Terms of Use of Yandex.Mail service
1. General Provisions
1.1. Air Smart Advertising Solutions FZ-LLC (hereinafter referred to as the “Company") invites an Internet user outside the UAE (hereinafter referred to as the "User") to use Yandex.Mail available at: http://mail.yandex.com (hereinafter the "Service").
1.2. The current version of the Terms is always available at: https://yandex.com/legal/mail_termsofuse.
1.3. These Terms shall constitute a User Agreement and define how to use the Service.
In any matters not covered herein, the relations between the Company and the User with regard to the Service shall be governed by the User Agreement for Yandex Services (https://yandex.com/legal/rules) and Privacy Policy (https://yandex.com/legal/confidential) (hereinafter referred to as the Regulatory Documents).
1.4. When starting to use the Service, the User undertakes to read these Terms, as well as to review the Regulatory Documents, and independently bears the risk of not reviewing it.
Starting to use the Service (or its certain functions), the User is considered to have accepted these Terms, as well as the terms of the Regulatory Documents in full, without any reservations or exceptions.
If the User disagrees with any of the provisions of the said documents, the User is not entitled to use the Service.
1.5. These Terms and the Regulatory Documents may be amended by the Company without any special notice, and the new versions of these Terms and the Regulatory Documents shall come into force from the moment they are posted on the Internet at the addresses specified in this clause and in clause 1.3. of the Terms.
By continuing to use the Service after amendments to the Terms or the Regulatory Documents, the User shall be deemed to have accepted the new versions thereof.
1.6. By using the Service, the User agrees to receive informational messages. The user may opt out of receiving messages by using the Service functionality or by following the instructions in the email.
2. Use of the Service. Certain Service functionality
2.1. To start using the Service, the User shall register in compliance with the procedure described at section 2 of the User Agreement for Yandex Services (https://yandex.com/legal/rules) which will result in creation of a unique account for the User whose login shall be used in the Service as the address name for the mail box in login@yandex.ru format (hereinafter referred to as the Mailbox).
For addressing purposes, the Mailbox may be assigned a different domain zone as part of the Mailbox address (including without limitation: com, kz, by, etc.).
2.2. Subject to the limitations of the Service and settings of the User, the Service may offer to the User the functionality of creating, drafting, editing, sending and receiving e-mails using the Mailbox and other activities, if provided by the Service.
2.3. The User shall have the right to use the Mailbox from the moment of registration of the account and until its deletion, or until access to the Mailbox or User’s account is restricted by the Company or due to other purposes.
The contents of the Mailbox may be subject to archiving if the User has not used it for more than 24 months. Within 6 months after the archive is created, the User can access the Mailbox and its contents by logging in via the Service and, following the instructions provided by the Service, continue to use the Mailbox. If the User has not accessed the Mailbox after its archiving, the Mailbox can be deleted.
2.4. The storage of files attached to emails received/sent using the Mailbox shall be carried out under the Terms of Use of Yandex Disk Service, available at: https://yandex.com/legal/disk_termsofuse.
If the User exceeds the limit of storage space available within Yandex Disk, the Service functionality may be restricted, in particular, sending or receiving e-mails with file attachments that exceed the free disk storage space may be suspended.
2.5. The Service can render the functionality of sending automatic notifications to the User about upcoming events, including planned flights. The operation of this functionality is fully automated and does not imply Company's access to the contents of the User's Mailbox. The user can independently disable this functionality in the notification settings.
2.6. Paid and free features of the Service.
2.6.1. The following functionality may be provided to the User (individual) on a free of charge basis:
- use of the standard features of the Service;
- features of storing files attached to correspondence received/sent using a Mailbox within the limits of Yandex Disk;
- the voice to text feature for a message with its subsequent conversion to a text format,
The Company does not guarantee the accuracy, correctness, error-free operation of the functionality and recommends to additionally check the converted text before sending a message and check the original text with the sound reproduction.
2.6.2. On a basis of paid subscription, the User is provided with the following:
- advanced features of the Service under the terms available at: https://yandex.com/legal/promail_offer;
- advanced features for storing files attached to correspondence received/sent using a Mailbox under the terms and conditions of Yandex Disk.
