Terms of Use of Yandex SourceCraft

This document contains specific terms of use of SourceCraft (the "Service") and is an integral part of Yandex Cloud Customer Agreement (the "Agreement") and Service Terms set forth at https://yandex.com/legal/cloud_service_terms. Capitalized terms used herein but not defined herein shall have the meanings set forth in Agreement and Linked Documents.

1. Service Functionality

1.1. The Service offers the Customer:

  • possibility to create program code, manage program code versions, test, build, deploy and maintain software products;

  • an opportunity to implement the function of forming the Suggestions when writing program code in the IDE workspace including when the Customer installs the Plugin (the Code Assistant feature);

  • submission of Requests for the purpose of obtaining the Generated Program Code, including the complete creation of files, modules, or projects, and the ability to subsequently edit and publish such files, modules, or projects within the Service.

A complete description of the Service’s functionality is contained in the Instructions for using the Service posted on the Site and/or posted on the website: https://sourcecraft.dev and https://sourcecraft.dev/portal/docs/.

1.2. The Service provides the Customer with access to:

1.2.1. Storing and versioning of program code;

1.2.2. Automation of build and testing processes for software products;

1.2.3. Deployment and maintenance templates for software products;

1.2.4. Using the functions of the Code Assistant feature;

1.2.5. Using the functions of the VibeCraft feature;

1.2.6. Integration and use of third-party artificial intelligence models, including AI models independently selected by the User, for the generation of code;

1.2.7. Other functionalities of the Service that Yandex makes available to the Customer at its discretion. The full list of functionalities is available to the Customer on the Site and/or in the Management Console and/or posted on the website: https://sourcecraft.dev.

1.3. Service Level for the Service is determined in SLA.

2. Service Tariffication

2.1. The use of the Service is chargeable.

2.2. Service Fee is determined as per Service Rates and billing units specified on Site. Yandex may change Service Rates as stipulated by Agreement.

2.3. Service Fee for the Service depends on the number of Active users and Active сommitters (if applicable).

2.4. Yandex may from time to time provide Customer with additional functional features of the Service for an additional fee. Service Fee for the Code Assistant feature and the VibeCraft feature depends on the number of Workplaces and/or the amount of resources consumed.

2.5. Within the framework of the Service, the Customer can take advantage of special price and discount offers, information about which is posted on the Site and/or in the Management Console (if applicable).

2.6. The Customer acknowledges that only Statistical Data shall be used for the purpose of performing the Agreement and the Terms of Use of Yandex SourceCraft, in particular, in order to determine the number of Requests, the amount of remuneration, as well as the date of granting access to the Service and its duration.

2.7. In the event that the Customer uses connectable artificial intelligence models, ensuring their availability and payment for such models shall be the sole responsibility of the Customer.

3. Processing of data when using the Service (including the Code Assistant feature and the VibeCraft feature)

3.1. The Customer shall acknowledge and agree that the Service is not intended for the processing of personal data. If personal data or other information protected by law is submitted or stored by the Customer when using the Service, the Customer shall independently ensure the legality of the transfer of such data to Yandex, as well as their further processing, including for the purposes specified in these Terms.

4. Additional Code Assistant feature and VibeCraft feature Use

4.1. The Code Assistant feature and the VibeCraft feature may be used for commercial purposes to develop/create any computer programs, as well as used in any other way in the process of rendering services/performing work by the Customer in the course of its ordinary business. The VibeCraft functionality may be provided using both Yandex technologies and third‑party artificial intelligence models that are connected by the User independently or selected via the Service interface.

4.2. Yandex shall not guarantee the generation of the Suggestions or the Generated Program Code in all cases of program code input by the Customer, as well as the accuracy, reliability, correctness, or safety of the Suggestions or the Generated Program Code. Yandex does not guarantee the availability or operability of specific third‑party AI models used within the Service and shall not be liable for changes to the terms of their use made by third parties.

