1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of Yandex.Taxi B.V. (hereinafter referred to as Yandex.Taxi) to an Internet user (hereinafter referred to as the User) to use Yango service (hereinafter referred to as the Service).

1.2. The use of the Service by the User is governed by these Terms and documents of YANDEX LLC (16, Leo Tolstoy St., Moscow, 119021, Russia):

1.3. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms and provisions of Regulatory Documents, in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms and/or Regulatory Documents, the User may not use the Service.

1.4. Yandex.Taxi may, at any time without notice to the User, amend provisions hereof, and YANDEX LLC may, at any time without notice to the User, amend provisions of the Regulatory Documents. The current version hereof is available at: https://yandex.com/legal/yango_termsofuse. The User bears a risk of failure to review a new version of the Terms and Regulatory Documents. Any continued use of the Service after the Terms or Regulatory Documents have been changed will qualify as the acceptance of the new version.

1.5. The User shall stop using the Service, if he or she disagrees with any amendments to these Terms Yandex.Taxi made as prescribed by cl. 1.4 hereof.

1.6. The Service enables the User to place information, free of charge, on the User’s potential demand for passenger and baggage transportation services or other services, including delivery services, look through offers of organizations providing services in the said fields, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.

1.7. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to Yandex.Taxi.

1.8. For the avoidance of doubt, Yandex.Taxi does not provide passenger and baggage transportation services or other services, including delivery services, and help desk services.

1.9. All conversations the User holds with the support team and drivers of partners of the Service can be recorded to control quality and improve services.

1.10. By using the Service, the User consents to receive promotional messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use.

2.2. Information on passenger and baggage transportation services or other services, including delivery services (hereinafter referred to as the Information) is provided by partners of the Service. The list of partners is available at https://yango.yandex.com/partners. For more information about the services offered (including Wi-Fi access point availability in the cabin, in-cabin photo / video surveillance by the Rightholder's partner, and other information), the User may contact the partners of the Service or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide their with information about the services offered.

2.3. Yandex.Taxi shall not be held liable for the content and/or relevance of information provided by the partners of the Service, including information on the cost and current availability of the partners’ benefits. The User shall independently (without the participation of Yandex.Taxi) discuss the acquisition of services with the partners in accordance with the partners’ rules on the provision of services. Yandex.Taxi shall not be held liable for financial and any other transactions effected by the User and the partners and for any consequences of the acquisition of the partners’ services by the User.

2.4. The User may access functions of rating the services of the Service partners and commenting / leaving feedback on the Service and/or services of the Service partners. Users ratings and feedback are posted on the Service website and can be available on third-party websites. Yandex.Taxi reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason.

2.5. Yandex.Taxi reserves the right, at own discretion, to limit user access to the Service (or to certain functions of the Service, if technologically feasible) using the User's account or block the User’s entire account upon multiple violations hereof, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

2.6. When demand for taxi or other services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service partners can be raised. Yandex.Taxi informs of higher tariffs by posting the relevant notice on the Service website https://yango.yandex.com or otherwise as Yandex.Taxi thinks fit, inter alia, by sending an information message to the User’s mobile phone number.

2.7. Passenger and baggage transportation services as per Economy, Comfort, Business, and other tariffs available in the Service are rendered by different types of vehicles. Vehicles are ranked automatically based on vehicle performance data provided by the partners of the Service.

2.8. A taxi provider charges fees for a trip cancelled by the User, if such cancellation took place after the vehicle's arrival to the place the User had appointed. The amount of such fees is calculated the same way as the cost of trip/service as per tariff for a period of time from when the vehicle actually arrived to the pick-up place or from the time of arrival specified in information the taxi provider submitted to the User regarding the transportation the User/Users’ parcel ordered (whichever comes later) until the User cancelled the trip/service. The User shall cancel a trip/service by sending a relevant notice to the taxi provider via the Service. A User that has not boarded a vehicle served by the taxi provider within ten (10) minutes taking into account no-charge waiting time specified in a respective tariff is deemed to have cancelled a trip/service, unless otherwise stipulated by the relevant taxi provider's rules or agreements between the User and a representative (driver) of the taxi provider. The cancellation fee for airport-to-city transfers is calculated as described above plus an additional fee charged for out-of-town ride as per tariff.

