Terms of Use of the Scooters Service
According to these terms and conditions, Ridetech Georgia LLC (hereinafter “Ridetech Georgia”) offers any capable individual who has reached the age of 18 (hereinafter the “User”) to use Scooter service to place orders for e-scooters rental of third parties (Partners) (hereinafter the “Service”), as well as to accept this offer and thereby enter into an Agreement with Ridetech Georgia that regulates the legal relations related to the use of the Service (hereinafter the “Agreement”, or “Terms”, or “Offer”) on the terms and conditions specified below.
The Service provides the User with the functionality to place order for rides on a electric scooter (e-scooter) of Ridetech Georgia Partners. Legal relations governing rides on a e-scooter arise directly between the User and the Ridetech Georgia Partners, except for those legal relations that relate to Ridetech Georgia in accordance with these Terms.

THE USER (IN PARTICULAR, YOU) ACKNOWLEDGES AND UNDERSTANDS THAT THE USE OF A E-SCOOTER REQUIRES FROM THE USER (IN PARTICULAR, YOU) CERTAIN SKILLS AND COMPLIANCE WITH CONDITIONS THAT WILL CONTRIBUTE TO THE E-SCOOTER OPERATION THAT IS SAFE FOR THE USER (IN PARTICULAR, FOR YOU) AND THE SURROUNDING PEOPLE.
THE USER (IN PARTICULAR, YOU) UNDERSTANDS THE RISK OF ADVERSE CONSEQUENCES FOR HIMSELF/HERSELF OR OTHERS DUE TO FAILURE TO COMPLY WITH THE TERMS OF USE OF THE E-SCOOTER WHICH ENSURE SAFE CONTROL OF THE E-SCOOTER.
Renting an e-scooter, as well as using the Service functionality, means the User’s consent (in particular, your consent) to these Terms, as well as to the terms and conditions of other regulatory documents in full, without any reservations or exceptions. If the User (in particular, you) does not agree to these Terms in full or in any part, then the User (in particular, you) may not rent and use the e-scooter in any way.

Besides, in case of using the Service functionality, namely using the relevant Ridetech Georgia Partner Service, the User agrees to the terms of use of the Partner Service (hereinafter the “terms of the Partner Service”): User Agreement of the https://jetshr.com/docs/ka/eula.html - «JETT Georgia LLC» Partner Service.
(hereinafter jointly referred to as the “Regulatory Documents”).
The Service may also provide the User with the functionality to use the Services of Ridetech Georgia Partners, who, among other things, carry out independent activities to provide the service. In case of using the relevant Ridetech Georgia Partner Service, the User shall agree to the terms of use of the Partner Services, which will be available for review and acceptance via the Service functionality.
The Agreement is entered into on the terms of accession to these Terms in accordance with Article 331 of the Civil Code of the Georgia.
Certain terms of this Agreement may apply solely to a specific city or location in which the Rental is available or in which the Service functionality is provided. In this case, the text of the Agreement may directly refer to the attribution of the terms of the Agreement exclusively to a specific city or place. Thus, Ridetech Georgia expressly disclaims guarantees of any kind that the terms of the Agreement do not apply to a specific city or place where the Service Rental or functionality is available.
Ridetech Georgia reserves the right to make changes to the names of the buttons in the Application referred to herein, while maintaining their functionality.
1. Terms
1.1. Acceptance means the User’s consent to these Terms, provided in the manner prescribed by the Terms.
1.2. Rental means a temporary and short-term transfer of the rights to use and possess a e-scooter from Partner to the User in accordance with its intended purpose, from the beginning of the Rental until its completion, according to the rules defined by these Terms.
1.3. Rental payment means the Partner’s remuneration for providing the User with a e-scooter for Rent.
1.4. Booking means assigning a e-scooter selected by the User to the given User for the Booking period, carried out if there are available e-scooter after pressing the BOOK button.
1.5. Road Traffic Accident (RTA) means an event that occurs during the movement of a e-scooter and with its participation, in which people are killed or injured, vehicles, structures, cargo are damaged, or other material damage is caused.
1.6. Start means a fixed amount payment, which is part of the Rental Payment, also used to calculate it, which is accrued after clicking the BOOK button or the START YOUR RIDE button (if there is no Booking).
1.7. License Agreement means a license agreement for the use of the Yandex Go mobile application, available online at: https://yandex.com/legal/yandexgo_mobile_agreement/ .
1.8. Application means a module of the Yandex Go mobile application, the functionality of which allows Users to use the Service, provided on the basis of the License Agreement.
1.9. Parking means a bicycle parking area or other parking area designated in the Application as a e-scooter parking area where the User can complete the Rental.
1.10. Partners mean legal entities providing e-scooter Rental services in a certain territory, separately referred to as a “Partner”.

1.10.1. JETT Georgia LLC, a limited liability company, duly registered under the laws of Georgia, having its identification number 405448109 and registered office at: Apartment No. 2, 6 Givi Kartozia Street, Saburtalo District, Tbilisi, Georgia
1.11. Paid Wait Time means the period of time counted from the end of 10 minutes after pressing the BOOK button until the moment of pressing the START YOUR RIDE button and/or after pressing the WAIT MODE button until the moment of pressing the CONTINUE YOUR RIDE button.
1.12. Traffic Rules mean the Law of Georgia on Traffic, No. 1830 dated December 24, 2013, Resolution No. 546 of the Government of Georgia.
1.13. Linked Card means one or more User’s bank cards required for making cashless payments, the details of which are available in the Application in accordance with the License Agreement, as well as in the User’s account in accordance with the terms of use of linked cards set out herein.
When linking and using the Linked Card, the User confirms and guarantees that they have indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank having issued the Linked Card, inter alia, in relation to the procedure for cashless payments.
1.14. Estimated Ride Time means the estimated period of time required to complete a ride from the e-scooter location to the destination specified by the User, automatically calculated in the Application taking into account the ride route and traffic situation. The Estimated Ride Time is communicated to the User in the Application and may change during the ride if the specified parameters change or if the User makes stops during the ride in the Waiting mode.
1.15. Season means the period of time when the Service is available at the Users’ requests. The User will be notified of the start or end of the Season in the Application.
1.16. Party means Ridetech Georgia, a Partner or a User, collectively referred to as the “Parties”.
1.17. E-scooter means an electric scooter of the Partner, available for Rent by the User in accordance herewith.
1.18. Plans mean the amount of the Rental payment.
1.19. Rental (Ride) Commencement and Completion Zone mean the territory of the city designated in the Application as the Rental (ride) commencement and completion zone.
