Before using the program, please read terms and conditions of the below license agreement.

Any use of the program means that you fully and unconditionally accept the terms and conditions of this license agreement.

If you do not accept the license agreement in full, you may not use the program for any purpose.

 

1. General Provisions

1.1. This License Agreement (hereinafter referred to as the License) set the terms of use of Yango Deli for mobile devices (hereinafter referred to as the Program) and is signed with any person using the Program on the territory of the State of Israel (hereinafter referred to as the User) and Yandex.Go Israel Ltd., being a body authorized to grant the rights to use the Program (hereinafter referred to as the "Rightholder").

1.2. By copying the Program, installing it on its mobile device or using the Program in any way, the User expresses its full and unconditional consent to all terms and conditions of the License.

1.3. It is permitted to use the Program only under the terms and conditions of this License. If the User does not accept the terms and conditions of the License in full, the User may not use the Program for any purpose. It is prohibited to use the Program in violation of (failing to fulfill) any of the terms and conditions of the License.

1.4. The Program can be used by the User under the terms and conditions of this License for personal non-commercial purposes free of charge. It is only possible to use the Program under terms and in ways not covered by this License based on a separate agreement with the Rightholder.

1.5. When using the Program, you agree that the following documents forms an integral part of this License for the Program:

1.5.2. The Terms of Use of Yango Market available at https://yandex.com/legal/yangomarket_termsofuse

1.5.3. The Privacy Policy available at https://yandex.com/legal/confidential.

as well as document of YANDEX LLC (16, Leo Tolstoy St., Moscow, 119021, Russia), which terms and conditions fully cover the use of the Program:

1.5.4. The License to Use Yandex Search Engine available at https://yandex.com/legal/termsofuse;

The said documents (inter alia, any parts thereof) can be assigned and (or) amended by the Rightholder at any time. New versions of the documents shall come into effect upon their publication, unless otherwise stipulated by the version itself. Rightholder will make best efforts to notify the User of any material change to these documents, however it shall not be obligated to notify the User of any immaterial changes.

 

2. Rights to the Program

2.1. The exclusive right to the Program is vested in the Rightholder.

 

3. License

3.1. The Rightholder shall, free of charge and under an ordinary (non-exclusive) license, grant to the User the non-transferable right to use the Program in all countries of the world in the following ways:

3.1.1. to use the Program as intended, wherefore to copy and install (reproduce) it on the User’s mobile device/-s. The User may install the Program on an unlimited number of mobile devices;

3.1.2. to reproduce and distribute the Program for non-commercial purposes (free of charge).

3.2. The Program shall be used (inter alia, be distributed) under the name: Yango Deli. The User may not change and/or delete the name of the Program, the copyright notice or any other references to the Rightholder.

 

4. Limitations

4.1. Except as used in the scope and in the ways expressly stipulated by this License, the User may not modify, decompile, disassemble, decrypt and perform any other actions with the object code and source code of the Program meant to obtain information on the implementation of algorithms used in the Program, create derivative works using the Program and otherwise use (allow to use) the Program and any components thereof, maps and other images and data stored by the Program on the User’s mobile device, without the Rightholder’s written consent.

4.2. The User may not reproduce and distribute the Program for commercial purposes (inter alia, for a fee), inter alia, as part of software product collections, without the Rightholder’s written consent.

4.3. The User may not distribute the Program in any form other than the form received, without the Rightholder’s written consent.

 

5. Special Provisions

5.1. Some functions of the Program can only be performed with the Internet available. The User shall independently get and pay for such access under terms and as per tariffs of its communication or Internet provider.

5.2. The User acknowledges and agrees that, subject to the terms of the Privacy Policy, the Rightholder can process the User’s personal information required to provide the services (including personal details), transfer the User’s personal details to the Rightholder’s partners (which may be located in the jurisdictions that may have not the same level of protection provided in the User's jurisdiction), and also agrees that the Rightholder’s partners can process personal information in order to provide services to the User within the Program. When the User uses the Program, the personal information is transferred to Yandex.Taxi LLC (16, Leo Tolstoy St., Moscow, 119021, Russia) and YANDEX LLC to be processed under the terms and for the purposes determined in the Privacy Policy available at: https://yandex.com/legal/confidential. When the personal information is transferred to Rightholder’s partners, they will be subject to the terms of the Privacy Policy. The User hereby consents to the foregoing.

5.3. The User is hereby notified, understands and agrees that the Program can collect anonymized statistical data, which shall be owned by the Rightholder

5.4. The Program shall be registered and used by applying the User’s mobile phone number. If the User deletes the Program from the User’s mobile device, then the User’s personal information obtained by the Rightholder during authorization in the Program with the use of the User’s mobile phone number and application of the Program will be saved for as long as it may be permitted pursuant to Section 9 of the Privacy Policy (Clause 1.5.2 of this License). If the Program is re-installed on the device and registered using the same mobile phone number as an identifier, the User’s personal information provided with the use of the said mobile phone number will be restored in full.