2.9. The User authorizes Yandex.Taxi to process personal information (including personal details) of the User of Yandex.Taxi, to transfer personal information of the User to Yandex.Taxi’s partners, and to process personal information for Yandex.Taxi’s partners to provide services to the User in the Service. When the User turns to the Service, their personal information is transmitted to YANDEX LLC to be processed under the terms and for the purposes determined in the Privacy Policy of YANDEX LLC available at: (https://yandex.com/legal/confidential).

2.10. If the User orders deliveryservices from Yandex.Taxi’s partners, he or she undertakes not to hand over for the delivery the following items:
  • hand-held combat, non-military and service weapons, ammunition, spare parts and components, sports bows and crossbows, weapons designed for light, smoke and sound signals, electric weapons, electroshock devices and spark dischargers, cold bladed weapons, bludgeons, knuckle-dusters, shurikens, twigs, boomerangs and other adjusted items for striking, smashing, throwing, piercing, and cutting except for sporting equipment, special technical dual-use devices and components;
  • narcotic drugs, psychotropic substances, precursors and their analogs;
  • nuclear materials, radioactive, superpotent, caustic, explosive and flammable substances, firing agents, pyrotechnic substances and related items, and other hazardous substances;
  • poisons, poisonous animals, poisonous substances, poisonous plants and seeds of poisonous plants;
  • the national currency and foreign currency;
  • printed publications, graphic materials, film, photo, audio and video materials containing propaganda for or promotion of violent changes of the constitutional order, destruction of national security, war, social, racial, national, religious, class and clan superiority, cruelty, violence, and pornography;
  • perishable foodwithout special package;
  • items and substances that, by their nature or due to packaging, can be a danger to the public, can contaminate or damage (destruct) other loads, surrounding people, or items;
  • animals and plants, biological materials;
  • items requiring specially equipped vehicles to be transported, including foodstuff;
  • liquids in open containers;
  • space eating items, which total length, width (two diameters or axes at the roll base) and height dimensions (subject to special exemptions) exceed 150 cm; long items over 150 cm; the weight of transferred items may not exceed 20 kg;
  • fragile items without special packaging;
  • any other items, which distribution is prohibited or limited in the territory of countryof delivery service provision.

The Yandex.Taxi’s partners may set other limits on items to be delivered.

The Yandex.Taxi’s partners do not provide any postal services and do not accept postal items (addressed letter correspondence, postal parcels, containers, printed publications in relevant packaging) for delivery.

The Driver, acting as a representative of the Yandex.Taxi’s partner, can prepare the consignment document with the User or they can come into the agreement not to conclude the consignment document.

The User is aware of and confirms that, if he or she fails to meet the above requirements to items to be delivered, the User is solely responsible for all the negative effects that may occur while the Yandex.Taxi’s partner provide delivery services. At the same time, a Yandex.Taxi’s partner may deny delivery services to the User, if the Yandex.Taxi’s partner/ representatives of the Yandex.Taxi’s partner discover any non-deliverable items.

3. Function of Cashless Payment for Passenger and Baggage Transportation Services and other services, including delivery services

3.1. The User can pay for passenger and baggage transportation services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:

3.1.1. Directly to a taxi provider (inter alia, by cash or by any other means stipulated by the said taxi provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Yandex.Taxi being involved and shall not be governed by these Terms. The said payment method may be restricted for the delivery services.

3.1.2. The User can access the function of cashless payment by a Linked Bank Card (cl. 3.2 hereof); in this case, Yandex.Taxi acts in the name of the relevant taxi provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the taxi provider or otherwise (including directly) (hereinafter referred to as cashless payments). Yandex.Taxi does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

Depending on the User's region, cashless payments can be made without Yandex.Taxi acting as a payment recipient or with Yandex.Taxi involved as another party to settlements or a party to information exchange.