1.20. Partner’s Service means Ridetech Georgia Partner’s Service, which provides the User with the opportunity to rent a Ridetech Georgia Partner’s e-scooter, as well as order other additional services.
1.21. Contractors mean Ridetech Georgia and Partners collectively.
1.22. Extended Insurance Program Connection Service means an additional service provided by the Partner in accordance with Clauses 10.3 to 10.7 hereof, which the User can purchase and use at his/her own discretion using the Application functionality for the e-scooter Rental period.
1.23. Promo Code means a specific sequence of symbols, upon activation of which and compliance with other conditions of its use, the User is provided with a Discount in accordance with these Terms of Use. The Promo Code may be brought to the attention of the User by indicating it in the Promotional Material, publishing it online, posting it in the Mobile Application, sending it by e-mail, and may also be communicated to the User in other ways.
1.24. Discount means provision of a discount to the User when Renting an Electric Scooter via the Service on the fee for the Service, or provision of another benefit, according to the information communicated to the User. The Discount size and type will be indicated in the Service interface or in the Promotional Material or other informational material accompanying the Promo Code.
1.25. Promotional Material means a document (including a paper card or other handout; a poster or other medium intended for public viewing; information in electronic form) containing a Promo Code and/or the terms and conditions of the Discount.
2. Entering into the Agreement
2.1. To enter into the Agreement and gain access to the Rental Service and other Service functionality, the User shall accept the Terms in the manner established by Clauses 2.1.1 to 2.1.3 of the Terms, and also agree to the terms of the Partner Service (if applicable), which are available for review and acceptance via the Service functionality. The Acceptance shall be considered made by the User provided that the User performs the following set of actions:
2.1.1. The User has provided reliable information in the amount and manner specified in the Application. The specified data shall be requested by Ridetech Georgia and provided by the User before accessing the Rental (ride) Service. If the User does not have the Application and/or an active account in the Application, the User shall install the Application and/or register an account.
2.1.2. The User has confirmed that he/she has read the text of the Terms and Regulatory Documents in full by clicking the button (swiping the switch to the right) “I agree with the Terms” or another action that will be offered to the User as confirmation and agreement with the Terms of Use of the Service in the Application upon first clicking the BOOK button or the START YOUR RIDE button;
2.1.3. Adding a Linked Card to the Application by the User (provided that the Linked Card has not been added earlier), and debiting the amount within one (1) Georgian Lari (GEL) required to confirm the accuracy and validity of the Linked Card data; in case of successful completion of the transaction, the specified amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and access the Rental Service or other Service functionality.
2.2. Services and/or Partners shall not bear any liability or obligations under this Agreement if the User’s accession to the Agreement in accordance with Clause 2.1 of the Terms is impossible due to reasons that did not arise through the fault of Services and/or Partners.
2.3. The User agrees that Ridetech Georgia may verify the data provided under Clause 2.1 of the Terms in any legal way, including sending a request to the User to provide supporting information. The User is hereby notified and agrees that if the User does not provide the requested supporting information necessary for the purposes of additional verification of the User, the access to the Service may be restricted for the User.
2.4. Ridetech Georgia will not be responsible or liable for any obligations if the acceptance of the Terms is impossible for reasons beyond the control of Ridetech Georgia.
2.5. By accepting the Terms, the User confirms that any actions performed in the Application under his/her account, including actions for cashless payment using the Linked Bank Card, are performed personally by the User. All risks associated with unauthorized use of the User’s account or device shall be borne by the User.
2.6. By entering into this Agreement, the User confirms that he/she:
2.6.1. Has a command of the Georgian or English language at a level sufficient to read and comprehend the meaning and essence of the Agreement in the event of accepting the Terms in Georgian or English language, respectively
2.6.2. Has read the terms and conditions of the Agreement, realized the essence and meaning of the documents specified therein, agreed with their content, undertakes to fulfill the requirements established thereby and understands all the consequences of execution of the Agreement and subsequent use of the Service and Application.
2.6.3. Agrees with the placement of any equipment and any technologies in the e-scooter that enable tracking and recording the e-scooter exact coordinates, track the e-scooter movement, monitor the e-scooter state.
2.6.4. The User acknowledges that relevant government authorities may notify them regarding administrative offenses. Ridetech Georgia may assist in delivering such information only if formally authorized to do so by the respective authority, and shall not assume any governmental functions. Notification may be made using any available means of communication (telephone message, telegram, email, SMS) regarding the date, time, and place of drafting the offense report and the consideration of the case on its merits.
2.6.5. By entering into this Agreement, the User represents and warrants that he/she has reached the age of eighteen (18) years.
3. Subject Matter of the Terms
3.1. The Terms establish the general conditions for the provision of the Service to the User, namely the granting by Ridetech Georgia of the right to use the Application for the Rental of the Partner’s e-scooter, the transfer of the e-scooter by Partners to the User for Rent, and the provision of additional services to Users (if applicable).
3.2. The Service is provided to the User upon requests sent by the User via the Application by clicking on the BOOK button or the START RIDE button.
3.3. The User may use the Application under the terms and conditions of a simple (non-exclusive) license in the territory of the Georgia during the term of the Agreement. The right to use the Application by installing it on the User’s device for the purpose of registering an account in the Service, as well as by submitting requests for e-scooter Rental, is provided by Ridetech Georgia to the User free of charge.
3.4. The e-scooter is provided by the Partner to the User for short-term rental for personal non-commercial use. Legal relations for the e-scooter Rental arise between the Partner and the User as provided in Clause 13.5 hereof.
3.5. The use of the Service by the User is governed by this Agreement and the Regulatory Documents.
4. Rights and Obligations of the Parties
4.1. Ridetech Georgia may:
4.1.1. Modify, adapt and otherwise change the Application at its own discretion;
4.1.2. Require the User to pay the Rental payment in accordance with Section 8 hereof in the interests of the Partners;
4.1.3. Terminate this Agreement unilaterally in the event of a User’s violation of this Agreement;
4.1.4. Refuse to grant access to the Service to Users who, in the opinion of Ridetech Georgia, act in bad faith in relation to the Service;
4.1.5. Impose fines on the User who violates this Agreement. Ridetech Georgia may send the User an invoice to pay the fine.
4.2. Ridetech Georgia shall:
4.2.1. Provide the User with the right to use the Application from the moment of Acceptance in the “as is” format, that is, with the functional properties and in the state in which the Application exists at the time of its use by the User;
4.2.2. Correct errors that arise during the operation of the Application (if possible);
4.2.3. Refrain from actions that may interfere with the User’s use of the Application, except in cases of User’s violation of his/her obligations hereunder.
