Terms and Conditions of the Discount Subscription Promotion

Capitalized terms and definitions used herein are used in the meaning defined in the Terms of Use of the Scooters Service (https://yandex.com/legal/scooters_ge/) (hereinafter the “Offer”).

  1. The Discount Subscription Promotion is a promotion conducted by Ridetech Georgia LLC (hereinafter “Ridetech Georgia”) and the Partners specified in Clause 1.10 of the Offer (hereinafter the “Contractors”), the terms and conditions of which are available online at: https://yandex.com/legal/scooters_ge_discount_subscription_promo/ (hereinafter the “Promotion”) in the Scooters service (hereinafter the “Service”).

  2. Application means a module of the Yandex Go application for mobile devices, the functionality of which allows Users to use the Service, provided on the basis of the License Agreement under the terms and conditions available online at: : https://yandex.com/legal/yandexgo_mobile_agreement/ .

  3. The Promotion shall be valid until March 20, 2026 or until it is cancelled by the Contractors. The Promotion shall be held in the territory of the Georgia.

  4. The Promotion is held in order to maintain the interest of current Users of the Service who have registered and have an active status in the Service (unblocked Users). Users who may be offered the terms and conditions of the Promotion will be determined in the Application automatically based on a set of data evaluated by the Application algorithm on the time of the user’s registration in the Application, the number of rides and other indicators that may be changed by Ridetech Georgia unilaterally. The offer to participate in the Promotion to a specific User may be revoked by Ridetech Georgia at any time at its discretion.

  5. To participate in the Promotion, the User must select the “Discount Subscription” subscription (hereinafter the “Discount Subscription”, the “Subscription”) in the Service interface and pay for the Subscription selected by the User, provided to the User by the Partners in accordance with these Terms and Conditions and Clauses 8.5 and 8.14 of the Offer. Partners are specified in Clause 1.10 of the Offer. The Subscription fee and validity period are specified in the Application. Information on specific services included in Subscriptions is available in the Application. The Subscription shall be activated from the date of payment and be valid until the date specified in the Application.

    Only one Subscription may be activated at a time.

  6. At the discretion of the Contractors, Users with an active Subscription may be provided with a discount on the Rental Payment when choosing the Per-minute Plan, the terms and conditions of application of which and information on the possibility of its application are also specified in the Application. The Subscription is not valid when choosing the Minutes Package Plan.

  7. The Subscription is provided for a specified period. The Subscription validity period (the “Subscription Period”) shall be one (1) month or six (6) months from the date specified in Clause 11 hereof; information on available subscription periods shall be communicated to the User via the Application. For the purposes hereof, a month means thirty (30) calendar days. The User may select the Subscription Period at his/her own discretion from the list of available Subscriptions in the Application.

  8. A Subscription may only be purchased before the e-scooter Rental begins. Subscription services shall be provided only for subsequent rides (e-scooter Rentals) from the moment specified in Clause 11 hereof.

    If there are insufficient funds on the User’s bank card account to pay for the Subscription, the Subscription will not be purchased.

  9. In the case of a joint ride (using the Another Scooter Option), the Subscription discount shall also apply to the e-scooters additionally rented by the User.

  10. By paying for one of the Subscriptions, the User enters into an agreement with the Contractors on the terms and conditions stipulated by this document, as well as the provisions of Article 319 of the Civil Code of the Georgia (No. 786 dated June 26, 1997). The User agrees that services are considered provided and accepted by the User from the moment such services become available to the User in the Application, regardless of whether the User requested the performance of the relevant services by the Contractors or not. From the moment specified in this Clause, in the event the User withdrawing the Subscription, the corresponding Subscription fee will not be refunded, but will be considered compensation for the Contractors’ costs incurred in connection with the provision of the Services.

  11. The Discount under the Subscription shall be considered to be provided to the User for the Subscription Period in full from the moment the User pays for the relevant Subscription on the Service, subject to the activation of the Subscription and compliance with Clause 8 hereof. The Subscription is considered activated from the moment the Application starts displaying the date of the end of the Subscription Period and the date of the next Subscription fee to be charged.