The User shall choose the relevant form of payment in the Service interface. In this respect, if it is impossible to make cashless payments for any reason (including, but not limited to temporary technical inaccessibility of this function, temporary or constant impossibility to make cashless payments using the Linked Card, insufficient funds in the Linked Card), the User undertakes to pay by Cash.

For cashless payments, it is possible to effect both one transaction for the entire cost of passenger and baggage transportationor other service and several transactions for certain parts of the cost of the service. Cashless payments can be effected by any of the above means during the trip/service or when the trip/service is over.

In case of cashless payments, the User can, along with payment for passenger and baggage transportation or other service, make an additional cashless payment to the taxi provider as a percentage of the cost of the paid passenger and baggage transportation or other service (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.

3.2. The User shall specify the Linked Bank Card in the Service interface indicating the following details:

  • Bank card number
  • Valid through
  • Verification code

If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.

3.3. When a Linked Card is added and when the User chooses the function of cashless payment for a certain trip/service, the amount limited to RUB 5 (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.4. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips via the Service interface; the User can change the amount of Tips for a certain trip/service in the Service interface, when the trip/service is over.

3.5. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be charged from the Linked Card, if the User, within 30 minutes after the trip/service is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip/service (specifies no number of stars) and clicks "Done".

3.6. If within 30 minutes after the trip/service is over the User assigns a low rating to the trip/service (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.

3.7. If within 30 minutes after the trip/service is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip/service. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip/service).

3.8. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.

3.9. When indicating their details pursuant to cl. 3.2 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.

3.10. The User understands and agrees that all actions performed in the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.

3.11. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact Yandex.Taxi by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

If, following the inspection caused by such a request, Yandex.Taxi decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If Yandex.Taxi is not a party to settlements made via the Linked Card, Yandex.Taxi can act as a body that transfers above user requests to taxi providers, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.

3.12. Yandex.Taxi reserves the right to require at any time that the User confirm the details they specified in the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated by cl. 2.5 hereof, if Yandex.Taxi thinks fit.

3.13. The provisions on the terms and procedure of payment for passenger and baggage transportation or other services, including delivery services, specified in this Section shall not apply, when a third party pays for such transportation or other services instead of the User under a separate contract Yandex.Taxi signed with such third party.

Conditions d'usage du service Yango

1. Dispositions générales

1.1. Les présentes Conditions (ci-après — Conditions) représentent un offre de la société Yandex.Taxi B.V. (ci-après — « Yandex.Taxi ») à l'utilisateur du réseau Internet (ci-après — Utilisateur) concernant l'usage du service Yango (ci-après — « Service »).

1.2. L'usage du Service par l'Utilisateur est régi par les présentes Conditions, ainsi que par les documents de la SARL YANDEX (16 rue Lva Tolstovo, Moscou, 119021 Russie) :

1.3. Il est considéré qu'en procédant à l'usage du Services/de ces fonctionnalités séparées, l'Utilisateur accepte les présentes Conditions, ainsi que les conditions des Documents réglementaires dans leur intégrité, sans aucune restriction ni réserve. Dans le cas où l'Utilisateur n'accepte par une quelconque des dispositions des Conditions et/ou des Documents réglementaires, l'Utilisateur ne peut pas utiliser le Service.

1.4. Yandex.Taxi a le droit de modifier les dispositions des présentes Conditions à tout moment et sans notification à l'Utilisateur et la SARL YANDEX a le droit de modifier les dispositions des Documents réglementaires à tout moment et sans notification à l'Utilisateur. La version en vigueur des présents Conditions est publiée à : https://yandex.com/legal/yango_termsofuse. Le risque de non prise de connaissance de la nouvelle version des Conditions et des Documents réglementaires est subi par l'Utilisateur. L'usage du Service après la modification des Conditions ou des Documents réglementaires est considéré comme l'accord de l'Utilisateur avec leurs nouvelles versions.