4.3. The Partner may:
4.3.1. Monitor the e-scooter safety, as well as its technical state, monitor the compliance of the e-scooter operation with the objectives set forth herein; Ridetech Georgia shall not ensure the operation of the Partner’s e-scooter.
4.4. The Partner shall:
4.4.1. Provide the User with a e-scooter for Rent in accordance with the terms and conditions hereof;
4.4.2. Provide the User via the Application with complete information on the e-scooter necessary for its operation;
4.4.3. Ensure normal operation of the e-scooter during the Rental at its own expense.
4.5. The Contractors may:
4.5.1. Refuse to enter into the Agreement if the User provides false or incomplete data at the time of registration in the Application.
4.5.2. Suspend performance or refuse to perform the Agreement in the event of the User’s failure to fulfill the obligation to pay the Rental payment and/or the User’s violation of other provisions of the Terms;
4.5.3. Record, via the Application, the User’s and e-scooter identification data transferred to the User for Rent.
4.6. The User may:
4.6.1. Use the Application, rent the e-scooter and use other Service functionality in the manner and under the terms and conditions stipulated hereby;
4.6.2. Transfer rented e-scooter to capable third parties who have reached the age of eighteen (18) and meet the requirements hereof, for rides in the presence of the User, as well as for a joint ride in accordance with Section 7 hereof. When transferring a rented e-scooter to a third party, the User’s obligations arising in connection with the Rental shall not be transferred to such third party and shall remain with the User;
4.7. The User shall:
4.7.1. Pay the Rental payment in time and ensure that the Linked Card has the required amount of funds;
4.7.2. Use the e-scooter in strict accordance with its intended purpose under the terms and conditions hereof;
4.7.3. Before the start of the ride on the e-scooter, accept the e-scooter for Rent in the manner prescribed by Section 5 hereof;
4.7.4. Before starting a ride on the e-scooter, check its state and inspect it for mechanical damage. If damage to the e-scooter is discovered during inspection, the User undertakes to send photos of the damage to the e-scooter to the Contractors via the Application. In this case, the User shall be liable for causing damage during the Rental (ride), if they are detected by another User or Partner later. If any damage to the e-scooter is detected, which may affect the safety of its operation (electronics malfunction, brake system malfunction, steering system malfunction, other), the User shall not ride the e-scooter.
4.7.5. Ensure the e-scooter safety from the moment the Rental commences until the moment the Rental terminates;
4.7.6. Return the e-scooter in good state and without damage;
4.7.7. Upon Rental completion, park the e-scooter in the Parking Lot in accordance with Section 5 hereof;
4.7.8. Immediately notify the Contractors via the Application of any damage to the e-scooter received during the Rental, or any RTA involving the e-scooter.
4.7.9. Stop using the e-scooter if:
-
a RTA occurs involving the User and/or the e-scooter, regardless of the User’s fault;
-
due to a RTA involving the User and/or the e-scooter, third party property was damaged, regardless of the User’s fault;
-
the e-scooter has been damaged to such an extent that its further use is impossible or unsafe, which must be reported to the Contractors via the Application;
4.7.10. register a RTA that occurred during the e-scooter Rental period and not flee the scene of the RTA;
4.7.11. Not allow harm to the life, health and property of third parties, including other road traffic participants. In case of causing harm using a e-scooter, the User shall be held liable in accordance with the procedure provided for by the applicable laws of the Georgia.
4.7.12. Not subrent the e-scooter to third parties. Transfer of e-scooter to third parties for use is permitted only under the terms and conditions provided for in Section 7 and Clause 4.6.2 hereof;
4.7.13. Take appropriate measures to protect his/her Application account details, including his/her name and password, from unauthorized use by others, and if such use is discovered, promptly notify the Contractors of the relevant information via the Application or by e-mail: support.taxi@go.yandex.com;
4.7.14. Do not share your Application account details with third parties;
4.7.15. If funds are debited from the User’s account in an amount that does not comply with the terms and conditions of the Agreement, notify the Contractors immediately on the matter via the Application or by e-mail: support.taxi@go.yandex.com.
4.7.16. Do not ride on the e-scooter inside buildings or restricted areas, do not ride up or down stairs on the e-scooter, do not ride on curbs, embankment fences, streets, buildings, do not place the e-scooter in places where solid household waste is placed, including not placing the e-scooter in a container for collecting such waste, etc.;
4.7.17. During the use of the e-scooter, the User shall comply with the Traffic Rules and shall be liable for any violation thereof. In particular, the User shall ride on bicycle paths, bicycle-pedestrian paths or lanes for cyclists, and bicycle zones. If there are no bicycle and bicycle-pedestrian paths, lane for cyclists, bicycle zone, or there is no possibility to move along them, movement on the sidewalk or pedestrian path shall be allowed;
4.7.18. Do not disassemble the e-scooter, do not make changes to the e-scooter design, do not make changes to/modify the e-scooter software;
4.7.19. Do not charge the e-scooter on his/her own or connect other devices to the e-scooter for charging.
4.8. During the Rental, the User is prohibited from:
4.8.1. Using the e-scooter for off-road riding, cross country locality, uneven surfaces, poor covering, which may cause damage to the e-scooter during the ride;
4.8.2. Moving on the e-scooter if the total weight of the User and the cargo being transported exceeds 100kg;
4.8.3. Driving the e-scooter if damage to the e-scooter is detected that may affect the safety of e-scooter riding (electronics malfunction, brake system malfunction, steering system malfunction, etc.);
4.8.4. Riding on one e-scooter together with another individual (riding with two or more people).
4.9. FOR THE PURPOSES OF A SAFE RIDE, THE USER ALSO UNDERTAKES TO COMPLY WITH THE FOLLOWING RULES AND RECOMMENDATIONS THAT DIRECTLY AFFECT THE SAFETY OF THE E-SCOOTER RIDING:
4.9.1. Use a protective helmet and other protective equipment to prevent injury from falling or colliding;
4.9.2. Ride on the e-scooter in such a way that its actions can be predicted for other road traffic participants, including pedestrians. The User shall take into account the road situation and all other conditions that may affect the e-scooter safe operation.