5.5. For using Yango Market Service through the Program, the User shall accept Terms of Use of Yango Market posted on: https://yandex.com/legal/yangomarket_termsofuse, with the following additions:

5.5.1. When using Yango Market Service the User authorizes at Yango Market Platform using the User's Program login details.

 

6. Liability under the License

6.1. The Program is provided “as is”. The Rightholder provides no guarantees of error- and trouble-free operation of the Program or its certain components and/or functions, fitness of the Program for specific goals of the User, does not guarantee the reliability, accuracy, completeness and timeliness of the Data, and provides no other guarantees, which are not expressly stated in this License.

6.2. The Rightholder shall not be held liable for any direct or indirect consequences of any use of or inability to use the Program and/or any losses incurred by the User and/or third parties as a result of any use of, failure to use or inability to use the Program or its certain components and/or functions, inter alia, due to possible errors or failures in their operation, except as expressly stipulated by laws.

6.3. All issues and claims related to the use of / inability to use the Program and possible violations of laws and/or third-party rights by the Program shall be sent through the feedback form to support@yango.yandex.com.

6.4. This License and all relations associated with the use of the Program shall be governed by laws of the State of Israel.

 

7. Updates / New Versions of the Program

7.1. This License covers all future updates / new versions of the Program. By agreeing to install an update / new version of the Program, the User accepts the terms and conditions of this License for relevant updates / new versions of the Program, if there is no other license agreement for the update / new version of the Program.

 

8. Amendments to this License

8.1. This license agreement may be unilaterally amended by the Rightholder. User notification of the amendments introduced to the terms and conditions of this License is posted at: https://yandex.com/legal/user_deli. The said amendments to the terms and conditions of the license agreement shall come into effect from the date of their publication, unless otherwise specified in the relevant publication.

 

9. Interpretation

9.1. Wherever used herein, a pronoun in the masculine gender shall be considered as including the feminine gender unless the context clearly indicates otherwise.

9.2. This License is a translation from Hebrew into English. However, in the event of a conflict between the License in Hebrew and its translation, the Hebrew version of the License shall be legally binding.

בטרם ייעשה שימוש בתוכנה, יש לעיין בתנאי הסכם הרישיון שלהלן.

בכל שימוש בתוכנה, אתה מסכים באופן מלא ובלתי מותנה לתנאי הסכם רישיון זה.

ככל שאינך מסכים להסכם הרישיון במלואו, אינך רשאי לעשות שימוש בתוכנה, לכל מטרה שהיא.

 

1. הוראות כלליות

1.1. בהסכם רישיון זה (להלן: "הרישיון") מפורטים תנאי השימוש של Yango Deli למכשירים ניידים (להלן: "התוכנה"), ומתקשרים בו כל אדם שעושה שימוש בתוכנה בטריטוריה של מדינת ישראל (להלן: "המשתמש"), ויאנגו דלי ישראל בע"מ, בהיותה גוף המורשה לתת את הזכויות לעשיית שימוש בתוכנה (להלן: "בעלת הזכויות").

1.2. בכך שהוא מעתיק את התוכנה, מתקין אותה במכשיר הנייד שלו או עושה בה שימוש בכל דרך שהיא, המשתמש מביע את הסכמתו המלאה והבלתי מותנית לכל תנאי הרישיון.

1.3. מותר לעשות שימוש בתוכנה רק על פי תנאי רישיון זה. ככל שהמשתמש אינו מסכים לתנאי הרישיון במלואם, הוא אינו רשאי לעשות שימוש בתוכנה לכל מטרה שהיא. אסור לעשות שימוש בתוכנה תוך הפרה של כל תנאי מתנאי הרישיון.

1.4. המשתמש יהיה רשאי לעשות שימוש בתוכנה בהתאם לתנאי רישיון זה, למטרות אישיות ופרטיות ולא מסחריות, ללא עלות. ניתן יהיה לעשות שימוש בתוכנה בהתאם לתנאים ובדרכים שאינם נכללים ברישיון זה, רק על פי הסכם נפרד עם בעלת הזכויות.