1.5. Dans le cas où Yandex.Taxi a apporté des modifications quelconques aux présentes Conditions, conformément au paragraphe 1.4. des présentes Conditions, que l'Utilisateur n'accepte pas, il est tenu d'arrêter l'usage du Service.

1.6. Le Service donne à l'Utilisateur la possibilité de publier, à titre gratuit, l'information relative à la demande potentielle de l'Utilisateur de service de transport des passagers et du bagage, ainsi que la possibilité de prendre connaissance des informations relatives aux offres des organisations qui fournissent des services dans le domaine susmentionné et de rechercher de telles offres selon les critères fixés par l'Utilisateur. Toutes les fonctionnalités du Service existant actuellement, ainsi que tout leur développement ou l'adjonction de toutes fonctionnalités nouvelles constituent l'objet des présentes Conditions.

1.7. En fonction de la région de l'Utilisateur, l'accès à toutes ou à certaines fonctionnalités du Services peuvent être bloqué ou limité. L'accès de l'Utilisateur aux fonctionnalités depuis une certaine région est considéré comme bloqué (limité) pour, si l'Utilisateur ne peut pas s'en servir directement. L'application de tous moyens techniques ou logiciels pour contourner ces limitations est interdite. Les dispositions des présentes Conditions qui régissent les fonctionnalités du Service l'accès auxquelles est bloqué (limité) pour l'Utilisateur ne sont pas applicables jusqu'à ce que l'Utilisateur ne puisse s'en servir directement. Les informations concernant l'accessibilité des fonctionnalités du Services dans une région correspondante sont fournies à l'Utilisateur à la demande de celui-ci adressée à Yandex.Taxi.

1.8. Pour éviter tout doute, Yandex.Taxi ne fournit pas de services de transport des passagers et des bagages, ainsi que des services de dispatching et d'information.

1.9. Toutes les conversations de l’Utilisateur avec les spécialistes du service clientèle ainsi qu’avec les chauffeurs des partenaires du service peuvent être enregistrés à des fins de contrôle de la qualité et de perfectionnement des services.

1.10. Par l'usage du Service, l'Utilisateur donne son accord pour la réception des messages publicitaires. L'Utilisateur a le droit de renonces à la réception des messages publicitaires, en appliquant les fonctionnalités correspondantes du Services ou en suivant les indications du message publicitaire reçu.

2. Usage du Service. Certaines fonctionnalités du Service

2.1. Le Service est mis à disposition de l'Utilisateur pour l'usage personnel non commercial.

2.2. Les informations relatives aux services de transport des passagers et des bagages (ci-après — Informations) sont fournies par les partenaires du Service. La liste des partenaires est accessible depuis l'adresse https://yango.yandex.com/partners. Pour les informations détaillées relatives aux services fournis (y compris les informations relatives à la possibilité de connexion par wi-fi dans la voiture, à la réalisation par le partenaire du détenteur de droits de la vidéoprotection dans la voiture et autres informations) l'Utilisateur peut soit s'adresser aux partenaires du Service, soit fournir ses cordonnées via une fonctionnalité du Service pour que les partenaires du Service puissent eux-mêmes contacter l'Utilisateur et lui fournir les informations relatives aux services offerts.

2.3. Yandex.Taxi n'engage pas la responsabilité pour le contenu et/ou pour l'actualité des informations fournies par les partenaires du Service, y compris pour les informations relatives aux prix des services des partenaires, ainsi que à leur disponibilité à un moment donné. L'interaction de l'Utilisateur avec les partenaires concernant l'acquisition des services est effectuée par l'Utilisateur lui-même (sans participation de Yandex.Taxi), conformément aux règles de la prestation des services définies par les partenaires. Yandex.Taxi n'engage pas la responsabilité pour les opérations financières et pour toutes autres opérations effectué par l'Utilisateur et par les partenaires, ainsi que pour toutes les conséquences de l'acquisition des services des partenaires par l'Utilisateur.