4.9.3. At the beginning of the ride and directly during the ride, hold the steering wheel with both hands and do not allow the e-scooter to be operated with one hand;
4.9.4. Do not allow the e-scooter to collide with or come into contact with any objects that may interfere with the e-scooter safe operation;
4.9.5. Do not hang any heavy bags or backpacks on the e-scooter’s steering wheel that could obstruct the e-scooter safe operation;
4.9.6. Stand on the e-scooter with both feet;
4.9.7. Shall not operate the e-scooter in a state of alcoholic, narcotic, toxic or other intoxication, as well as refuse to undergo a medical examination procedure at the request of an authorized official;
4.9.8. Do not cross the roadway at overhead, ground, underground or other crossings without dismounting from the e-scooter ;
4.9.9. Do not ride on a e-scooter with a pet tethered to the e-scooter or otherwise walk a pet if this may affect the safety of the ride (e.g., holding a pet’s leash while riding on the e-scooter ).
4.9.10. Comply with the rules established in the territory in which he/she uses and/or leaves the e-scooter . In case of violation of the established rules, the User will independently bear the liability provided for such violations, including paying fines.
4.9.11. Do not tow one or more e-scooters, do not use the phone while riding on a e-scooter .
5. Procedure for e-scooter Acceptance and Transfer by the User
5.1. A e-scooter shall be transferred for Rental from the Partner to the User as follows:
5.1.1. Information on the e-scooter s available for Rental is available in the Application. The User independently selects a e-scooter from the list offered in the Application;
5.1.2. The User may Book a e-scooter before actually accepting the selected e-scooter in accordance with Clause 5.1.3 of the Agreement;
5.1.3. The User will use the camera of the phone (device) to scan the QR code placed on the e-scooter. The Application displays the following information on the selected e-scooter: location, terms of the Rental payment , and e-scooter charge level. The User shall confirm the actual acceptance of the selected e-scooter by pressing the START YOUR RIDE button in the Application. When selecting the e-scooter, the User shall check the sufficiency of funds on the Linked Card.
5.2. The transfer of the e-scooter from the User to the Partner upon the Rental completion shall be carried out as follows:
5.2.1. The User undertakes to park the e-scooter in the Parking Lot, press the END YOUR RIDE button in the Application and send photos of the general view of the parked e-scooter (photos of the parking lot and the e-scooter ) via the Application.
5.2.2. The Rental Period ends after the Contractors receive, via the Application, photos of the general view of the parked e-scooter (photos of the parking lot and e-scooter). If the User complies with the e-scooter transfer procedure stipulated by the Agreement, the User will have access to information on the total Rental payment via the Application.
6. Rental Period
6.1. The Contractors may, at the User’s request, prior to accepting the e-scooter for Rental, to provide the User with access to the Booking function of one or more e-scooter s (in accordance with Section 7 of the Terms) selected by the User using the Application for a period of time determined in the Application. During the specified period, the booked e-scooters will become unavailable for use by other Users. Additional options available to the User within the framework of the Booking will be determined by the Contractors at their own discretion, their availability will be determined in the Application; additional options will be included in the Paid Wait Time amount and will not be charged separately. The Paid Wait Time amount within the Booking may be indicated separately, may be included in the Rental payment amount and will be determined in the Application. The charging of Paid Wait Time begins after the User presses the BOOK button in the Application for the selected e-scooter and ends when the User presses the START YOUR RIDE button in the Application, except for cases expressly provided for in the Application.
6.2. The Rental Period is calculated from the moment the START YOUR RIDE or BOOK button is pressed in the Application until the actual e-scooter Rental completion by pressing the END YOUR RIDE button in the Application and sending, as confirmation, a photo of the general view of the parked e-scooter (photos of the parking lot and the e-scooter) by the User via the Application.
6.3. The User determines the Rental Period of a specific e-scooter at his/her discretion. In this case, the e-scooter Rental Period may not exceed twenty-four (24) hours in a row.
6.4. The e-scooter Rental Period will be calculated in seconds.
7. Joint Ride
7.1. The User may simultaneously rent up to three e-scooters maximum (Another Scooter Option).
7.2. The User may transfer rented e-scooters for use by capable individuals who have reached the age of eighteen (18) (joint ride) and who meet the requirements of the Terms.
7.3. When transferring the e-scooter to third parties, the User undertakes to familiarize all third parties to whom the User transfers the e-scooter with this Agreement and the Regulatory Documents, as well as the terms of use of the Partner’s Service (if applicable).
7.4. In the event of a joint ride, the User shall, and not the third party to whom the e-scooter was transferred, be liable for the safety of the e-scooter, as well as compliance herewith, before the Contractors.
7.5. Monetary obligations arising in connection with the Rental of several e-scooters shall be imposed on and fulfilled directly by the User and may not be transferred to third parties.
7.6. In case of a joint ride, the Minutes Package option shall apply only to the Rental of one e-scooter, which Rental Period commences earlier. It is not allowed to use the Minutes Package option for the second and/or third e-scooter within the joint ride.
8. Rental payment
8.1. The Rental payment includes Rental Payments and the cost of additional services and options.
8.2. The Rental payment amount will be determined by the Contractors and communicated to the User in the Application. The User agrees to the specified Rental payment amount and confirms his/her request by clicking the START YOUR RIDE button in the Application.
8.3. The User may choose one of the following methods for calculating the Rental payment amount, provided that they are available in the Application:
8.3.1. Per-Minute Plan
This Plan assumes per-minute payment of the Rental payment .
The lump-sum minimum Rental payment will be refunded to the User if the User refuses to ride a e-scooter (does not press the START YOUR RIDE button).
The Rental payment for this Plan will be calculated after pressing the START YOUR RIDE button.
8.3.2. At the User’s request, the User may be provided with the Minutes Package option (subject to its availability in the Application).
The Minutes Package option requires a fixed payment for the Rental payment .
When connecting the Minutes Package option, the Rental payment amount will be calculated for providing the User with the Service for a certain number of minutes, including Paid Wait Time, defined and indicated in the Application. The Minutes Package option is valid for the period specified in the Application, within the territory of the city of Tbilisi. Available options and the number of minutes therein are determined by the Contractors at their own discretion and communicated to the User through the Application functionality.
If the Season ends before the expiry of the Minute Package option, the remaining minutes will not be carried over to the next Season.
8.3.3. The Start and the Paid Wait Time amounts may be indicated separately, or may be included in the Rental payment amount and will be determined in the Application.
8.3.4. The service of connection to the Extended Insurance Program and its fee may be included in certain Plans; information thereon will be communicated to the User via the Application functionality.
8.3.5. User may be offered to use other Plans and options, participation in promotions that amend and supplement the provisions related to the Rental payment and specified in Clauses 8.3.1 to 8.3.3 hereof, as well as other methods of calculating the Rental payment not named herein by posting such Plan conditions, options and promotions in the Application and on page online linked to the page on which these Terms are posted: https://yandex.com/legal/scooters_ge/ .
