימוש. בהעדר פרשנות חד משמעית למונח בנוסח תנאי השימוש, יש לפרש את פרשנות המונח, כפי שהוא מוגדר: ראשית - בפלטפורמה, ושנית - חקיקת מדינת ישראל.

 

2. הוראות כלליות

2.1 השימוש בפלטפורמה של Yango Market משמעו כי המשתמש מסכים לתנאי השימוש הנ"ל וכמו כן כפוף למסמכים הבאים שקובעים את השימוש בפלטפורמה, ביניהם :

- רישיון לשימוש במנוע החיפוש של יאנדקס (https://yandex.com/legal/termsofuse)

- תנאי שימוש על ידי המשתמשים בשירותי יאנדקס (https://yandex.com/legal/rules)

-מדיניות הפרטיות (https://yandex.com/legal/confidential)

-תנאי שימוש עבור שוברים לקידום מכירות של פלטפורמת Yango Market (https://yandex.com/legal/yangomarket_promocode) (נקראים ביחד "מסמכים רגולטוריים")

2.2 השירותים ו/או חלקם הינם "שירותים מבוססי מיקום" הנעזרים בתוכנות ניווט (GPS) על מנת לקבוע את מיקומך. לתשומת לבך, לא ניתן לספק חלק מהשירותים ללא הסכמת המשתמש לשימוש בתוכנות אלו, לפיכך, המשתמש נותן הסכמתו לכך שיאנגו תיעזר בתוכנות ניווט על מנת לשלוח את ההזמנה אל הכתובת המבוקשת בידי המשתמש. יש לציין כי במסגרת הפלטפורמה ניתן לראות את מגוון המוצרים והחנויות אולם בשל היות השירותים מבוססי מקום יכולת ההזמנה מחנות מסוימת תלויה במיקומה הגיאוגרפי ובשותפות המוכר עם הפלטפורמה.

2.3 בעת ההרשמה ו/או לשם ביצוע הזמנה, המשתמש יידרש למסור פרטים אישיים, כגון טלפון ו/או כתובת דואר אלקטרוני, וכן פרטי המיקום שלו או מיקום אליו הוא רוצה לבצע את הזמנת המשלוח. כמו כן, התשלום עבור ההזמנה יתבצע באמצעות כרטיס אשראי בלבד. יאנגו רשאית לשנות את מדיניות הפלטפורמה ומסירת הפרטים ולקבוע דרכי זיהוי נוספות בעת ההרשמה לפלטפורמה.

2.4 מידע פרטי עבור המשתמש בפלטפורמה נקלטת בהתאם לתנאים ולמטרות שנקבעו על פי מדיניות לשמירת סודיות.

2.5 השימוש בפלטפורמה הינו למטרות אישיות ופרטיות בלבד, ומכירת המוצרים והשירותים בפלטפורמה אינה מיועדת למכירה סיטונאית או למכירה חוזרת (רכישת כמות מוצרים מהפלטפורמה לצורך מכירתם ללקוחות אחרים). אין להעתיק, להשתמש, לאפשר לאחרים להעתיק או להשתמש בתכנים מתוך הפלטפורמה או הקשורים בה לכל מטרה שאיננה לצורך שימוש פרטי ואישי.

2.6 המשתמש רשאי להשתמש בפלטפורמה ובשירותים רק בהתאם לתנאי השימוש. הוא אינו רשאי להשתמש או לאפשר לאחרים להשתמש בפלטפורמה או בשירותים שלא בהתאם להוראות תנאי השימוש.

2.7 החברה רשאית לבצע שינויים בתנאי השימוש בכל עת, בהתאם לשיקול דעתה הבלעדי. שינויים בתנאי השימוש יכנסו לתוקף מיום פרסומם בדפי הפלטפורמה, בהתאם להוראות הדין, ללא מתן הודעה מוקדמת. המשך שימושך בפלטפורמה ובשירותים הניתנים בה לאחר עריכת השינויים בתנאי השימוש כאמור יעידו על הסכמתך וקבלתך את תנאי השימוש החדשים.