2.4. L'Utilisateur peut avoir l'accès aux fonctionnalités de l'évaluation des services des Partenaires, ainsi que de la publication des commentaires/avis relatifs au Services et /ou aux services des partenaires. Les notes et les avis des utilisateurs sont publiés sur le site du Service et peuvent également être accessibles depuis les sites des tiers. Yandex.Taxi se réserve le droit de refuser la publication de tous notes/avis, ainsi que d'effacer/bloquer à tout moment la note/l'avis publiés par l'Utilisateur, à sa convenance et sans aucune explication.

2.5. Yandex.Taxi se réserve le droit de limiter, à sa convenance, l'accès de l'Utilisateur au Service (ou à de certaines fonctionnalités du Service, si cela est possible du point de vue technique) depuis son compte personnel ou de bloquer le compte personnel de l'Utilisateur pour les violations répétées des présentes Conditions ou applique d'autres mesures à l'Utilisateur dans le but du respect de la législation et des droits et intérêts légitimes des tiers.

2.6. Au cours des périodes où la demande de services de taxi est élevé (y compris les jours fériés, les jours des manifestations publiques et dans les autres cas), les tarifs des partenaires du Service peuvent être augmentés. Yandex.Taxi informe de l'augmentation des tarifs par la publication de la notification correspondante sur le site du Service https://yango.yandex.com ou par tout autre moyen à la convenance de Yandex.Taxi, y compris par l'envoi d'un message informationnel au numéro mobile de l'Utilisateur.

2.7. Les services de transport des passagers et des bagages selon les tarifs Économe, Confort, Affaires et selon les autres tarifs proposés par le Service sont fournis par les voitures de classes différentes. La répartition des voitures entre les classes est réalisée automatiquement en fonction des renseignements relatifs aux caractéristiques de la voiture fournis par les partenaires du Service.

2.8. Le service de taxi facture la renonciation de l'Utilisateur à un trajet lorsque cette renonciation a eu lieu après l'arrivée de la voiture à l'endroit indiqué par l'Utilisateur. Ce montant est calculé de la même façon que le coût du trajet selon le tarif horaire du moment de l'arrivée de la voiture à l'endroit de départ ou du moment de l'arrivée indiqué dans les informations présentées à l'Utilisateur par le service de taxi dans le cadre du service de transport commandé par l'Utilisateur (selon la dernière éventualité) et au moment de la renonciation de l'Utilisateur au trajet. L'Utilisateur renonce au trajet, en envoyant une notification correspondante au service de taxi par voir du Service. Il est considéré que l'Utilisateur qui n'a pas embarqué dans la voiture fournie par le service de taxi au cours de dix (10) minutes, compte tenu du temps de l'attente non remboursable indiqué pour le tarif correspondant, a renoncé au trajet, sauf autres dispositions du service de taxi correspondante ou saufs autres stipulations entre l'Utilisateur et le représentant (le conducteur) du service de taxi. Le montant facturé dans le cas de la renonciation de l'Utilisateur au trajet de l'aéroport est calculé de la même façon qu'il est indiqué ci-dessus, avec la facturation du supplément pour le trajet hors de la ville, conformément au tarif.

2.9. L'Utilisateur donne son accord à Yandex.Taxi pour le traitement des informations personnelles (y compris des données personnels) de l'Utilisateur par Yandex.Taxi, pour le transfert des informations personnelles de l'Utilisateur par Yandex.Taxi aux partenaires de Yandex.Taxi, ainsi que pour le traitement des informations personnelles par les partenaires de Yandex.Taxi dans le but de la prestation des services à l'Utilisateur dans le cadre du Service. Lors de l'usage du Service par l'Utilisateur, les informations personnelles de l'Utilisateur sont transmises à la SARL YANDEX pour le traitement dans les conditions et dans les buts définis dans la Politique de confidentialité de la SARL YANDEX qui est accessible depuis l'adresse suivante : (https://yandex.com/legal/confidential).