8.4. In order to ensure the quality of services for Users, as well as to take into account changes in demand and other conditions, a coefficient may be occasionally applied to the Rental payment, which may change its final amount. Ridetech Georgia notifies about an increase or decrease of the Rental payment by tariffs/options by posting a corresponding notice in the Application or by other means at its discretion.
8.5. Payment of the Rental payment , as well as the cost of additional options in accordance with Clause 8.3.2 hereof, shall be made by direct debiting funds from the User’s Linked Card. The distribution of the Rental payment between Rental Payments and other additional services is indicated in the receipts and reporting documents generated based on the ride results, which are sent to the User.
8.6. The total Rental payment amount, which includes tetris, is calculated as follows:

The Rental payment is rounded up to the nearest whole sum for figures from 50 tetris and more;
-
The Rental payment is rounded down to the nearest whole sum for figures from 49 tetris and less.
8.7. The Contractors may write off from the User’s Linked Card at the time of the start of using the Service an amount of up to five (5) Georgian Lari (GEL) as a refundable deposit. If the Rental payment amount actually exceeds the amount of the written-off refundable deposit, the Contractors may write off funds in the amount of up to six (6) Georgian Lari (GEL) from the User’s Linked Card each time the specified limit is exceeded. The difference between the amount of the refundable deposit written off from the User’s Linked Card and the total Rental payment amount will be refunded to the User’s Linked Card.
8.8. In case of User’s disagreement with the fact and/or amount of the write-off and on other issues related to the use of the Linked Card within the Service, the User may contact the Contractors via the support service (feedback) interface in the Application.
8.9. If, based on the results of the check on the request specified in Clause 8.8, the Contractors decide to refund the amount of the Write-off in full or in part, the said refund will be made to the Linked Card bank account. The refund shall be carried out with the participation of an authorized payment processor or an electronic money operator, or other participants in settlements, information technology interaction, and shall be governed by the rules of international payment systems, banks (including the bank issuing the Linked Card) and other participants in settlements.
8.10. The Rental payment may be charged within one transaction in the amount of the full Rental payment or several transactions in the amount of a partial Rental payment . In this case, the Rental payment may be debited in any of the specified ways before the Rental commencement, during the Rental, or upon its completion.
8.11. In case of insufficient funds, impossibility of writing them off from the User’s Linked Card, as well as in case of the User’s debt hereunder, the Partner may turn off the e-scooter traction. In the e-scooter traction has been turned off, the User must complete the Rental or top up the limit of the User’s Linked Card.
8.12. Ridetech Georgia’s obligation to provide the Service and the Partner’s obligation to provide the e-scooter for Rental to the User in accordance with the terms hereof are counter to the User’s obligation to pay the Rental payment on time in accordance with the Terms and to comply with the Terms.
8.13. The Contractors do not guarantee that there will be no errors and failures in the Service functioning in relation to the provision of the possibility of writing off the Rental payment .
8.14. Payment for the use of Partner Services shall be made through the use of the Service functionality. In this case, Ridetech Georgia acts on behalf of the relevant Partner with the involvement of an authorized payment processor (payment system operator/payment organization), or an electronic cash operator (hereinafter referred to as the “Operator/Processor”) or other participants in settlements, information and technology interaction, and is the payee as an agent of the Ridetech Georgia Partner (hereinafter the “cashless payment”). The Operator/Processor is an authorized person having the right to accept and process payments in accordance with the Applicable Law. The payment procedure in this case shall be governed by the rules of international payment systems, banks (including the issuing bank of the Linked Card) and other settlement participants. Ridetech Georgia does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.
8.15. The Contractors may debit any payment due to them from the User’s Linked Bank Card, including fines at any time before the User completes the e-scooter Rental, and if the Contractors reveals that the User has violated the terms and conditions of this Agreement and/or Traffic Rules in the e-scoote Rental Period. In this case, the User may select the Linked Bank Card in the App, wherefrom the payments will be debited as a priority.
8.16. Temporary discounts and/or bonuses may be provided to the User, including as part of promotions, special offers, or independently of them. The validity period, amount, and conditions of these discounts or bonuses as well as the procedure for terminating them are set by the service and communicated to users in any way the service deems appropriate, including through the application interface. After the expiration date, the discounts or bonuses expire automatically. Discounts and bonus points do not accumulate unless explicitly stated otherwise by the service. The service may decline providing or extending discounts and bonuses at its discretion.
- Subscription
9.1. The User may purchase the Subscription in the App at any time during the term of this Agreement. To purchase the Subscription, the User selects the Subscription from the available options in the App's user interface and then pays for the selected Subscription. The price, validity period, and information on specific services included in the Subscription are shown in the App. Only one Subscription per User is permitted.
9.2. The Subscription's terms and conditions may allow canceling of the “Unlock” fee for the Subscription validity period in the “Per Minute” tariff and in the “Minutes Bundle” option, or making changes to other Rental terms and conditions. The Subscription shall not be valid if the User activates or applies valid promo codes for a discount and/or obtains a similar personal discount in the Service from any active Subscription.
9.3. The Subscription shall be valid (activated) after the User pays for the corresponding Subscription and the App shows the end date of the Subscription period and the date when the fee for the next Subscription period is charged (except for the trial period). If the funds on the User's Linked Payment Card are not available to pay for the Subscription, then the Subscription is not purchased and is not activated.
9.4. The Subscription is provided for a fixed period (the “Subscription Period”). The information about available Subscription Periods is shown to the User in the App's user interface. The User selects the Subscription period on their own from the list of available options in the App.
9.5. The Subscription may only be purchased before the Rental period. The Subscription shall be valid only regarding Rental of a PMD started after the Subscription was activated.
9.6. If a ride is carried out by several people (the “Rent Another Scooter” option is used), then the special Rental terms and conditions under the Subscription shall also apply to additional rented PMDs.
9.7. By paying for the Subscription, the User agrees that at the end of the Subscription Period, their Subscription will be automatically re-activated for the same period (Subscription Extension Period) if the User has not canceled the Subscription Extension in the App. The Subscription may be extended any number of times after the end of each active Subscription Period.
The extension fee for the Subscription is charged in advance by the acquiring bank to the Linked Payment Card in the amount set in the Service as of the day of payment for the Subscription (Subscription Fee).
The Subscription is extended only when the funds on the User's Linked Payment Card are sufficient. The Subscription shall be deemed extended for the next period from the moment the Subscription price is charged to the User's Linked Payment Card. If the funds on the User's Linked Payment Card are insufficient to pay for the Subscription, then the Subscription is not automatically extended.
