- Definitions
This acceptable use policy (“AUP”) describes prohibited uses of Customer for Yandex.Cloud Services and forms an integral part of Yandex.Cloud Customer Agreement (“Agreement”). Capitalized terms used herein but not defined herein shall have the same meanings set forth in Agreement or Linked Documents.
For the purposes of this document, applicable legislation means the legislation of the Russian Federation, as well as, in certain cases, the applicable legislation of Kazakhstan. Applicable legislation also includes the legislation of other countries, as well as acts of international law applicable to the relations of the parties, provided that Yandex undertakes obligations to comply with them.
1. Prohibition to store, place, and distribute Illegal and Critical Content
1.1. Customer
bears full responsibility for the Content placed (uploaded) by the Customer on the Platform for public and/or restricted access. The Customer undertakes to indemnify and hold Yandex harmless against any claims from third parties related to the Customer's use of Services, including those related to the violation of rights to intellectual activity results and equivalent means of individualization.
1.2. Yandex does not monitor Customer’s Content placed (uploaded) on the Platform for public and/or restricted access, and is not responsible for the accuracy, quality, and content of such Content.
Yandex does not exercise any prior censorship (moderation) of the Content placed (uploaded) by the Customer. In the event of the Customer's violation of applicable legislation, the provision of Services may be suspended by Yandex without prior notice to the Customer.
Yandex has the right to immediately, without prior notice to the Customer, suspend the provision of access to the Services and/or delete the relevant Content in the following cases:
1.4.1. Customer takes actions aimed at forwarding, posting, transmitting, reproducing, downloading, placing, distributing in any way, as well as any other use of Content that is illegal, malicious, threatening, defamatory, offends public morality, promotes hatred and/or discrimination of people based on racial, ethnic, gender, religious, or social grounds, contains insults directed at specific individuals or organizations, or affects any patent, trademark, trade secret, copyright, or other proprietary rights and/or copyright and related rights of third parties;
1.4.2. Customer places links to any Content that is fully or partially protected by copyright, related, or other rights, without the permission of the rightsholder, as well as to Content prohibited by applicable legislation;
1.4.3. Customer distributes and/or posts Content that contradicts the requirements of applicable legislation, norms of international law, or infringes upon the rights of third parties;
1.4.4. Customer places and promotes Content containing pornographic materials, including those depicting minors, materials containing elements of child erotica, as well as advertisements for intimate services;
1.4.5. Customer places and/or transmits illegal Content, including Content that contributes to the incitement of interethnic enmity, incites violence against any person or group of persons, or to inhumane treatment of animals, calls for the commission of illegal activities, including explaining the procedure for using explosives and other weapons;
1.4.6. Customer publishes and places Content containing codes that act similarly to computer viruses, hacker programs, or other malicious programs;
1.4.7. Customer takes actions to distribute in any way Content containing information about third parties that is untrue and/or defamatory to the honor and dignity of individuals, or the business reputation of legal entities.
1.5. In cases when the Customer is a resident of the Russian Federation, Yandex is not responsible for the Customer's placement of critical information infrastructure subject to regulation under the regulatory legal acts adopted in accordance with it, and hereby prohibits the Customer from such placement.
1.6. Where Customer is a resident of the Republic of Kazakhstan, Yandex is not responsible for the Customer's placement of critical digital objects subject to regulation under the Law of the Republic of Kazakhstan dated November 24, 2015 No. 418-V "On Cybersecurity" and the regulatory legal acts adopted in accordance with it, and hereby prohibits the Customer from such placement.
1.7. Where Customer is a resident of a state other than those specified in Clauses 1.5 and 1.6,, Yandex is not responsible for the Customer's placement of infrastructure objects for which special requirements are established by the relevant provisions of applicable legislation (including foreign legislation) that Yandex is obliged to fulfill, and hereby prohibits the Customer from such placement.
2. Prohibition to falsify data**
2.1. Yandex may, at its’ sole discretion, suspend Customer's right to access to Services and/or delete the relevant Customer's Content immediately without prior notice to Customer if:
2.1.1. Customer performs actions to impersonate another person or representative of a legal entity or a community, including Yandex employees, forum moderators, and a website owner, without sufficient rights to do so, as well as actions aimed at misleading others regarding the properties and characteristics of any subjects or objects;
2.1.2. Customer uses any forms and methods of unlawful representation of other persons;
2.1.3. Customer provides names, addresses, phone numbers, logins, passwords, email addresses, etc. that do not belong to Customer or do not exist as identification details, unless the owners of these details authorized Customer to use them.