3. Fonctionnalité de paiement du service de transport des passagers des bagages sans espèces

3.1. Le paiement du service de transport des passagers des bagages fourni à l'Utilisateur conformément à l'information publiée par lui à l'aide du Service relative à la demande du service correspondant peut être effectué par l'Utilisateur de manière suivante :

3.1.1. Directement au service de taxi (y compris en espèces ou par tous autres moyens acceptés par le service de taxi correspondant lorsqu'ils sont prévus, ci-après dans le texte des présentes Conditions et dans l'interface du Service — « Espèces »). Le paiement par le moyen de paiement susmentionné est effectué sans participation de Yandex.Taxi et n'est pas régi par les présentent Conditions.

3.1.2. L'Utilisateur peut avoir l'accès à la fonctionnalité de paiement sans espèces, avec une Carte bancaire attachée (paragraphe 3.2. des présentes Conditions) ; dans ce cas Yandex.Taxi agit de la part du service de taxi correspondant ou sur une autre base et fait intervenir le processeur de paiement agréé, le processeur de paiement électronique ou tout autre entité participant au règlement et est le bénéficiaire du paiement en qualité de l'agent du service de taxi ou en toute autre qualité (ci-après — « paiement sans espèces »). Yandex.Taxi ne garantit pas l’absence d'erreurs et de défaut de fonctionnement du Service en ce qui concerne la possibilité du paiement sans espèces.

En fonction de la région de l'Utilisateur, le paiement sans espèces peut être effectué sans participation de Yandex.Taxi en qualité du bénéficiaire du paiement, ou avec intervention de Yandex.Taxi en qualité de l'entité tierce participant au règlement ou en qualité du participant de l'interaction informationnelle.

Le choix du moyen de paiement est effectué par l'Utilisateur dans interface du Service. Toutefois, dans le cas où il est impossible d'effectuer le paiement sans espèces pour toute raison que ce soit (y compris, mais sans s'y limiter, dans le cas d'inaccessibilité technique temporaire de cette fonctionnalité, d'impossibilité temporaire ou permanente d'effectuer le paiement sans espèces avec une Carte bancaire attachée), l'Utilisateur s'engage à effectuer le paiement en Espèces.

Dans le cas du paiement sans espèces, il est possible d'effectuer une seule transaction pour le montant total correspondant au coût du service de transport des passagers et des bagages, ainsi que plusieurs transactions correspondant aux certaines parties du prix du service. Dans ce cas, le paiement peut être effectué par tout moyen susmentionné au cours du trajet ou après son achèvement.

Lors du paiement sans espèces, l'Utilisateur a la possibilité d'effectuer, à sa convenance, outre le paiement du service de transport des passagers et des bagages, un paiement sans espèces complémentaire au bénéfice du service de taxi dont le montant est égal à un certain taux du coût du service de transport des passagers et des bagages payé (ci-après dans le texte des présentes Conditions et dans l'interface du Service — « Pourboire »).

3.2. La Carte bancaire attachée est identifiée dans l'interface du Service par l'Utilisateur qui fournit des données suivantes :

  • Numéro de la carte bancaire
  • Date de validité
  • Cryptogramme visuel

Si les données relatives à la carte bancaire sont exactes et valables, et si l'usage de cette carte dans le cadre du Service est possible du point de vue technique, la carte bancaire susmentionnée acquiert le statut de la Carte bancaire attaché et peut être utilisée pour le paiement sans espèces (paragraphe 3.1.2. des présentes Conditions). Toutes les Cartes attachées s'affichent dans l'interface du Service ; par souci de commodité de l'Utilisateur, 4 derniers chiffres du numéro de la Carte attachée sont affichés.

3.3. Lors de l'addition d'une Carte attachée, ainsi que dans le cas où la fonctionnalité de paiement sans espèces est choisi par l'Utilisateur pour un trajet, le prélèvement d'un montant de 5 roubles russes environ (ou d'un autre montant en devise de la région de l'Utilisateur) est effectué dans le but de vérifier l'exactitude et la validité des données de la Carte attachée ; dans le cas de la transaction réussie, le montant indiqué est remboursé à l'Utilisateur. La tentative échouée du prélèvement du montant indiqué signifie l'impossibilité d'adjonction de cette Carte attachée et/ou l'inaccessibilité de la fonctionnalité de paiement sans espèces.