9.8. The User acquiring a Subscription agrees to the automatic and direct debiting of funds from their Linked Payment Card in order to make a payment for the Subscription, and acknowledges that any payment orders for debiting funds from the Linked Payment Card provided in accordance with this Clause of the Terms and Conditions shall be deemed the User's own payment orders while any actions of the acquiring bank to charge funds in accordance with this Clause of the Terms and Conditions shall be deemed approved by the User.
Yandex shall not be responsible for any failure to charge the Subscription fee to the Linked Payment Card and activate/extend the Subscription for technical reasons.
9.9. If the issuing bank of the Linked Payment Card disputes a transaction carried out using the Linked Payment Card when making a payment for the Subscription, the Partner may deem this the User's refusal to activate/extend the Subscription from the date Yandex receives the request from the User's issuing bank.
9.10. The User who purchases the Subscription may refuse to extend the Subscription for the next Subscription Period in the App. In this case, the Subscription ends on the day following the last day of the paid Subscription Period. The Subscription may also be terminated by Partners in other cases or on other reasons provided for in the Terms and Conditions.
9.11. The User may cancel the Subscription unilaterally at any time during the Subscription Period. The User agrees that services under the Subscription are deemed to be rendered to and accepted by the User from the moment such services are made available to the User in the App, regardless of whether the User requested such services.
9.12. Partners may unilaterally change the Subscription's terms and conditions at any time by posting updated terms and conditions in the description of the Subscription in the App. The User shall track on their own the current status of the Subscription in the App (the list of included, excluded or added services), and also monitor any changes and amendments to the Subscription's terms and conditions, including cases when it is being extended. If the User does not agree to the changes in such terms and conditions, then the User shall cancel the Subscription.
9.13. The Partner reserves the right, at its own discretion, to unilaterally revoke or restrict the User's access to the Subscription (or to certain functions under the Subscription when possible), or refuse to extend the Subscription, including, but not limited to, when the User provides incomplete or false information, fails to pay for the services, or violates the laws of the Republic of Uzbekistan or these Terms and Conditions. If the User's account is blocked because the User provides false information about themselves or violates these Terms and Conditions, then the fee paid by the User for the current Subscription Period shall not be subject to recalculation/refund.
9.14. Partners may change the Subscription fee unilaterally. The User who has requested and paid for the Subscription (with automatic Subscription Extension) shall be notified of such change by posting the information about the new Subscription Fee in the App no later than 3 (three) calendar days before the change takes effect.
In this event, the price of the Subscription paid by the User as of the date when the corresponding change was made shall remain the same.
9.15. If during the paid Subscription Period the Partners suspend services due to the end of the Season in the Service and notify the User accordingly in the App, then the remaining part of the Subscription Period shall be postponed to the beginning of the next Season and the Subscription shall be re-activated on the first day of that Season in the corresponding city for a period equivalent to the previously unused and paid Subscription Period.
9.16. The User may not transfer their rights and/or obligations under the Subscription to third parties.
9.17. Unless otherwise provided in the Subscription description, the User may activate and utilize the Subscription in their existing account during a Trial Period free of charge. The duration of such Trial Period shall be indicated in the Subscription description in the App.
9.18. To activate the Trial Period, the User shall add their Linked Payment Card to the App as stated in Clause 2.1.3 of these Terms and Conditions, and then tap the “Try for Free” button (or a button with a similar meaning).
9.19. At the end of the Trial Period, the Linked Payment Card shall be automatically charged the Subscription Fee for the Subscription Period selected by the User when activating the Trial Period. The User who does not want to extend the Subscription for a fee at the end of the Trial Period shall cancel the automatic extension (purchase) of the Subscription in the App before the end of the Trial Period. In this case, the Subscription ends on the day following the last day of the Trial Period.
9.20. Each User may only utilize the Trial Period 1 (one) time.
10. Liability
10.1. For the failure to fulfill or improper fulfillment of obligations hereunder, the Parties shall be liable under this Agreement and the laws of the Georgia.
10.2. From the moment of acceptance of the e-scooter for Rental until the return of the e-scooter, the risk of accidental damage and loss of the e-scooter, as well as liability for damage caused by the e-scooter as a source of increased danger, shall be borne by the User.
10.3. The User shall bear full liability for any costs, fines (including administrative fines that were imposed for repeated administrative offences, regardless of who committed the administrative offence on the e-scooter for the first time), complaints, demands and claims that arose during the entire e-scooter Rental Period, which may be claimed by any third party during and after the completion of the Rental Period for any reason related to the use of the e-scooter, including any damages caused to third parties. If the payment of the administrative fine for the User was made by the Partner and/or Ridetech Georgia, the User is obliged to compensate the Partner and/or Ridetech Georgia for the losses incurred in connection therewith. If the User causes harm to the life, health or property of third parties, including other road traffic participants, during the use of the e-scooter, the User undertakes to fully compensate for the damage caused by his/her actions to both third parties and Ridetech Georgia.
10.4. Payment of the fine shall not exempt the User from compensation for damage caused to the property of the Partner and/or third parties.
10.5. All payments, fines and compensations as required by the Terms shall be written off by direct debiting the corresponding funds from the User’s Linked Bank Card. In case of failure to debit the User’s Linked Card account directly, the User undertakes to transfer the full amount of the User’s debt to the Linked Bank Card within three (3) calendar days from the date of sending the User a notice of debt via e-mail specified by the User upon registration in the Application.
10.6. In case of User’s violation of the provisions stipulated by Clauses 4.8.1, 4.8.2, and 4.7.17 hereof, the User shall pay a fine to the Contractors in the amount of one hundred and thirty (130) Georgian Lari (GEL).
10.7. In case of User’s violation of the provisions stipulated by Clauses 4.7.8, 4.7.9, 4.7.13, and 4.7.14 hereof, the User shall pay a fine to the Contractors in the amount of two hundred and twenty (220) Georgian Lari (GEL).
10.8. In case of User’s violation of the provisions stipulated in Clauses 4.7.2 and 4.7.12 hereof, the User shall pay a fine to the Contractors in the amount of three hundred and twenty (320) Georgian Lari (GEL).
10.9. In case of User’s violation of the provisions stipulated by Clause 4.7.6 hereof, the User shall pay a fine to the Contractors in the amount of one thousand one hundred (1100) Georgian Lari (GEL).
10.10. In case of User’s violation of the provisions stipulated by Clauses 4.7.16 and 4.9.8 hereof, the User shall pay a fine to the Contractors in the amount of thirty two (32) Georgian Lari (GEL).