1.5. בכל שימוש בתוכנה, אתה מסכים לכך שהמסמכים שלהלן מהווים חלק בלתי נפרד מרישיון זה לגבי התוכנה:

1.5.1. תנאי השימוש של Yango Deli, שאותם ניתן למצוא בכתובת: https://yandex.com/legal/tou_deli;

1.5.2 תנאי השימוש של Yango Market, שאותם ניתן למצוא בכתובת: https://yandex.com/legal/yangomarket_termsofuse

1.5.3. מדיניות הפרטיות, שאותה ניתן למצוא בכתובת: https://yandex.com/legal/confidential; וכן המסמך של Yandex LLC (16 Leo Tolstoy St., מוסקבה, רוסיה), שבו מפורטים מלוא התנאים לשימוש בתוכנה;

1.5.4. הרישיון לעשיית שימוש במנוע החיפוש של Yandex, שאותו ניתן למצוא בכתובת: https://yandex.com/legal/termsofuse.

בעלת הזכויות תהיה רשאית להמחות ו/או לתקן את המסמכים כאמור, וכל חלק מהם, בכל עת. נוסחים חדשים של המסמכים יכנסו לתוקפם עם פרסומם, למעט אם נקבע אחרת בנוסח עצמו. בעלת הזכויות תעשה את מיטב המאמצים על מנת להודיע למשתמש על כל שינוי מהותי במסמכים אלה, ואולם, היא לא תידרש להודיע למשתמש על כל שינויים לא מהותיים.

 

2. הזכויות בתוכנה

2.1. הזכויות הבלעדיות בתוכנה מוקנות לבעלת הזכויות.

 

3. הרישיון

3.1. בעלת הזכויות תיתן למשתמש, ללא עלות ובמסגרת רישיון לא בלעדי, זכות בלתי ניתנת להעברה לעשיית שימוש בתוכנה בכל מקום בעולם, בדרכים שלהלן:

3.1.1. עשיית שימוש בתוכנה באופן המיועד, קרי העתקתה (שכפולה) והתקנתה במכשיר הנייד של המשתמש, אחד או יותר; המשתמש יהיה רשאי להתקין את התוכנה במספר בלתי מוגבל של מכשירים ניידים;

3.1.2. שכפול התוכנה והפצתה למטרות לא מסחריות (ללא עלות).

3.2. בתוכנה יעשה שימוש (בין היתר בהפצתה) תחת השם Yango Deli. המשתמש לא יהיה רשאי לשנות ו/או למחוק את שם התוכנה, את הודעת זכויות היוצרים או כל התייחסות אחרת לבעלת הזכויות.

 

4. מגבלות

4.1. למעט שימוש באופן ובדרכים כמפורט במפורש ברישיון זה, המשתמש לא ישנה או יפענח את התוכנה, לא יבצע בה שחזור לשפת סף או היפוך הידור, ולא יבצע כל פעולה אחרת בקוד האובייקט ובקוד המקור של התוכנה, במטרה לקבל מידע על יישום האלגוריתמים בהם נעשה שימוש בתוכנה, והוא לא יצור ממנה יצירות נגזרות, או יעשה או יתיר עשיית שימוש בה או בכל רכיבים שלה, או בכל מפות או תמונות אחרות או נתונים ומידע המאוחסנים באמצעותה במכשיר הנייד של המשתמש, ללא הסכמתה, מראש ובכתב, של בעלת הזכויות.

4.2. המשתמש לא יהיה רשאי לשכפל ולהפיץ את התוכנה למטרות מסחריות (לרבות בתשלום), ובכלל זאת כחלק מחבילות של מוצרי תוכנה, ללא הסכמתה בכתב של בעלת הזכויות.

4.3. המשתמש לא יהיה רשאי להפיץ את התוכנה בכל צורה שאינה הצורה בה היא התקבלה, ללא הסכמתה בכתב של בעלת הזכויות.

 

5. הוראות מיוחדות

5.1. פונקציות מסויימות של התוכנה מסוגלות לפעול רק עם חיבור זמין לאינטרנט. המשתמש ישיג באופן עצמאי גישה כאמור, וישלם עבודה, בתנאים ובתעריפים של ספק שירותי התקשורת או האינטרנט שלו.

5.2. המשתמש מאשר ומסכים כי בפכוף לתנאי מדיניות הפרטיות, בעלת הזכויות תהיה רשאית לעבד את המידע האישי של המשתמש הנדרש לצורך מתן השירותים (ובכלל זה פרטים אישיים), להעביר את הפרטים האישיים של המשתמש לשותפים של בעלת הזכויות (שעשויים להיות ממוקמים בתחומי שיפוט שלא קיימת בהם אותה רמת הגנה הניתנת בתחום השיפוט של המשתמש), והוא מסכים גם שהשותפים של בעלת הזכויות רשאים לעבד מידע אישי לצורך מתן השירותים למשתמש במסגרת התוכנה. כאשר המשתמש עושה שימוש בתוכנה, המידע האישי מועבר ל- מסמך של Yandex.Taxi LLC (16 Leo Tolstoy St., מוסקבה, רוסיה), ול- Yandex LLC, על מנת שיעובד על פי תנאי מדיניות הפרטיות שאותה ניתן למצוא בכתובת:

https://yandex.com/legal/confidential, ולמטרות הקבועות בה. כאשר המידע האישי יועבר לשותפים של בעלת הזכויות, הוא יהיה כפוף לתנאי מדיניות הפרטיות. המשתמש מסכים בזאת לאמור לעיל.