3.4. Lors de l'adjonction de la Carte attachée, ainsi qu'à tout moment après son adjonction, l'Utilisateur a la possibilité de fixer et/ou de modifier le montant du Pourboire par défaut dans l'interface du Service ; le montant du Pourboire pour un trajet concret peut être modifié par l'Utilisateur dans l'interface du Service après l'achèvement de ce trajet.

3.5. Le Pourboire (montant par défaut ou montant spécialement indiqué par l'Utilisateur pour un trajet concret) sera prélevé sur la Carte attachée, si, au cours de 30 minutes après l'achèvement du trajet, l'Utilisateur donne une note positive au trajet (4 à 5 étoiles) et appuie le bouton « Terminé » ou s'il n'attribue aucune note au trajet (n'indique pas le nombre d'étoiles) et appuie le bouton « Terminé ».

3.6. Dans le cas où, au cours de 30 minutes après l'achèvement du trajet, l'Utilisateur donne une note négative au trajet (1 à 3 étoiles) et appuie le bouton « Terminé », le Pourboire ne sera pas prélevé sur la Carte attachée.

3.7. Dans le cas où, au cours de 30 minutes après l'achèvement du trajet, l'Utilisateur appuie le bouton « Terminé », le montant du Pourboire (montant par défaut ou montant indiqué par l'Utilisateur spécialement pour un trajet concret) sera bloqué sur la Carte attachée pendant 24 heures au cours desquelles l'Utilisateur a la possibilité de augmenter et de réduire le montant du Pourboire pour le trajet correspondant. Après l'achèvement de la période indiquée, le prélèvement du Pourboire est effectué dont le montant a été fixé par l'Utilisateur (par défaut ou pour le trajet concret).

3.8. Le paiement sans espèces est effectué par l'Utilisateur avec la participation du processeur de paiement agréé ou du processeur de paiement électronique et est régi par les règles des systèmes de paiements internationaux, par les règles des banques (y compris de la banque émettrice de la Carte attachée) et des autres entités participant au règlement.

3.9. Lors de l'indication de ses données conformément au paragraphe 3.2. des présentes Conditions et lors de l'usage ultérieur de la Carte attachée, l'Utilisateur confirme et garantit l'exactitude et l'exhaustivité des informations fournies relatives à la carte bancaire valable émise à son nom ; le respect par lui des règles des systèmes de paiements internationaux et des exigences de la banque émettrice de la Carte attachée, y compris en ce qui concerne les modalités de la réalisation des paiements sans espèces.

3.10. L'Utilisateur comprend et accepte que toutes les actions effectuées dans le cadre du Service avec l'utilisation du numéro mobile confirmé par lui, y compris en ce qui concerne le paiement sans espèces à l'aide de la Carte bancaire attachée sont réputées d'avoir été effectuées par l'Utilisateur.

3.11. Dans le cas du désaccord de l'Utilisateur avec le fait et/ou avec le montant du paiement sans numéraire et dans le cas des questions liées à l'usage de la Carte attachée dans le cadre du Service, l'Utilisateur a le droit de s'adresser à Yandex.Taxi par téléphone dont les numéros sont indiquée par le Service et/ou via l'interface du service assistance clients (formulaire de contact) dans le délai de 14 jours à compter de la date de réalisation du paiement sans espèces ou de la date des autres actions ou événements faisant l'objet de la demande.