10.11. In case of User’s violation of the provisions stipulated by Clause 4.7.7 hereof, the User shall pay a fine to the Contractors in the amount of fifteen (15) Georgian Lari (GEL).
10.12. In case of User’s violation of the provisions stipulated by Clauses 4.8.4 hereof, the User shall pay a fine to the Contractors in the amount of thirty two (32) Georgian Lari (GEL) for each person.
10.13. In the event that the User evades registration of a RTA that occurred during the e-scooter Rental Period, in the manner prescribed by the laws currently in force, and/or flees the scene of the RTA, the User, at the request of the Contractors, shall pay a fine to the Contractors in the amount of six hundred and forty (640) Georgian Lari (GEL).
11. Terms of Use of the Scooter Service Promo Codes
11.1. The Promo Code may be communicated to the User by receiving it from posting it on the Service, sending it by e-mail, through authorized third parties, and may also be communicated in other ways.
11.2. The Promo Code can provide the following types of Discounts:
- Providing the User with a discount on the payment of a limited number of minutes when using a e-scooter, valid for a limited period of time, in accordance with the terms and conditions set out in the Promotional Material or otherwise communicated to the User (“Gifted Minutes”). This type of Discount can only be used in the Per-Minute Plan. The Discount shall not apply to additionally rented e-scooters in the case of a joint ride (Another Scooter Option).
- providing the User with a discount on a fixed payment amount, which is part of the Rental Payment, also used to calculate the Rental payment, which is accrued after clicking the BOOK button or the START YOUR RIDE button (if there is no Booking), valid for a limited time, in accordance with the terms and conditions set out in the Promotional Material or otherwise communicated to the User (“No-Charge Start”). This type of Discount can be used on any Plan provided for herein.
- Providing the User with a discount on the payment of the Rental payment, valid for a limited period of time, in accordance with the terms and conditions set out in the Promotional Material or otherwise communicated to the User (“Ride Discount”). This type of Discount can only be used in the Per-Minute Plan.
11.3. The Promo Code provides a Discount only if the Promo Code is activated in the Mobile Application and these Terms are met. Adding the Promo Code to the Mobile Application does not equal its activation.
11.4. The Promo Code after activation can be used by one User only once, unless otherwise specified in the information communicated to the User.
11.5. Until the Promo Code is not activated, the Promo Code may be transferred by one User to another User, in cases when the Promo Code is not unique, or if this is not prohibited by the terms and conditions of the Promo Code.
11.6. The Promo Code has a validity period during which the Promo Code shall be activated by the User in the Mobile Application. Upon expiration of the Promo Code, it becomes invalid.
11.7. The Discount provided by the Promo Code has its own validity period. The validity period of the Discount starts after the Promo Code is activated in the Mobile Application. If the User has not fully utilized the benefit of the Discount, the unused portion thereof will expire at the end of the Discount’s validity period, unless otherwise stated in the materials accompanying the Promo Code.
11.8. The Discount provided by the Promo Code may be combined with other Promo Code Discounts, unless otherwise stated in the informational materials accompanying the Promo Code.
11.9. The Discount cannot be exchanged for money, for another type of Discount or for another benefit.
11.10. To prevent unfair use and/or abuse of Promo Codes, Ridetech Georgia reserves the right to employ verification methods not explicitly specified in these Terms, including, but not limited to, verifying that the User is genuinely eligible to receive the Promo Code, and that the User is not an employee or representative of Ridetech Georgia or a Ridetech Georgia counterparty from whom the Promo Code was obtained for distribution to end Users.
Ridetech Georgia may, in the event of detection of a fact of abuse and/or unfair use of the Promo Code, refuse to provide a Discount to the User and/or cancel the User’s Promo Code.
11.11. Use of the Promo Code may be unavailable for technical reasons if the User fails to update the Mobile Application to the latest available version and/or for other reasons.
11.12. The User can delete the Promo Code in the Service interface before it is activated. This action is not irrevocable; after deletion, the Promo Code can be re-entered.
11.13. When considering requests concerning the Promo Code activation or use, Ridetech Georgia support service may request, and the requesting User is obliged to provide, confirmation of the receipt of the Promo Code (a screenshot of the page with the Promo Code and/or other confirmation as instructed by a support service employee). In case of failure to provide such confirmation, Ridetech Georgia reserves the right to refuse to provide the Discount.
11.14. Ridetech Georgia reserves the right to unilaterally amend these Terms at any time, including terminating the provision of the Discount prematurely or modifying the terms and conditions of the Discount provision. Information on such amendments will be made available by Ridetech Georgia at: https://yandex.com/legal/scooters_ge/ with no special notification of the User. The User undertakes to monitor the specified amendments at the specified link on his/her own.
11.15. Ridetech Georgia shall not be liable for failure to fulfill or improper fulfillment of its obligations, as well as for any direct, indirect, special losses and damages of Users associated with the provision of Promo Codes in accordance with the Terms, resulting from failures in telecommunications and energy networks, actions of malicious programs, unfair third party actions aimed at unauthorized access and/or disabling software and hardware, as well as other unforeseen force majeure events. Ridetech Georgia is not obligated to compensate Users for losses in such cases.
11.16. Ridetech Georgia may refuse the User to provide a Discount and Promo Code if they have provided false information on themselves or otherwise violated the Terms of Use of the Scooters service.
11.17. How to Activate a Promo Code
A Promo Code may only be used after activation.
A Promo Code can be added and activated in the Mobile Application:

To add a Promo Code, you need to enter it in the special Enter Promo Code field and click the Activate button:
After adding, the Promo Code will be displayed in the Mobile Application and will be available for further activation (use).
To activate (use) the Promo Code, before the start of the Rental, you must select the Promo Code in the corresponding section of the Mobile Application and click the Activate button in the pop-up window. In case of successful activation, a window will appear with information on how to use the Promo Code.

12. Personal Data Processing
12.1. In order to provide the Service in accordance with these Terms, Ridetech Georgia may process the User's personal data up to the extent and for the purpose necessary for the provision of such Service, as specified in the Notice on Personal Data Processing posted at: https://yandexgo.com/legal/yandexgo_privacy_notice/en/
12.2. When providing the Service functionality, Ridetech Georgia does not make any decisions that give rise to legal consequences in relation to the User or otherwise affecting his/her rights and legitimate interests.