  12. By paying for the Subscription, the User agrees that in each subsequent Subscription Period specified by the User when entering the Subscription, Ridetech Georgiamay charge the Subscription fee amount established in the Service on the date of payment in advance until the User who purchased the Subscription refuses to renew the Subscription for the next Subscription Period (Subscription Renewal), until the Promotion is cancelled by Ridetech Georgia, and in other cases stipulated hereby. The Subscription may be renewed an unlimited number of times after the end of each active Subscription Period.

    The Subscription shall be renewed in accordance with this Clause provided that there are sufficient funds on the User’s bank card account. The Subscription is considered extended for the next period from the moment of successful debiting of the corresponding Subscription fee from the User’s Linked Card account. If there are insufficient funds on the User’s bank card account to pay for the Subscription, the Subscription will not be automatically renewed.

  13. The User understands and agrees that the Subscription may be entered by default for one of the Periods offered in the Application interface. The User buying the Subscription may refuse to renew the Subscription for the next Subscription Period in the Application. In this case, the Subscription shall be terminated from the day following the last day of the paid Subscription Period. Moreover, Ridetech Georgia may terminate the Subscription in other cases or for other reasons as stipulated in the Terms and Conditions.

  14. In the event that the User’s bank disputes a transaction conducted using a bank card to pay for a Subscription, Ridetech Georgia may consider this as the User’s withdrawal of the Subscription from the date Ridetech Georgia receives the corresponding request from the User’s bank.

  15. By accepting the Terms and Conditions, the User buying the Subscription consents to the regular automatic and direct debiting of his/her account to pay for the Subscription and acknowledges that debit orders issued under this clause of the Terms and Conditions are those of the User, and the processing center’s and the acquiring bank’s actions taken to debit the User's account in accordance with this Clause of the Terms and Conditions are performed with the User’s consent.

    Automatic debiting under this Clause of the Terms and Conditions begins subject to the following:

    • the User enters all the required details of the Linked Card;
    • the automatic Linked Card debiting service is activated as follows: automatically when the first payment is made;
    • by clicking the Subscribe button (or any other similar button), which shall mean the User consents with these Terms and Conditions.

  16. The User is obliged on his/her own to monitor the information on the Subscription status in the Application (the list of services, which may change, including being supplemented/reduced), as well as monitor the introduction of amendments and supplements hereto on page https://yandex.com/legal/scooters_ge_discount_subscription_promo/ , which come into force on the date of the corresponding amendment in the Application or on the specified page.

  17. Yandex reserves the right to deny the User an access to the Subscription or restrict access to the Subscription (or to certain functions of the Subscription, where technically possible), inter alia, if it finds out that the User provided incomplete or inaccurate data, if the User violated these Terms and Conditions, the Offer or the laws of the Georgia. If the User’s account is blocked because the User provided inaccurate personal data or if the User violated these Terms and Conditions and/or the Offer, the amount of the subscription fee the User has paid for the current Subscription Period will not be recalculated/refunded.

  18. The Contractors may unilaterally revise the Subscription fee. At the same time, the User who has made, and paid for Subscription (with automatic renewal) will be notified of this change no later than three (3) calendar days before the changes take effect in one of the following ways (as the Contractor thinks fit):

    At the same time, the fee for the Subscription Period actually paid by the User at the time of making the respective changes is not subject to change.

  19. If during the paid Subscription Period the Contractors suspend the provision of services due to the end of the Season in the Service, information on which is communicated to the User via the Application interface, the remaining part of the Subscription Period will be transferred to the beginning of the next season, and the Subscription will be renewed on the day of the beginning of the season in the Service in the corresponding city for the period of the previously unused and paid Subscription Period.

  20. The User may not transfer his/her rights and/or obligations under the executed Subscription to third parties for a fee or free of charge.

  21. The Contractors reserve their right to introduce amendments to these Promotion Terms and Conditions, which shall apply to all participants of the Promotion from the date of publication of such amendments online at: https://yandex.com/legal/scooters_ge_discount_subscription_promo/

    By participating in the Promotion, the User confirms that he/she has read and agrees with these Promotion Terms and Conditions.
