Terms of Use of Yandex.Collections API

YANDEX Limited Liability Company (hereinafter referred to as the "Yandex") invites an Internet user (hereinafter referred to as the "User") to use Yandex.Collections API under the terms and conditions set forth herein (hereinafter referred to as the "Terms").

1. General Provisions

1.1. Terms and Definitions

Service means Yandex.Collections API being a programming interface meant to interact with Yandex.Collections and available at: https://yandex.com/collections.

Data means links to images the User found on the Internet via Yandex.Collection available at: https://yandex.com/collections or the User uploaded to Yandex.Collections as a preview (hereinafter referred to as the "content"). The User combines such content in their own discretion in certain categories (hereinafter referred to as the "Collections").

API Key means a unique ID Yandex assigns to the User that makes Service functions accessible from the User's website(s).

1.2. The way the User uses the Service shall be governed by these Terms and:

1.3. By starting to use the Service or its certain functions, inter alia, the User accepts, upon signing up in the Service, obtaining an API Key, posting the service code in their website, or using any other feature available in the Service, these Terms and terms of all the documents specified in cl. 1.2 of the Terms, in full, without reservation or exception, and undertakes to respect them. It is only possible to use the Service under the terms and conditions other than the terms and conditions of the said documents subject to Yandex's prior written consent. If the User disagrees with any of the terms and conditions of the said documents, the User may not use the Service.

1.4. The User shall be held independently liable for compliance with the Laws when using the Service. Unless explicitly stated otherwise, the term "Laws" throughout this text shall mean any applicable laws, including both laws of the Russian Federation and laws of residence of the User or a place, where the User's equipment is located, or a place, where he/she commits legally significant acts under these Terms. If the User violates the Laws by using any feature of the Service, the User undertakes to cease using the Service.

1.5. These Terms and relations between Yandex and the User arising out of or in connection with the use of the Service are covered by the law of the Russian Federation, and all disputes and disagreements arising out of the Terms or the use of the Service shall be resolved in court at the location of Yandex subject to the mandatory pre-trial settlement of disputes and disagreements by making user requests via Yandex feedback form as prescribed by the rules of cl. 5.1 of the Terms.

2. Terms of Use of the Service

2.1. To gain access to the Service, the User should sign up as prescribed and secure Yandex’s consent to use the Service in the form of an API Key transferred to the User. After the sign-up, Yandex may, at own discretion, deny access to the Service without giving any reason. The User may not use any programs, devices, or other means that make it possible to obtain an API Key automatically or otherwise in violation of the procedure established by Yandex.

2.2. The User may only use the Service as part of web services freely available for public use. The User may not use the Service for projects requiring payment or otherwise limiting access for third parties. The sign-up requirement shall not be deemed as limiting access under this clause. The User may not use the Service to create web services, computer software, or otherwise, if such use violates the Laws, the documents specified in cl. 1.2 of the Terms, and/or third-party rights and legitimate interests.

2.3. The Service makes it possible for the User to create, upload, edit, and delete the Collections as well as to add, edit, move, and delete cards from the Collections. The User may only use the Data and functions obtained through the Service as part of features provided by the Service.

2.4. Any limits and restrictions, including the limited number of service accesses per day, are set as Yandex thinks fit and can be changed without prior notice to the User. If the limits and restrictions set by Yandex are exceeded, Yandex reserves the right to restrict user access to the Service.

2.5. The User may not change, decompile, and/or somehow modify the program code they obtained via the Service. This rule does not apply to software code and scripts that are cited as examples in the description of the Service. Such data are provided freely and without charge and can be changed, modified, or otherwise converted while retaining a reasonably specific link to Yandex.

2.6. The User is hereby notified and agrees that when providing the Data to the User Yandex may receive impersonal (without reference to the User) statistics on how the Service is used and technical information on the User’s website. Yandex processes such statistics and such information as per the rules of the Privacy Policy.

2.7. Yandex reserves the right to change, correct, or update the Service at any time, with no prior notice to the User. When another stable version is released, Yandex announces its release on web pages of the Service. When a new version of the Service is released, Yandex does not guarantee that its outdated versions will operate stably and continuously. The User unwilling to use an updated version of the Service can continue to use an outdated version of the Service at their own risk or stop using the Service by deleting the respective code from the User's website(s).

2.8. Yandex may, at its own discretion, terminate or suspend access to the Service for the User without notice and with no reason given, particularly if the User fails to comply with the requirements of these Terms.

3. Intellectual Property Rights

3.1. The exclusive right to the Service is vested in Yandex. The exclusive rights to the Data are vested in Yandex or other copyright holders. These Terms do not authorize the User to use the Service or Data other than as directly permitted in the Service interface as per these Terms.

3.2. Using the Service, the User grants to Yandex the right to use a logotype, trademark, and/or trade name of the User and/or the User's website for information, advertising, and marketing purposes with no need to secure any additional consent of the User and with no remuneration payable to the User for such use.

4. Disclaimer

4.1. Yandex provides the Service (including the Data) "as is". Yandex does not guarantee that the Service and Data are fit for the User's purposes and expectations, the Service and its certain components and/or functions operate uninterruptedly and error-free, and does not guarantee the reliability, accuracy, completeness, or timeliness of the Data. Yandex does not guarantee the uninterrupted and error-free operation of third-party software products and solutions (including libraries) recommended in specifications and other Service-related documents to run the Service.

4.2. The User will be held solely liable, in full, for using and safekeeping their API Key. The User may not obtain an API Key for third parties, transfer, or provide it to third parties. Yandex will not be held liable for unauthorized use of the API Key by third parties. All actions performed in the Service with the API Key belonging to the User will be deemed to be performed by the User.

5. Final Provisions

5.1. All questions and claims related to the use of / inability to use the Service should be sent via feedback form on the web page of the Service.

5.2. Yandex may change the text of these Terms at any time without notifying the User. The current version of these Terms is available at: https://yandex.com/legal/collections_api. A new version of these Terms becomes effective once posted online at the URL specified in this paragraph. Any continued use of the Service after the Terms have been amended will qualify as the acceptance of the new version. The User shall stop using the Service, if Yandex has made any changes to these Terms the User disagrees with.