2.8 החברה שולחת למשתמשים פושים שיווקיים (להלן: "פושים") לשם קידום חוויית המשתמש באפליקציה בהתאם לפעילות באפליקציה וכן במסגרת עדכוני פעילות וקידומי מכירות. יובהר כי, עם השימוש באפליקציה הינך מאשר לקבל פושים על ידי החברה באמצעות האפליקציה כאמור לעיל. ניתן להפסיק את קבלת הפושים כאמור על ידי סגירת אפשרות זו דרך הגדרות המכשיר באנדרואיד או IOS.

2.9 אם במסגרת הצגת המוצר בפלטפורמה פורסמה הנחה, אז גובה ההנחה נקבע אוטומטית על סמך המידע שהוצג על יד המוכר (בחנות המוכר בפלטפורמה) לגבי המחיר החדש והישן בדרך חיסור מהמחיר הישן את המחיר החדש, קביעת גובה ההנחה באחוזים מהמחיר הישן ועיגול תוצאת ההנחה למספר שלם מתבצע על פי חוקי חשבון.

2.10 Yango Market שומרת על זכותה, על פי שיקול דעתה הבלעדי, להגביל גישה ו/או לחסום שימוש בפלטפורמה ו/או לנקוט בכל אמצעי אחר במקרה של הפרת תנאי שימוש אלה ו/או ההתגלות של מספר חשבונות פרטיים שבשימושו של המשתמש ו/או הפרת הוראות הדין, פגיעה בזכויות ואינטרסים של צדדים שלישיים ו/או החברה, חששות לביטחון הציבור או במקרה של ההתחייבויות המשפטיות של החברה. זאת ועוד, אם המוכר ו/או Yango Market יגלו כי ביצועי הזמנות על ידי המשתמש נעשו במטרה לקבל רווח עסקי, במטרת מכירה חוזרת, גילוי מעשי קנייה בכמויות ומכירה חוזרת של הסחורה בכמויות גדולות על ידי המשתמש, Yango Market שומרת על זכותה להגביל או לחסום כלל למשתמש מסוג זה את שימושו בפלטפורמה.

2.11 המשתמש אחראי על בטיחות וסודיות פרטיו (שם משתמש וסיסמא). כל הפעולות בפלטפורמה שבוצעו באמצעות שם המשתמש והסיסמא של המשתמש נחשבים כמעשיו של המשתמש.

2.12 כל שימוש על ידי משתמש קטין (מי שטרם מלאו לו 18 שנים), מחייב הסכמתו של הורה או אפוטרופוס על-פי חוק. ככל שהסכמה כאמור לא התקבלה, הקטין אינו רשאי להשתמש בפלטפורמה.

 

3. שימוש בפלטפורמה ותיאור השירות

3.1 הפלטפורמה מקשרת בין המשתמשים והמוכרים, במסגרתה ניתנת הזדמנות למשתמשים לקנות את המוצרים המוצעים על ידי המוכרים בפלטפורמה וכן מספקת מידע רלוונטי (בהתאם לתוצאות החיפוש) על המוצרים המוצעים על ידי המוכרים. המידע אודות המוצרים בפלטפורמה מסופק על ידי המוכרים, לרבות אך לא רק, מידע על מחירי מוצרים, מאפיינהם, הוראות שימוש. המוכר אחראי לספק מידע מדויק, ועדכני על מוצריו וכן כל מידע שנדרש על פי דין.

3.2 ביצוע הזמנת שירות לגבי הספקת הסחורה בפלטפורמה על ידי המשתמש מהווה:

3.2.1 הסכם למתן שירותי ארגון ואספקת המוצרים שנבחרו בהזמנה ע"י Yango Market.

3.2.2 וגם הסכמי רכישה של המוצרים- מכירה של הסחורה שהוזמנהמחנות המוכרים.