4.3. Yandex shall not be responsible for the content of the Suggestions and the Generated Program Code. The generation of content is performed in a fully automatic mode; Yandex does not (and does not have the technical ability to) verify the correctness of the Suggestions and the Generated Program Code, and all publicly available information that forms the basis for training the relevant artificial intelligence model.

4.4. The Customer shall independently verify the Suggestions and the Generated Program Code for accuracy, reliability, relevance, legality, and absence of vulnerabilities before using for its own purposes, integrating them into products, and/or before its further distribution the final program code obtained by using the Suggestions or the Generated Program Code.

4.5. The content of the Suggestions and the Generated Program Code shall not be considered as the result of creative work of Yandex’s employees, it does not express Yandex’s views, and shall not be construed as professional consultation or guidance as to a course of action.

4.6. The Customer shall assume all risks, including those related to infringement of third-party rights, when using the program code containing the Suggestions or the Generated Program Code.

4.7. The operation of the Code Assistant feature and the VibeCraft feature does not imply in each specific case the possibility of accurately identifying the source of information used for the purposes of training the artificial intelligence model on which the operation of the Service is based.

4.8. Suggestions and the Generated Program Code are created using AI technologies, therefore the Suggestions may not be unique and may coincide in whole or in part with the Suggestions or the Generated Program Code generated for other customers, or with code that is publicly available.

4.9. The Code Assistant feature can be used through the Service interface or by installing the Plugin to the corresponding IDE on the device through which the program code is developed. Plugins are available for download to devices at: https://storage.yandexcloud.net/yandex-code-assistant/plugins/vscode/yandex-code-assist.vsix.

4.10. Unless otherwise provided by a separate agreement between Yandex and the Customer, Yandex shall grant to the Customer free of charge, under an ordinary (non-exclusive) license, the non-transferable right to use the Plugin in accordance with its functional purpose to generate the Suggestions in all countries worldwide during the term of validity of the exclusive rights in the following ways:

4.10.1. use the Plugin for its direct functional purpose, in order to copy and install (reproduce) it on the Customer's personal computer(s). The Customer has the right to install the Plugin on an unlimited number of personal computers;

4.10.2. reproduce the Plugin on the Customer's devices.

4.11. When using the Code Assistant feature and the VibeCraft feature, it is prohibited to:

4.11.1. use special functionalities and create products with the help of the Code Assistant feature for the purposes contrary to the requirements of the applicable law, provisions hereof;

4.11.2. submission of Requests or otherwise circumventing the Service’s restrictions for the purpose of obtaining code or content that contains:

  • illegal and/or otherwise prohibited content;
  • instructions for creating malware, evading the law, or infringing the rights of third parties;
  • unethical or offensive content, or content that promotes hatred or discrimination;
  • pornographic material, including material depicting minors;
  • content that violates privacy rights, trade, banking, or other protected secrets;
  • content that infringes copyrights or other intellectual property rights of third parties.

4.11.3. disrupt the normal operation of the Service, perform other actions that may lead to functional failures and violate the rights and interests of Yandex and third parties;

4.11.4. to use the program code containing the Suggestions or the Generated Program Code for unfair purposes, in particular, to mislead third parties and to pass off that code as the result of human labor, in cases where there is no implied or explicit prohibition on the use of AI technologies;

4.11.5. use logos, means of individualization, interface design, other intellectual property of Yandex and its affiliates, as well as references to Yandex and its affiliates when distributing program code containing the Suggestions or the Generated Program Code without obtaining Yandex's consent, except for cases where special automatic marking is used in the Code Assistant feature (if any);

4.11.6. with the use of the Code Assistant feature or the generation of Generated Program Code to customize and train generative neural networks, services and tools that are based on AI technologies.

4.11.7. distribute / transfer the Plugin to third parties without prior approval of such transfer by Yandex.