5.3. המשתמש מיודע, מבין ומסכים בזאת כי התוכנה תהיה רשאית לאסוף נתונים סטטיסטיים ללא שיוך, שיהיו בבעלותה של בעלת הזכויות.

5.4. התוכנה תירשם, ויעשה בה שימוש, באמצעות מספר הטלפון הנייד של המשתמש. ככל שהמשתמש ימחק את התוכנה מן המכשיר הנייד שלו, המידע האישי שלו שהתקבל על ידי בעלת הזכויות במהלך האישור בתוכנה, תוך שימוש במספר הטלפון הנייד של המשתמש בזמן השימוש בתוכנה, ישמר במשך פרק הזמן המותר על פי ס' 9 למניות הפרטיות (סעיף משנה 1.5.2 לרישיון). ככל שהתוכנה תותקן מחדש במכשיר ותירשם תוך שימוש באותו מספר טלפון נייד כמזהה, המידע האישי של המשתמש שנמסר תוך שימוש במספר הטלפון הנייד כאמור, ישוחזר במלואו.

5.5. כדי להשתמש בשירות Yango Market המאפשרת למשתמש לקבל גישה לפלטפורמת Yango Market באמצעות התוכנה, המשתמש חייב לאשר את תנאי השימוש של Yango Market זמינים בקישור: https://yandex.com/legal/yangomarket_termsofuse עם התוספת הבאה:

5.5.1. בעת שימוש בשירות של Yango Market המשתמש נרשם בפלטפורמת Yango Market באמצעות פרטי הכניסה של המשתמש.

 

6. אחריות על פי הרישיון

6.1. התוכנה נמסרת כמות שהיא (AS IS). בעלת הזכויות לא נותנת כל התחייבות או אחריות להפעלה נטולת שגיאות והפרעות של התוכנה או של הרכיבים ו/או הפונקציות המסויימים שלה, התאמתה של התוכנה למטרות ספציפיות של המשתמש, או להיותם של הנתונים אמינים, מדוייקים, מלאים ועדכניים, והיא אינה נותנת כל התחייבות או אחריות אחרים, שאינן מפורטות במפורש ברישיון זה.

6.2. בעלת הזכויות לא תחוב בשל כל תוצאות, במישרין או בעקיפין, של כל שימוש או אי יכולת לעשיית שימוש בתוכנה ו/או כל נזקים, אובדן או הפסדים שיגרמו למשתמש ו/או לצדדים שלישיים כתוצאה מן השימוש, אי השימוש או אי היכולת לעשיית שימוש בתוכנה או ברכיבים ו/או בפונקציות המסויימים שלה, לרבות בשל שגיאות או תקלות בהפעלתם, למעט כקבוע במפורש בדין.

6.3. לכל בירורים ותלונות, ונושאים אחרים בנוגע לשימוש או אי היכולת לעשיית שימוש בתוכנה, ולכל חשש להפרות של הדין ו/או של זכויות של צדדים שלישיים על ידי התוכנה, יש לפנות אלינו באמצעות טופס המשוב שאותו ניתן למצוא בכתובת: support@yango.yandex.com.

6.4. על רישיון זה ועל כל ענין הקשור לשימוש בתוכנה יחולו דיני מדינת ישראל.

 

7. עדכונים/גרסאות חדשות של התוכנה

7.1. רישיון זה חל לגבי כל העדכונים/הגרסאות החדשות העתידיים של התוכנה. בהסכמה להתקנת עדכון/גרסה חדשה של התוכנה, המשתמש מסכים לתנאי רישיון זה לגבי העדכונים/הגרסאות החדשות הרלוונטיים של התוכנה, ככל שלא קיים כל הסכם רישיון אחר ביחס אליהם.

 

8. תיקונים לרישיון

8.1. בעלת הזכויות תהיה רשאית לתקן הסכם רישיון זה באופן חד צדדי. הודעות למשתמשים בדבר התיקונים שיעשו בתנאי רישיון זה יפורסמו בכתובת:

https://yandex.com/legal/user_deli. התיקונים כאמור לתנאי הסכם הרישיון יכנסו לתוקפם במועד פרסומם, למעט אם יצוין אחרת בפרסום הרלוונטי.

 

9. פרשנות

9.1. למעט אם נאמר אחרת, כל האמור בהסכם רישיון זה בלשון זכר אף לשון נקבה במשמע.