במסגרת הסכם הרכישה של המוצרים בפלטפורמה כאמור- המשתמש מתקשר בעסקאות מוסכמות עם המוכר שממנו רוכש את המוצרים. במסגרת הזמנה שנעשתה בפלטפורמה לגבי שירותי אספקת המוצרים, המשתמש מתקשר בעסקאות מוסכמות ישירות עם יאנגו.

3.3 לפני ביצוע הזמנה בפלטפורמה המשתמש מתחייב לעיין ולהכיר את כל תנאי אספקת המוצרים והשירות על יד Yango Market וכמו כן תנאי רכישת המוצרים ומידע על המוכר בפלטפורמה. יש לציין כי שגיאות נראות לעין כולל שגיאות כתיב שקיימות בייצוג הסחורה או בייצוג השירות לא כפופות משפטית.

3.4 התנאים המהתיים של עסקת רכישה ומכירה של המוצרים בין המשתמש לבין המוכר המצוינים בתיאור המוצרים שפורסם בפלטפורמה על ידי המוכר, בצורה של ביצוע הזמנה בפלטפורמה.

3.5 התנאים המהותיים של העסקה בין המשתמש לבין Yango Market לגבי שירותי ארגון ואספקת המוצרים מצויינים בטופס הזמנה בפלטפורמה וגם תנאי השימוש הנ"ל.

3.6 עם ביצוע ההזמנה מסכים המשתמש כי המוכררשאי להמחות את ביצוע הזמנת הרכישה של המוצרים לצד שלישי- אך עדיין נושא באחריות על ביצועה כלפי המשתמש, וכמו כן מסכים כי Yango Market רשאית להמחות את ביצועה של ההזמנה למתן שירותי אספקת הסחורה לצד שלישי אך עדיין נושאת באחריות על ביצועה כלפי המשתמש.

3.7 המשתמש נותן את הסכמתו ל Yango Market לעיבוד פרטיו והמידע האישי שלו (להלן:המידע האישי) כפי שמונחים אלה מוגדרים במדיניות הפרטיות לשימוש פונקציונאלי של הפלטפורמה, להעברת פרטיו האישיים של המשתמש על ידי Yango Market למוכרים ולשותפים של Yango Market שמפרסמים הצעות לרכישת מוצרים בפלטפורמה וגם לנציגיהם המוסמכים לעיבוד עתידי של המידע על מנת לתת למשתמש אפשרות פונקציונאלית לחפש ולהכיר את מידע רלוונטי בעניין המוצרים, שליחת שאלתות למוכרים האלה לגבי רכישת המוצרים המתאימה למשתמש וכן להעברת פרטיו האישיים של המשתמש לצד שלישי כולל גם שותפים של Yango Market, וגופים מטעמו של Yango Market (כולל בהתבסס על תוצאות חיפוש) על מנת לתת למשתמש שירותים מותאמים אישית ומיקוד חומרים מקדמי מכירות.

המשתמש מאשר את הסכמתו בכך שפרטיו האישיים שסופק על ידו ל Yango Market בעת השימוש בפלטפורמה עשוי להיות מועבר על יד Yango Market:

- למוכר שאתו המשתמש סוגר עסקת רכישה של מוצרים.

- לצד שלישי מטעמו של Yango Market שאמור לבצע עסקת ארגון ואספקת המוצרים למשתמש.

- לחברות אשראי שמשתתפות בפעולות המשתמש באמצעות כרטיסי אשראי לצורך תשלומים בפלטפורמה על מנת לאשר ביצוע פעולות מסוג זה על פי בקשת חברות האשראי .

Yango Market עשוי לחלוק עם הגופים המצוינים לעיל ו/או לקבל מהגופים האלה רק אותם פרטים האישיים של המשתמש שנדרשים למטרות שצויינו לעיל. עיבוד הפרטים האישיים של המשתמש על ידי Yango Market וכמו כן מידע אחר מטעמו של המשתמש בפלטפורמה מתבצעים על פי תנאי השימוש הנ"ל ומדיניות הפרטיות.