4.11.8. modify, decompile, disassemble, decrypt and perform other actions with the object code of the Service and/or the Plugin in order to obtain information about the implementation of algorithms used in the Service and/or the Plugin, as well as to use (allow to use) the Service and/or the Plugin in any other manner, without the written consent of Yandex.

4.12. The Customer shall be solely responsible to third parties for actions related to the use of the Code Assistant feature the VibeCraft feature, the Suggestions, and the Generated Program Code as part of the Customer's program code.

4.13. The information provided by the Customer when using the Code Assistant feature and the VibeCraft feature, and the results of such generation (Suggestions and Generated Program Code) are not used by Yandex for the purposes of training models, unless the Customer has given us permission to do so.

4.14. Until April 6, 2026, the Code Assistant feature was provided in accordance with the Terms of Use of SourceCraft Code Assistant, available at: https://yandex.com/legal/cloud_terms_code_assistant/en/.

4.15. The Service may be provided using third‑party products. The use of such third‑party products shall be governed by the terms established by the relevant third parties, and the Customer shall comply with those third‑party requirements, including, without limitation, the following (as applicable to the model used):

4.15.1. the requirements located at https://www.llama.com/llama3_1/license and https://www.llama.com/llama3_3/license.

4.15.2. the requirements located at https://ai.google.dev/gemma/terms, including the Prohibited Use Policy available at https://ai.google.dev/gemma/prohibited_use_policy.

4.15.3. the requirements located at https://github.com/deepseek-ai/DeepSeek-LLM/blob/main/LICENSE-MODEL, including the restrictions on prohibited uses, which include:

  • any use that violates any applicable national or international law or regulation or infringes the lawful rights or interests of any third party;
  • any military use;
  • any use to exploit, harm, or attempt to exploit or harm minors in any way;
  • any use to create or disseminate knowingly false information and/or content intended to cause harm to others;
  • any use to create or disseminate improper content in violation of applicable regulatory requirements;
  • any use to create or disseminate personally identifiable information (PII) without proper authorization or for unwarranted purposes;
  • any use to defame, denigrate, or otherwise harass others;
  • any use for fully automated decision‑making that adversely affects individuals’ legal rights or otherwise creates or alters legally binding obligations;
  • any use aimed at discriminating against or harming individuals or groups based on social behavior (online or offline) or known or predicted personal characteristics;
  • any use targeting socially vulnerable groups (by reason of age, social, physical, or mental characteristics) with the purpose of substantially distorting the behavior of a person in such group in a manner that causes or may cause physical or psychological harm to that person or to others;
  • any use intended to discriminate against individuals or groups whose interests are protected by law under applicable legislation.

5. Intellectual Property

5.1. By posting Content on the Service, the Customer grants Yandex a worldwide, non-exclusive, free-of-charge license for the entire term of the copyright for the following rights in relation to the Content:

  • reproduction;
  • copying;
  • storage and computer memory recording.

If, within the functionality of the Service, the Customer makes the Content publicly available, in addition to the above rights, the Customer also grants Yandex the right of public display and making available to the public in relation to the Content.

5.2. If, within the functionality of the Service, the Customer makes the Content publicly available, the Customer grants other Customers a worldwide, non-exclusive, free-of-charge license for the entire term of the copyright for the following rights in relation to the Content:

  • reproduction;
  • copying;
  • storage and computer memory recording;
  • modification and creation of derivative works;
  • public display and making available to the public.

In this case, other Customers have the right to exercise these rights exclusively within the Service and solely through the implementation of the functionality of the Service.

5.3. The Customer has the right to post Content on an open license terms at their discretion by posting the text of such license as part of the Content. In this case, the terms of such license prevail over clause 5.2 of these Terms.

5.4. If the Customer, within the functionality of the Service, exercises their right to modify another Customer’s Content (Contribution), and another Customer approves such Contribution, then the Customer who made the Contribution grants the right to use the Contribution under the terms specified in clause 5.2 or 5.3 of the Terms, and the Customer — the copyright holder of the Content — has the right to use the Content containing the Contribution on the same terms. If the Customer — the copyright holder of the Content — posted the related agreement (Contributor License Agreement) as part of the Content, then the terms of such agreement are to be applied.