12.3. When providing the Service functionality Ridetech Georgia may collect individual consents to the processing of Users’ personal data for access to the Service additional (optional) options, as well as for the purpose of sending information about Ridetech Georgia products, services and/or our partners. The User will voluntarily, of his/her own free will and in his/her own interests, provide Ridetech Georgia with such consent to the processing of his/her personal data and can revoke the corresponding consent using the features of the Service.
12.4. The User makes a representation to Ridetech Georgia of the circumstance, which is significant for the performance hereof and the provision of the Service, that all personal data provided by him/her is reliable and relates to the User, and is liable for any negative consequences of the inaccuracy of the personal data provided.
12.5. Ridetech Georgia processes personal data strictly in accordance with the Law of Georgia on Personal Data Protection. Users are clearly informed about the types of data collected, the purposes thereof, and the legal basis for each. Optional services requiring additional consent (e.g., location tracking, marketing) will be presented with a separate, freely given opt-in, and revocable at any time
13. Termination and Modification of the Terms
13.1. Ridetech Georgia may propose amendments to these Terms by posting a new version at: https://yandex.com/legal/scooters_ge/ . The User agrees to the proposed amendments to the Terms by expressing consent in the manner provided for in Clause 2.1 of the Terms, by booking and/or Renting a Partner’s e-scooter after Ridetech Georgia posts a new version of the Terms. If, since entering into the Agreement, the text of the Agreement posted at https://yandex.com/legal/scooters_ge/ has been amended, then by renting the e-scooter, the User confirms that he/she has read the amendments and agrees with the Agreement as amended from time to time.
13.2. This Agreement may be terminated on either Party's initiative.
13.3. The Parties have agreed that, at the Partner’s and/or Ridetech Georgia’s request, this Agreement may be terminated in the following cases:
13.3.1. The User’s violation of the Terms of Use of the Service, available at: https://yandex.com/legal/scooters_ge/;
13.3.2. The User’s violation of the License Agreement to use the Yandex Go mobile application available at: https://yandex.com/legal/yandexgo_mobile_agreement/ .
13.3.3. The User’s outstanding debt to the Partner.
13.4. This Agreement may be early terminated by Ridetech Georgia unilaterally and out of court in the event of repeated violation (more than two (2) times) of the terms and conditions hereof by the User by sending a notice to the User via the Application. In the event of Ridetech Georgia’s repudiation of the Agreement, the Agreement shall be deemed terminated from the moment the User is notified on the matter via the Application.
13.5. This Agreement may be early terminated by the User unilaterally and out of court at any time via the Application interface. In the event of the User’s repudiation of the Agreement, the Agreement shall be deemed terminated from the moment Ridetech Georgia is notified on the matter via the Application.
13.6. For all other reasons that are not listed in Clauses 12.1 to 12.5 hereof, in the absence of the consent of the Parties, the Agreement shall be terminated in court.
13.7. The Parties’ obligations under the Agreement, which, by their nature, shall remain in effect after the termination of the Agreement (including, but not limited to, confidentiality obligations, settlement of accounts, etc.), shall survive the termination hereof.
13.8. The Agreement shall be effective from the moment of Acceptance in the manner provided for hereby.
13.9. The Agreement shall be in effect perpetually, and, in terms of the Rental of a specific e-scooter, until the Rental completion.
14. Miscellaneous
14.1. This Agreement shall be governed by and construed in accordance with the laws of the Georgia. Any issues not governed hereby shall be resolved in accordance with the laws of the Georgia.
14.2. All disputes and disagreements arising between the Parties shall be settled by means of negotiations. If controversial issues are not resolved during the negotiations, all disputes under the Agreement or in connection herewith shall be subject to consideration in court in accordance with the laws of the Georgia currently in force.
14.3. Ridetech Georgia and/or third parties engaged may collect opinions and comments from Users on various issues of the Service for statistical purposes, to control the quality of Rental Services provided or the provided access to the Service functionality, as well as use the data obtained in a depersonalized form for the operation of the Service. The survey of Users may be conducted by sending an informational message or communication using the contact information specified by the User in the account (via phone calls or messages).
14.4. Ridetech Georgia may temporarily or permanently restrict the User's access to the Rental Services or to the Service functionality without explanation, including in case of violation of these Terms and Conditions by the User, an order of a competent authority, causing damage to Ridetech Georgia or third parties (as well as in order to prevent such acts), creating danger to others, protecting the rights and legitimate interests of Ridetech Georgia and third parties, obtaining repeated complaints about the User's actions, including in case of violation of the rules and conditions that ensure the safe use of a e-scooter.
14.5. The User, by agreeing to these Terms, is aware and confirms that the User and the Partner determine the subject of the Rental and the terms of use of a specific e-scooter in writing: in the order of exchanging electronic documents, as provided for in Part 4 of Article 328 of the Civil Code of the Georgia, using the Application. The Parties acknowledge that the Application allows the Parties to the Agreement to be reliably established, as well as the fact that electronic documents originate from the Parties hereto. The e-scooter Rental Agreement is not a framework agreement and is entered into in relation to the Rental of a specific e-scooter. To inter into the Agreement, the Partner shall send the Agreement to the User in the Application, which shall be an offer, information on the e-scooters available for Rental, and the terms of their use, and the User shall send in the Application an acceptance of the offer in the form of a message about agreement with the terms and conditions of the Agreement and consent to accept for Rental a specific e-scooter from the list sent by the Contractors on the terms specified in the offer, including by clicking a button in the Application expressing the User’s consent to the Agreement, if he/she agrees with the terms and conditions of the Agreement, or refusal to accept the offer in the form of a corresponding message, if he/she does not agree with the terms and conditions of the Agreement.
14.6. The Parties acknowledge the validity of communications, as well as scanned copies of the documents sent and received using the App, as well as e-mail, which allows the message and/or document originating from the Party hereto to be reliably established. For the purposes of prompt cooperation, the Parties are entitled to use telephone communication. Ridetech Georgia uses the User’s contact data indicated by him/her at registration in the Application for contacting the User. The User is liable for the reliability of the information provided to Ridetech Georgia, including the e-mail address specified by the User when registering in the Application. The User is obliged to use the Ridetech Georgia’s and/or Partner’s data specified in the Terms and in the Application to communicate with Ridetech Georgia and/or the Partner.
14.7. The Parties have come to an agreement that a specific User performing any actions in the Application, including, but not limited to, accepting the Terms, accepting the e-scooter for Rental, the e-scooter in relation to which any actions are performed by the User, including in relation to which additional services are provided and which is in the User’s use, as well as the date and time of acceptance and transfer of the e-scooter, as well as the performance of other actions provided for by the Agreement, shall be determined on the basis of the data of remote accounting of the specified information by Ridetech Georgia.