המשתמש מבין ומסכים כי בעת שימוש בפלטפורמה, ועל מנת לתת לאפשר את הפונקציונאליות של הפלטפורמה, מועבר Yango Market באופן אוטומטי מידע כללי הבא: סוג של מערכת הפעלה במכשיר של המשתמש, גרסה ומזהה של דפדפן, סטטיסטיקה של שימוש בפונקציות של הפלטפורמה וגם מידע טכני אחר.

המשתמש מסכים לכך Yango Market רשאית לאחסן את המידע האישי המצוין לעיל,וכמו כן על פרטיו האישיים של מקבל הסחורה מטעמו של המשתמש, במהלך תקופת השימוש בפלטפורמה על ידי המשתמש ולפחות 3 שנים ממועד השימוש האחרון של המשתמש בפלטפורמה.

המשתמש מתחייב כי הוא בעל הזכות לספק את הסכמתו הנ"ל בעניין של צד שלישי (עבור) צד שלישי (מקבלי ההזמנה) ואחראי ככל שתופרההבטחה זו ותגרום להפסדים ל -Yango Market בגובה של ההפסדים והוצאות בית משפט של Yango Marketו/ או הוצאות של Yango Market על הסדר טעון עם צד שלישי כאשר הטענות האלה קשורות להפרת ההבטחה הנ"ל על ידי המשתמש.

3.8 ביצוע הזמנה בפלטפורמה, מהווה הסכמה של המשתמש לקבלת : (1) דואר אלקטרוני ו/או הודעות פוש שנשלחים על ידי Yango Market למשתמש לאחר ביצוע ההזמנה; במקרה של שינוי ההזמנה; לפני מועד אספקת ההזמנה; במקרה של ביטול ההזמנה על ידי החנות; ובמקרים אחרים שמשפיעים על ביצוע ההזמנה ו/או במטרה לעדכן את המשתמש בסטטוס ההזמנה, (2) הודעות (SMS) למס' הטלפון שנמסר על ידי המשתמש וכמו כן (3) שיחת טלפון למספר של המשתמש עם ההצעה להעריך את איכות השירות בפלטפורמה ו/או את שירות המוכר ו/או להודיע על סיבות לשינוי ההזמנה / מועד האספקה למשתמש.

3.9 ההזמנה מהווה הסכמתו של המשתמש לכך ש: (א) הוא עיין בכל הסעיפים של תנאי השימוש הנ"ל, (ב) מקבל את תוכן תנאי שימוש אלה בשלמותם וכן אתתנאי ההסכם למתן שירות אספקת המוצרים בינו לבין Yango Market וכמו כן את עסקת הרכישה- והמכירה בינו לבין המוכר, (ג) מבין את משמעות ההשלכות והמשמעותשל פעולותיו בנוגע לכריתה וביצוע של העסקאות במסגרת הפלטפורמה.

3.10 Yango Market רשאי לחסום למשתמש אפשרות לעשות הזמנה מאחר ביטולים רבים של ההזמנות על ידי המשתמש וגם מאחר הפרת תנאי שימוש הנ"ל על ידי המשתמש.

3.11 המשתמש חייב למסור פרטיים מהימן על עצמו ועל מקבל ההזמנה בעת ביצוע ההזמנה בפלטפורמה. מסירת פרטים שאינם נכונים על ידי המשתמש , לא עדכניים, או שגויים נחשבת על ידי המוכר להתחמקות המשתמש מקבלת ההזמנה ומהווה סיבה לביטול ההזמנה.

3.12 יובהר כי המידע על מלאי המוצרים הזמינים של המוכרים מצויין במעמד ההזמנה ועשוי להשתנות במהלך ביצוע ההזמנה עקב מאפיינים טכניים של פעילות הפלטפורמה. על המשתמש לבדוק את המידע שבפלטפורמה לגבי קיום המוצרים הזמינים במלאי.

3.13 Yango Market רשאי לערוך אירועים ו/או פעילות לקידום מכירות בפלטפורמה ותודיע על כך למשתמש באמצעות כללי פעילות רלוונטיים ו/או תקנון המתאימים לכך ו/או באמצעות שינוי ויזואלי של מחיר המוצר הספציפי בפלטפורמה.

