Terms of Use for the Yandex Telemost Service

1. General Provisions

1.1. This document (hereinafter referred to as the "Terms") establishes the terms of use for the Yandex Telemost service (Telemost) and constitutes an integral part of the General Terms of Use for Yandex 360 Services, posted at: https://yandex.com/legal/360_termsofuse (hereinafter referred to as the "General Terms").

By starting to use the Yandex Telemost service/its individual functions, the User/Corporate Client shall be deemed to have accepted these Terms and the General Terms in full, without any reservations and exceptions.

The current version of the Terms is always available on the Internet page at: https://yandex.com/legal/telemost_termsofuse/.

In case of disagreement by the User/Corporate Client with any of the provisions of the specified documents, the User shall not be entitled to use the Yandex 360 services.

1.2. The unified rules and principles for the use of Yandex 360 services, provisions on intellectual property, personal data processing, and liability shall be governed by the General Terms, taking into account the specifics contained in these Terms.

2. Features of the Use of the Yandex Telemost Service

2.1. Telemost provides the User/Corporate Client with the functionality to organize, conduct, and participate in video conferencing (hereinafter referred to as "Video Calls") with other Telemost Users. The Telemost service may include functionality of the Yandex Messenger service.

2.2. A User wishing to create a new Video Call via Telemost (hereinafter referred to as the "Video Call Initiator") must complete the registration procedure for a new User of Yandex services in accordance with the terms specified in the User Agreement for Yandex Services (https://yandex.com/legal/rules), or log in to Telemost using a previously registered account of a User of Yandex services. The Video Call Initiator is entitled to add other Users to participate in the Video Call by copying the individual URL address of the Video Call generated by Telemost (hereinafter referred to as the "Video Call Address") in the Telemost interface and transferring it to persons who can access the Video Call by following the received Video Call Address (hereinafter referred to as the "Participant"). Any Participant is also entitled to copy the Video Call Address and transfer it to persons who can access the Video Call. A Video Call Participant is entitled to access the Video Call: (a) by following the Video Call Address; (b) by making a telephone call to the number specified in the Telemost interface using the Video Call extension number. The functionality of connecting to a Video Call via a telephone call may not be available to all categories of Users. The telecom operator may charge the User for such a telephone call in accordance with the terms and tariffs of telecom services. When connecting via telephone, the level of data transfer security may be lower than when using a standard Internet connection.

2.3. The Video Call Initiator is its administrator (hereinafter referred to as the "Administrator"). The Administrator may have access to functionality such as turning off the microphone and/or video transmission of other Participants, pausing the Recording, and other functionalities provided by Telemost. The Administrator may appoint other Participants as Administrators. The Administrator may have the functionality to download data about Participants, which may include the Participant's public display name and email address, the date and time the Participant joined the Video Call, and the date and time the Participant left the Video Call. Administrators shall be solely responsible for checking and admitting Participants who have connected by telephone or via the Internet without an authorization procedure.

2.4. Telemost, on certain operating systems, provides the User with the functionality to demonstrate the screen of their device to other Participants during a Video Call. By activating the device screen sharing mode, the User acknowledges that the Participants will be able to view the information displayed in the active window of the User's device screen at the time of the screen sharing, and also agrees that as a result of the screen sharing, confidential information available to the Participants at the time of the User's screen sharing may be disclosed to the Participants.

2.5. A Participant who has accessed the Video Call via the received Video Call Address without logging in to Telemost must specify a display name in the Telemost interface for identification purposes.

2.6. Depending on the operating system used, Telemost may provide the Administrator and Participants with the ability to write and read messages in the Video Call chat.

2.7. Telemost may provide the User with the ability to record a Video Call (hereinafter referred to as the "Recording"). A corresponding notification about the Recording will be displayed in the Telemost interface. By starting to use Telemost, the User confirms and agrees that Recording may be carried out. The Administrator can set a restriction on Recording by the Participants. After the Recording is completed, a copy of it, as well as the history of Users' interactions in Telemost, can be saved both on the User's device and on the Disk of the Video Call Initiator. If there is no space on the Initiator's Disk to store a copy of the Recording, Yandex will send a corresponding notification to the Initiator. Yandex stores a copy of the Recording for 3 calendar days, giving the Initiator the opportunity to clear space on Yandex Disk to save the Recording. After the expiration of this period, the copy of the Recording may be deleted. The User undertakes to use the Recording in accordance with applicable law and shall be solely responsible to third parties for possible violations of third parties' rights related to the implementation of the Recording, its storage on the User's device and its use, including, but not limited to, possible violations of legislation on personal data, on private life and use of images of citizens, copyright, rights to means of identification and other intellectual property objects. Yandex is not responsible for the User's implementation of the Recording and its subsequent use.

2.8. Telemost may provide the User with the ability to schedule Video Calls by creating an event using the Yandex.Calendar functionality. When creating such an event in Telemost and/or Yandex.Calendar, a field may be provided for specifying a link to the Video Call. The User shall independently set the privacy settings for the information specified in the event fields in Yandex.Calendar and determine the circle of people to whom this information may be available. The Rightholder is not responsible for such information or for third parties' access to such information.

2.9. Telemost may provide Corporate Clients with the ability to conduct and/or connect to a live video broadcast of a Video Call for viewers, occurring in real time (hereinafter referred to as the "Live Stream"). A Live Stream can be conducted simultaneously by several co-hosts who have access to the corresponding functionality through Telemost. The Live Stream Initiator can independently configure the ability to connect to it only for the organization's employees in Yandex 360 or for any Users who have the URL of such a Live Stream. During the Live Stream, Users may be able to interact in the Live Stream chat. After the end of the Live Stream, the chat can be saved on the device of the Live Stream co-hosts. By participating in the Live Stream as a viewer or co-host, the User shall comply with applicable laws and be solely responsible to third parties for possible violations of third parties' rights related to the implementation of the Live Stream, its storage on the User's device and its use, including, but not limited to, possible violations of legislation on personal data, on private life and use of images of citizens, copyright, rights to means of identification and other intellectual property items. Yandex is not liable for the User's implementation of the Live Stream and its subsequent use. A Corporate Client is not entitled to conduct several Live Streams simultaneously.

2.10. Telemost may use elements of third-party software, in particular the software product "jitsi", provided by 8x8, Inc. under the terms set forth by the rightholder on the website https://jitsi.org.

2.11. Telemost may use a noise suppression function implemented based on the open-source software "Rnoise", the rightholder of which is Xiph.org Foundation, and which is distributed under the terms of the BSD 3-clause license. 2.12. Yandex is not aware of the content of Video Calls conducted via Telemost, the purposes of their conduct, or the composition of information transmitted during the Video Call. The User shall be solely responsible for actions performed by them using Telemost functions, including for damage caused to other Users and third parties.

2.13. Chats in the Telemost mobile application may be automatically synchronized and displayed in Yandex Messenger, in connection with which the provisions of the Terms of Use for the Yandex Messenger service, posted on the page: https://yandex.com/legal/messenger_termsofuse/, shall fully apply to them.