3. Prohibition of Spamming**
3.1. Yandex may, at its’ sole discretion, suspend Customer's right to access Services and/or delete the relevant Customer's Content immediately without prior notice to Customer if Customer:
3.1.1. performs actions to send, transfer, distribute, post Spam;
3.1.2. subscribes a postal address of the owner of the relevant address to any periodic mailings without prior confirmation from the owner of the address (push subscription);
3.1.3. performs a periodic mailing with no explicit indication of the way to unsubscribe;
3.1.4. sends information to persons who previously clearly stated their unwillingness to receive such information;
3.1.5. advertises services, goods, and other materials, which distribution is limited or prohibited by applicable laws, and advertises spamming and similar services;
3.1.6. takes actions aimed at sending, transmitting, or distributing in any way lists of other people's email addresses, pyramid schemes, multilevel (network) marketing, online earning systems, chain letters, etc.
4. Prohibition of Mining**
4.1. The Customer shall not use the Platform and/or Services for Mining, nor organize, coordinate, or otherwise facilitate Mining activities using the Platform and/or Services.
4.2. Yandex may, at its’ sole discretion, suspend Customer's right to access Services without prior notice if the Customer violates the clause 4.1, or if Yandex has grounds to believe (including based on an analysis of Service usage scenarios) that the Customer is committing such a violation. Yandex's decision to classify the Customer's activity as Mining shall be final, unless otherwise established by a court decision that has entered into legal force.
4.3. Yandex may undertake any technical and organizational measures for limiting the possibility of using the Platform and (or) Services for Mining.
5. Prohibition of network attacks**
5.1. Yandex may suspend Customer's right to access Services immediately without prior notice Customer, if Customer unauthorizedly uses Yandex.Cloud Platform for network attacks or as a platform for conducting network attacks.
6. Prohibition to Scan Internet Hosts**
6.1. Yandex may suspend Customer's right to access Services immediately without prior notice to Customer, if Customer unauthorizedly scans Internet hosts.
7. Prohibition to Platform operation interference and unauthorized access to third party data and unfair actions**
7.1. Yandex may suspend Customer's right to access to Services (in whole or in part) immediately without prior notice to Customer, if Customer takes actions aimed at:
7.1.1. disrupting the normal operation of the Platform;
7.1.2. gaining unauthorized access to the information and Content of other Customers and Users of the Platform;
7.1.3. unfair use of the Platform and Services, including by taking actions that violate the rights of Yandex, third parties, or the terms of this document. Unfair use shall include, among other things, actions that are non-standard and not aimed at the normal use of the Platform and consumption of Service resources by a typical user, provided that such actions create risks to the security of the Platform, the stability of Service provision, or violate the rights of Yandex and/or third parties.
8. Prohibition to use Services in breach of any law**
8.1. Yandex may suspend Customer's right to access Services immediately without prior notice to Customer, if Customer uses Services in such a manner and by such methods that, in Yandex's opinion, result in a violation of applicable legislation and/or a violation of the rights and legitimate interests of third parties.
9. Prohibition on launching the operating system from secondary disks**
9.1. Customer is obliged to launch the operating system from the primary disk.
9.2. Yandex has the right to immediately, without prior notice to Customer, suspend the provision of access to Services on which Customer has launched the operating system by the secondary disk.
10. Network resources use limitation**
10.1. Yandex may limit access to certain network resources (gaming, bitcoin taps, etc.) in case Yandex has reasons to believe that the use of these network resources may lead to Customer’s misuse of Grant provided during Trial period or Credit Limit.
10.2. If Customer is intended to use the network resources specified in Clause 10.1 hereof, Customer shall request access from the Technical Support Service staff.
10.3. The criteria for granting access to the network resources specified in clause 10.1 of these Rules are established by the Technical Support Service.
11. Measures taken by Yandex in the event of a violation of these Rules
11.1. In the event that the Customer commits actions specified in this AUP, as well as for the purpose of identifying the causes of relevant incidents and misuses originating from the Platform's Cloud resources provided to the Customer, Yandex may perform memory dumps of Virtual Machines and DB Hosts of Customer and take other steps to identify causes of relevant incidents or misuses.
12. Security Measures**
12.1. For the purposes of preventing computer attacks (including DoS/DDoS attacks) and computer incidents, eliminating or mitigating their consequences, as well as taking measures to eliminate such consequences, Yandex may temporarily block or throttle the cloud resources of the Platform and the Services, including those provided to Customer. In such cases, Yandex shall bear no liability for any adverse consequences arising as a result of the actions specified in this Clause.
The Service Level Agreement shall also not apply when the circumstances specified in this Clause occur.
Definitions
Terms used in this document with an initial capital letter and not defined in the Offer and the Special Terms of Use of the Platform Services published on the Internet at https://yandex.com/legal/cloud_service_termsshall have the following meanings:
“Mining’ means an activity involving the use of the resources of the Platform and/or the Services, aimed at the creation and/or circulation of cryptocurrency, as well as any other activity recognized as mining in accordance with the provisions of applicable legislation.
“Spam” means Content sent to the public at large without prior consent.