3.14 המראה החיצוני של המוצרים ו/או אריזתם עשויים להשתנות על ידי היצרן ולהיראות שונה לעומת המוצג בפלטפורמה, אך ללא שינויים פונקציונאליים.

 

4. ביצוע הזמנה והסכמי העסקאות בפלטפורמה

4.1 במסגרת הזמנה אחת בפלטפורמה, המשתמש רשאי לסגור עסקאות לרכישת מוצריםהשייכת למספר מוכרים וכן לשירות אירון ואספקת הסחורה עם יאנגו.

4.2 במעמד ההזמנה המשתמש מוסר את הפרטים הנדרשים בפלטפורמה על ידי Yango Market והמוכר לצורך ביצוע ההזמנה כולל (אך לא רק): פרטים אישיים של המשתמש, אופן משלוח, כתובת למשלוח, שם ושם משפחה של מקבל ההזמנה, פרטים ליצירת קשר, ואמצעי תשלום.

4.3 עריכת ההסכם למתן שירותי הספקה של הסחורה על ידי המשתמש וגם עסקאות רכישה- מכירה לגבי המוצרים מתבצעות עם לחיצה על כפתור " לתשלום" (בכפוף לאישור הזמנה שנשלח למשתמש). לאחר לחיצה על הכפתור "לתשלום" מתאפשר התשלום למשתמש תוך 20 דקות. אם התשלום לא בוצע תוך זמן זה מכל סיבה שהיא, אז אין שום הסכמים /עסקאות בין Yango Market והמוכרים לבין המשתמש.

4.4 ביצוע פעולות על ידי המשתמש שרשומות בסעיף 4.3 לתנאים הנ"ל מהווה הסכמתו מלאה ובלתי מותנית לתנאים וגם לתנאי ההסכמים בינו לבין Yango Market והמוכרים.

4.5 מרגע ביצוע פעולות על ידי המשתמש הרשומות בסעיף 4.3 לתנאים הנ"ל (אלא אם צויין אחרת) נוצרות התחייבויות הדדיות בין יאנגו לבין המשתמש (במסגרת של ההסכם למתן שירותי אספקת המוצרים), וכן בין המוכר לבין המשתמש (במסגרת עסקת רכישה- מכירה של המוצרים).

 

5. תשלום על הזמנה

5.1. למשתמש שעשה בפלטפורמה מתאפשרות תשלום עבור המוצרים והשירות באמצעות אמצעי כרטיס אשראי השייך למשתמש (לדוגמא, בכרטיס אשראי או או באמצעים אחרים ככל שיתאפשר בפלטפורמה).

5.2 התשלום מתבצע לחשבון של Yango Market, אשר פועלת בשם המוכר בבענייןגין קבלת סכומים כספיים כתשלומים עבור המוצרים וזאת כגוף מוסמך לקבלת תשלומים ו/או גוף אלקטרוני לקבלת כספים (קבלת תשלומים כסוכן של המוכר).

5.3 Yango Market לא מבטיחה זמינות לתשלום במזומנן בכל עת.

5.4 במקרים הכפופים לחוק, חשבונית נשלחת למייל לכתובת כפי שציין המשתמש בהזמנה.

 

6. ביטול ההזמנה והחזרת מוצרים

6.1 ביטול הזמנה על יד המוכר

המוכר רשאי לבטל את ההזמנה במקרים הבאים:

  • המשתמש לא שילם עבור ההזמנה
  • המוכר לא הצליח ליצור קשר עם המשתמש/ מקבל ההזמנה על פי פרטי הקשר שנמסרו על ידי המשתמש בביצוע.
  • במקרים אחרים כאשר לא ביכולתו של המוכר לבצע את ההזמנה.
  • המשתמש מוותר על המוצרים במקרים על פי החוק.
  • המשתמש מתחמק מקבלת ההזמנה.