5.5. The Customer shall be entitled to use the Service, the Suggestions, and the Generated Program Code in any manner that does not contradict these Terms of Use and applicable law. Any use beyond the scope of the Terms of Use is possible only with the prior approval of Yandex.

5.6. The Customer shall agree that Yandex may use Requests, elements of the program code entered by the Customer and the Suggestions for the purposes of analytics to study errors and failures in the operation of the Service, to improve the operation of algorithms and technologies of Yandex and its affiliates, as well as for the purposes of discovering violations of the Terms of Use.

5.7. When starting the use of the Code Assistant feature and the VibeCraft feature, the Customer shall warrant that it does not and will not perform any actions aimed at circumventing any technical means of protection against an unauthorized use of the Service.

Any copying, reproduction, processing, distribution, making available to the public or other use of the Service and the code generation tools beyond the features provided in accordance with the Terms and any use thereof without the prior consent of Yandex are prohibited.

5.8. The Customer shall agree that Yandex may use the program code entered by the Customer, which Yandex receives as part of the User Information collected by the Plugin, to generate the Suggestions and maintain the correct operation of the Code Assistant feature. For the above purposes, the Customer shall grant Yandex and its affiliates the right to use such code under an ordinary (non-exclusive) license in all countries worldwide during the entire term of the exclusive rights by recording it in the memory of any devices, copying, modifying, creating derivative works solely for the purposes of analyzing and optimizing the Code Assistant feature.

6. Additional Service Use Restrictions

6.1. The Service may contain a number of restrictions, a list of which is contained on the Site and/or posted on the website: https://sourcecraft.dev and https://sourcecraft.dev/portal/docs/, in the section "Quotas and limits".

6.2. The Customer agrees to comply with all the rules and Instructions for using the Platform and Service, including posted on the website: https://sourcecraft.dev and https://sourcecraft.dev/portal/docs/. In case the Customer breaches the aforementioned rules and Instructions, Yandex reserves the right to immediately suspend access to the Service and/or rename the Customer, resources, organizations, profiles and etc. in the Service, and/or take other measures as provided for in the Agreement and at the above-mentioned addresses.

7. Definitions

“Active user” means a user whose action(s) resulted in any changes within Organization and/or repositories during Accrual Period.

Active Committer” means a user who, during Accrual Period, has made at least one (1) commit to a repository or uploaded a security report from personal code scanning tool.

Code Assistant” means an additional functional feature of the Service providing the Customer with an opportunity to implement the function of forming the Suggestions when writing program code in the workspace IDE.

VibeCraft” means an additional functional feature of the Service that enables the Customer to implement functionality for the Generation of Program Code.

IDE” means an integrated development environment.

Suggestions” means an AI-generated suggested option for writing program code that is one of the likely extensions of the program code entered into the IDE workspace by the Customer;

Organization” means a user's workspace within Service.

Plugin” means a special program module for installing Code Assistant to the corresponding IDE on the device of the Customer.

User Information” means information collected by the Plugin and transmitted for the purpose of generating the Suggestions, including elements of the program code being entered, device telemetry (keystrokes, other parameters), basic configuration of the Plugin / IDE, list of open files on the device and other information necessary for correct operation of the Code Assistant.

Workplace” means the right to use the Code Assistant feature with increased quotas for one (1) Organization member.

Generated Program Code” means information (code fragments, files, modules) generated using artificial intelligence technologies in response to a Customer Request, intended for subsequent use, editing, and integration into software products.

Request” means textual information, code context, or other data submitted by the Customer to the Service for the purpose of obtaining Generated Program Code or Suggestions.

Statistical Data” means data concerning the use of the Service, collected automatically by Yandex.