2.7. Commercial use of the Service or any of its components is not subject to the Terms.
3. Restrictions to the Use of the Service
3.1. The User may define the procedure and goals of using the Service on his/her own and shall be responsible for such use. The User shall refrain from using the Service for illegal purposes, for receiving/sending/publishing information violating requirements of any applicable legislation and affecting rights and interests of any third parties.
The User shall be held solely liable, including liability to third parties, for actions performed by him/her when using the Service, and for the compliance of the content of any information received/sent via the Service, with the requirements of applicable laws.
3.2. The User acknowledges and agrees that he/she shall independently assess all the risks associated with the use, processing and storage of information published/received/sent via the Service, including the assessment of reliability, completeness, safety, legality or utility of such information.
3.3. The Company reserves the right (but is not obliged) to restrict the User's access to the Service (or to certain features of the Service, if technologically possible) using the User's account or to block the User's account completely if the User violates these Terms and/or the terms of the Regulatory Documents, as well as if there is a threat of violation of the rights and interests of third parties and/or the Company or its affiliates.
3.4. The Company reserves the right to establish any (technical, legal, organizational or other) rules, limits and restrictions on the use of the Service, and may change them at its sole discretion, without prior notice to the User. To the extent not prohibited by applicable laws, these rules, limits and restrictions may vary for different categories of Users.
4. Liability
4.1. The Company shall take any reasonable measures and perform all possible actions directed at securing the User’s data in the Service and maintaining the operation of the Service. However, the User shall be aware of the possibility of technical malfunctions and failures in the operation of the Service, and agrees that the Company does not have the technical ability to predict when and how they may occur, nor notify the User about them in advance, nor completely exclude the possibility of their occurrence. Regardless of the reasons and consequences, the occurrence of such faults or failures may not be the basis for subjecting the Company to any penalties.
4.2. The Company does not access the Users' correspondence and does not track actual content or the information sent or received by the User via the Service. The Company does not provide confirmations or reports indicating that the User has sent or received correspondence, performed any actions in the Service, or recorded the status of the User's Mailbox at any given time. Any actions relating to viewing, changing, deletion, management of the Mailbox content are performed exclusively by the User at his/her own discretion.
The User acknowledges that deleting the contents of the Mailbox may result in complete loss of the information contained in the correspondence, without the possibility of its recovery.
4.3. Any information received using the Service shall be used by the User at his/her own risk and the User shall be solely liable for any possible consequences of using the information, including the damage that it may cause to the User's device and to data stored in the device; for violation of rights and any other damage caused to the User and to third parties.
The Company is not liable for any kinds of losses incurred as a result of the User's use or inability to use the Service or any of its components/functions, including those incurred as a result of possible errors and malfunctions.
4.4. The Company has a right to set restrictions on the use of the Service for all Users, or for certain categories of Users (depending on the User's place of residence, the language in which the Service is provided, etc.), including: availability/absence of certain features of the Service, period of storage of Mailbox, any other content, maximum number of messages that can be sent or received by a single registered User, maximum size of an email message or disk space, maximum number of requests to the Mailbox during a specified period of time, maximum content storage period, special parameters for content upload, etc. The Company is entitled to prohibit automatic access to the Service, as well as stop receiving any information generated automatically (for example, email spam).
In order to protect the User's hardware and its own hardware, the Company has a right to restrict the reception of any messages and their delivery to the User when such messages contain malware or malicious code, or when Company's automatic filtering and antivirus protection tools have detected the presence of such malware or malicious codes in the specified messages. The User is notified and agrees that the Company, thereof, has a right to analyze and investigate such malware and malicious code contained in these messages, as well as to transmit such messages to partners engaged for analysis — third-party developers of antivirus software to improve the quality of automatic filtering and antivirus protection of the Company.
5. Miscellaneous
5.1. Personal data of the User is processed for the purposes and on conditions stated in the Privacy Policy current version of which is available at https://yandex.com/legal/confidential.
5.2. Any relations pertaining to the use of the Service shall be governed by the applicable law.
5.3. Any and all questions, requests and claims related to the use/inability to use the Service, as well as any potential infringement of the laws and/or third party rights, shall be forwarded via the feedback form available at: https://yandex.com/support/mail/troubleshooting.html.