6.2 ביטול הזמנה על יד המשתמש

במקרה בו המשתמש מעוניין לבטל את ההזמנה שנעשתה בפלטפורמה ולהחזיר את הסחורה שבהזמנה, הוא פונה למוכר הסחורה על פי פרטיו של המוכר הרשומים בפלטפורמה.

6.3 החזר כספי למשתמש עבור הסחורה מתבצע על ידי המוכר, שפרטיו מובאים לידיעת המשתמש כפי שהם רשומים בפלטפורמה, וזאת על בסיס ובהתאם לאופן ולתנאים הרשומים בחוק.

 

7 שירותי ארגון ואספקת ההזמנה

7.1 עלות השירות לארגון ואספקת המוצרים עבור כל הזמנה נקבעת בהתאם למחירים הרשומים במועד ביצוע ההזמנה בפלטפורמה. מועד האספקה מצוין בפלטפורמה בעת ביצוע ההזמנה. Yango Market רשאית לעדכן את מחירי המוצרים בפלטפורמה מפעם לפעם, בהתאם לתמחור המוכרים ועל פי שיקולה במעמד צד אחד.

7.2 למען הסר כל ספק, יובהר כי Yango Market ו/או צד שלישי מטעמה המעורב על ידה למתן השירות (קבלן משנה) אינם המוכרים של המוצרים אלא אם צוין אחרת בצורה ברורה בהזמנה.

7.3 המשתמש חייב לשלם עבור השירות כפי שהוגדר וצוין בתנאי השימוש הנ"ל.

7.4 Yango Market לא אחראית על אי ביצוע ו/או ביצוע לא ראוי של התחייבויות במסגרת מתן שירות בכל מקרים כדלקמן:

  • אם זה נובע מהפרת תנאי שימוש אלה על ידי המשתמש;
  • במקרה של העדרות המשתמש (אומקבל ההזמנה שצוין על ידי המשתמש) בכתובת המשלוח במועד המוסכם על ידי המשתמש (/מקבל ההזמנה);
  • לא ניתן לצור קשר עם המשתמש (ו/או מקבל ההזמנה) על פי פרטי הקשר שבהזמנה לצורך קביעת מועד המשלוח ובירור פרטים נוספים;
  • אם זה תוצאה של כוח עליון : אסון טבע, הפסקת נתיבי תקשורת ותחבורה, סחפי שלג;
  • המשלוח התקבל בצורה סגורה ולא נגרם נזק חיצוני לאריזה;
  • אלא אם המשתמש לא ביצע פעולות אחרות נוספות שנדרשות לקבלת ההזמנה במקום מסירת ההזמנה בהתאם לתנאי האספקה שקבועים בפלטפורמה או לדרכים מיוחדות לאספקת המוצרים;

 

8. שונות

8.1 המשתמש מאשר כי הוא בעל יכולת וגילו מתאים על פי החוק לביצוע עסקאות רשומות לעיל בתנאים הנ"ל.

8.2 במקרה בו Yango Market מגלה על הפרת הכללים על ידי המשתמש ו/או פעולות לא ראויות שביצע המשתמש במסגרת פעילות שוטפת ו/או במסגרת מבצעים, Yango Market שומר לעצמו את הזכות להפסיק השתתפות של המשתמש בפעילות ו/או לבטל הזמנות של המשתמש בפלטפורמה. Yango Market קובעת באופן עצמאי דרכים להגדרת פעולות של המשתמש כפסולות ו/או מפרות את התנאים הנ"ל ורשאית לא לחשוף מידע זה לעיל לצד שלישי.

8.4 Yango Market לא אחראית על:

8.4.1 שיבושים זמניים והפסקות בתפקוד של הפלטפורמה ואובדן מידע כתוצאה מכך וכמו כן בטיחות המידע, נכונותו ועמידתו בהעברה של המידע.

8.4.2 אמינות, איכות ומהירות בתפקוד של הפלטפורמה וגם על בטיחות המידע שנוצר, התקבל והשתמש על ידי המשתמש.

8.5. החוזה נערך באנגלית ובעברית. בכל מקרה של אי התאמה, הנוסח בעברית יגבר.
