Terms of Use for the Yandex Forms Service
1. General Provisions
1.1. This document (hereinafter referred to as the "Terms") establishes the terms of use for the Yandex Forms service (Forms).
If Forms are used within the framework of Yandex 360 services, the General Terms of Use for Yandex 360 Services, posted at: https://yandex.com/legal/360_termsofuse (hereinafter referred to as the "General Terms"), shall apply in addition to these Terms.
If Forms are used within the framework of the Yandex Cloud Platform services, the Terms of Use for the Yandex Cloud Platform Service, posted at: https://yandex.ru/legal/cloud_termsofuse/ru/, shall apply in addition to these Terms.
By starting to use the Yandex Forms service/its individual functions, the User/Corporate Client shall be deemed to have accepted these Terms and the aforementioned documents in full, without any reservations and exceptions.
The current version of the Terms is always available on the Internet page at: https://yandex.com/legal/forms_termsofuse/.
In case of disagreement by the User/Corporate Client with any of the provisions of the specified documents, the User shall not be entitled to use the Forms.
1.2. The unified rules and principles for the use of the service, provisions on intellectual property, personal data processing, and liability shall be governed by the documents specified in clause 1.1 of the Terms, taking into account the specifics contained in these Terms.
2. Features of the Use of the Yandex Forms Service
2.1. By starting to use the Forms, the User/Corporate Client agrees to and accepts the Help section available at: https://yandex.ru/support/forms/en/. The specified page constitutes an integral part of these Terms.
2.2. The Service provides Users/Corporate Users with the functionality to conduct marketing research, collect applications and feedback on the User's/Corporate Client's goods and/or services, and conduct other surveys by creating and publishing surveys for an audience on the Internet. Yandex reserves the right to provide other functional capabilities that Yandex, at its sole discretion, makes available for use.
2.3. Yandex reserves the right, at its sole discretion, to restrict the User's/Corporate Client's access to the Service (or to certain functions of the Service, if technologically possible) or to completely block the User's/Corporate Client's account in the event of a gross or repeated violation of these Terms, to delete a specific Form, or to apply other measures to the User/Corporate Client for the purpose of complying with legal requirements or the rights and legitimate interests of third parties.
2.4. Access levels are divided into:
- Users who create Forms (hereinafter referred to as the "Creator");
- Users who fill out Forms (hereinafter referred to as the "Respondent").
2.5. The Creator shall be solely responsible for the content of the Forms and undertakes to independently compensate for any damage caused to third parties, the Respondent, or Yandex in connection with their unlawful actions.
2.6. The Service is not intended for the processing of special categories of personal data concerning racial or national origin, political opinions, religious or philosophical beliefs, health status, intimate life, or personal data regarding criminal records. The Creator is not entitled to create Forms that involve the provision of such data.
2.7. The Creator is obliged to comply with the requirements of applicable legislation in the field of personal data when processing Respondents' personal data, including having a legal basis for processing personal data through the Service. Yandex is not liable to Respondents for violations of applicable legislation in the field of personal data committed by the Form Creator.
2.8. Respondents are also obliged to comply with these Terms, other applicable documents, and legal requirements, including in cases where they specify personal data of third parties when using the Forms. Yandex is not liable to third parties for violations of applicable legislation in the field of personal data committed by Respondents.
2.9. The User is obliged to compensate Yandex for losses incurred by Yandex as a result of violations of these Terms, other applicable documents, and legal requirements.
2.10. The Forms may include the possibility of integration with Yandex Metrica, as well as other Yandex 360 services, including but not limited to Mail, Tracker, and Wiki.
