License Agreement for the use of the Yandex Disk Application for Mobile Devices

Before using the program, please read the terms and conditions of the following license agreement. Any use of the program by you means your full and unconditional acceptance of its terms.

If you do not accept the terms of the license agreement in full, you are not entitled to use the program for any purpose.

1. General Provisions

1.1. This License Agreement (the "License") sets forth the terms and conditions for the use of the "Yandex Disk" program for mobile devices (the "Program") and is concluded between any person using the Program (the "User") and Yandex (as defined in the User Agreement for Yandex Services https://yandex.com/legal/rules), which is the holder of the exclusive right to the Program (the "Rightholder").

1.2. By copying the Program, installing it on your mobile device, or using the Program in any way, the User expresses their full and unconditional consent to all the terms and conditions of the License.

1.3. The use of the Program is permitted only under the terms and conditions of this License. If the User does not accept the terms and conditions of the License in full, the User is not entitled to use the Program for any purpose. The use of the Program in violation (non-fulfillment) of any terms and conditions of the License is prohibited.

1.4. The use of the Program by the User under the terms and conditions hereof for personal non-commercial purposes is free of charge. The use of the Program on terms and in ways not provided for by this License is possible only on the basis of a separate agreement with the Rightholder.

1.5. By using the Program, the User agrees that the following documents are integral parts of this License, the terms and conditions of which fully apply to the use of the Program:

The specified documents (including any parts thereof) may be amended by the Rightholder unilaterally without any special notice. New versions of the documents shall come into force from the moment of their publication, unless otherwise provided in the new versions of the documents.

1.6. This License and all relations associated with the use of the Program shall be governed by the laws of the Russian Federation, and any claims or lawsuits arising out of or in connection with this License or the use of the Program shall be submitted to and reviewed by courts at the location of the Rightholder, unless otherwise provided by the agreement of the Parties, including one concluded by accepting an offer.

1.7. The Rightholder may provide the User with a translation of this License from Russian into other languages; however, in the event of a conflict between the terms of the License in Russian and its translation, the Russian version of the License shall be legally binding exclusively.

2. Rights to the Program

2.1. The exclusive right to the Program belongs to the Rightholder.

3. License

3.1. The Rightholder grants the User a non-transferable right to use the Program free of charge, on the terms and conditions of a simple (non-exclusive) license, on the territory of countries around the world in the following ways:

3.1.1. Use the Program for its direct functional purpose, for which purpose to copy and install (reproduce) it on the User's mobile device(s). The User has the right to install the Program on an unlimited number of mobile devices. Upon installation on a mobile device, each copy of the Program is assigned an individual number, which is automatically reported to the Rightholder.

3.1.2. Reproduce and distribute the Program for non-commercial purposes (free of charge).

4. Limitations

4.1. Except as used in the scope and in the ways expressly stipulated by this License or the legislation of the Russian Federation, the User may not modify, decompile, disassemble, decrypt, and perform any other actions with the object code of the Program having the goal of obtaining information on the implementation of algorithms used in the Program, create derivative works using the Program, and otherwise use (allow to use) the Program, without the written consent of the Rightholder.

4.2. The User does not have the right to reproduce and distribute the Program for commercial purposes (including for a fee), including as part of collections of software products, without the written consent of the Rightholder.

4.3. The User does not have the right to distribute the Program in a form different from the one in which they received it, without the written consent of the Rightholder.

4.4. The Program must be used (including distributed) under the name: "Yandex Disk", "Disk", "Disk", or "Yandex.Disk". The User is not entitled to change the name of the Program, change and/or delete the copyright notice or any other indication of the Rightholder.

5. Terms of Use of Individual Functions of the Program

5.1. The performance of the Program's functions is possible only if there is access to the Internet. The User independently receives and pays for such access on the terms and at the rates of their telecom operator or Internet access provider.

5.2. When using the Program to interact with other services and/or programs of the Rightholder, including for uploading files to such services and/or programs and for copying files from such services and/or programs, the User also fully accepts and agrees to the terms of use, license agreements, and other regulatory documents of the respective services and/or programs.

5.3. All data on the use of the Program transmitted in accordance with this License is stored and processed in accordance with the Privacy Policy (https://yandex.com/legal/confidential/).

5.4. The User may have the opportunity to purchase additional options and subscriptions in the APP STORE application store. In this case, payment for the cost of the Subscription selected by the User in the APP STORE application store via the "In App Subscriptions" or "In App Purchases" technology provided by Apple Inc., as well as automatic renewal of access to the Subscription, are carried out under the terms posted on the Internet at: https://www.apple.com/legal/internet-services/itunes/en/terms.html.

5.5. The User may have the opportunity to purchase a Subscription in the Google Play application store. In this case, payment for the cost of the Subscription selected by the User in the Google Play application store via the In-app purchase technology provided by Google LLC, as well as automatic renewal of access to the Subscription, are carried out under the terms posted on the Internet at: https://play.google.com/intl/en_us/about/play-terms.html.

6. Liability under the License

6.1. The Program is provided on an "as is" basis. The Rightholder provides no warranties regarding the error-free and uninterrupted operation of the Program or its individual components and/or functions, the compliance of the Program with specific goals and expectations of the User, nor does it provide any other warranties not expressly stated in this License.

6.2. The Rightholder is not liable for any direct or indirect consequences of any use or impossibility of using the Program and/or damage caused to the User and/or third parties as a result of any use, non-use, or impossibility of using the Program or its individual components and/or functions, including due to possible errors or malfunctions in the operation of the Program, except in cases expressly provided for by legislation.

6.3. When using the Program, the following information is transmitted to the Rightholder in automatic mode anonymously (without linking to the User): the type of operating system of the User's mobile device, the version and identifier of the Program, statistics on the User's use of individual files uploaded via the Program, statistics on the use of the Program's functions, as well as other technical information.

6.4. Any questions and claims related to the use/impossibility of using the Program, as well as possible violations by the Program of legislation and/or third-party rights, must be forwarded via the feedback form at: http://feedback.yandex.com/disk/.

7. Updates/New Versions of the Program and Third-Party Software

7.1. This License shall apply to all subsequent updates/new versions of the Program. By agreeing to the installation of an update/new version of the Program, the User accepts the terms and conditions of this License for the corresponding updates/new versions of the Program, unless the update/installation of a new version of the Program is accompanied by another License Agreement.

7.2. Third-party software is included in the Program as its separate components. Current information about such third-party software included in the Program is available at: https://yandex.com/legal/disk_mobile_agreement/components/.

8. Amendments to the Terms of this License

8.1. This license agreement may be amended by the Rightholder unilaterally. Notification to the User of the amendments made to the terms of this License is published on the page: https://yandex.com/legal/disk_mobile_agreement/. The specified amendments to the terms of the license agreement shall come into force from the date of their publication, unless otherwise stipulated in the relevant publication.