Si, suite à la vérification d'une telle demande Yandex.Taxi prend la décision de remboursement intégral ou partiel du montant du paiement sans espèces, ce remboursement est effectué sur le compte bancaire de la carte bancaire qui a été utilisée pour le paiement sans espèces. Le remboursement des fonds est effectué avec la participation du processeur de paiement agréé ou du processeur de paiement électronique et est régi par les règles des systèmes de paiements internationaux, par les règles des banques (y compris de la banque émettrice de la Carte attachée) et des autres entités participant au règlement. Dans les cas où Yandex.Taxi ne participe pas aux règlements à l'aide de la Carte attachée, Yandex.Taxi peut intervenir en qualité de l'entité qui transmet les messages de l'Utilisateur concernant les questions susmentionnées aux services de taxi, aux postes de dispatching ou à d'autres personnes qui sont bénéficiaires du paiement au titre des opérations susmentionnées liées à la Carte attachée.

3.12. Yandex.Taxi se réserve le droit d'exiger à tout moment la justification par l'Utilisateur des données indiquées par lui dans le cadre du Service, y compris des données de la Carte attachée et de demander pour cela de fournir des pièces justificatives (notamment, des pièces d'identité) dont le défaut de présentation peut, à la convenance de Yandex.Taxi, être considéré comme la présentation des informations inexactes et peut entrainer les conséquences prévues au paragraphe 2.5. des présentes Conditions.

3.13. Les dispositions indiquées à la présente section et relatives aux conditions et aux modalités du paiement du service de transport des passagers et des bagages ne sont pas applicables dans le cas où le paiement de ce service est effectué au nom de l'Utilisateur par une tierce personne en vertu d'un contrat spécial passé entre Yandex.Taxi et la tierce personne susmentionnée.

Yango -palvelun käyttöehdot

1. Yleistä

1.1. Nämä Ehdot (jäljempänä Ehdot) ovat Yandex.Taxi B.V.:n (jäljempänä Yandex.Taxi) tarjous Internetin Käyttäjälle (jäljempänä Käyttäjä) Yango -palvelun käyttämisestä.

1.2. Palvelun käyttämistä säädellään näissä Ehdoissa ja seuraavissa YANDEX OOO:n (Lva Tolstogo ul. 16, 119021 Moskova, Venäjä) asiakirkjoissa:

1.3. Palvelun / sen osien käytön aloittanutta Käyttäjää pidetään nämä Ehdot sekä Säätelevien asiakirjojen ehdot hyväksyneenä täydessä laajuudessa ilman mitään varaumia ja poikkeuksia. Jos Käyttäjä ei hyväksy joitakin Ehtojen ja/tai Säätelevien asiakirjojen lausekkeita, hän ei saa käyttää Palvelua.

1.4. Yandex.Taxi voi milloin tahansa muuttaa näitä Ehtoja Käyttäjää tiedottamatta, ja YANDEX OOO voi milloin tahansa muuttaa Säätelevien asiakirjojen ehtoja Käyttäjää tiedottamatta. Voimassaoleva versio Ehdoista on osoitteessa https://yandex.com/legal/yango_termsofuse. Riski jäädä tutustumatta uuteen versioon Ehdoista ja Säätelevista asiakirjoista jää Käyttäjälle, ja Palvelun käytön jatkamista Ehtojen tai Säätelevien asiakirjojen muuttumisen jälkeen katsotaan näiden uuden version hyväksymiseksi.

1.5. Jos Yandex.Taxi on tehnyt joitakin muutoksia näihin Ehtoihin kohdan 1.4 tarkoittaman menettelyn mukaisesti, ja Käyttäjä ei hyväksy ko. muutoksia, hänen on lopetettava Palvelun käyttö.

1.6. Palvelu antaa Käyttäjälle maksuttoman mahdollisuuden jättää tieto mahdollisesta taksimatkatarpeestaan tai muista palveluista, mukaan lukien toimituspalveluista sekä mahdollisuuden tutustua tietoon ko. alojen palveluntarjoajien tarjouksista sekä etsiä ko. tarjouksia Käyttäjän säätämillä hakuehdoilla. Kaikki tällä hetkellä olemassa olevat Palvelun toiminnot sekä näiden kaikki kehitykset ja/tai uusien toimintojen lisäykset ovat näiden Ehtojen alaisina.

1.7. Käyttäjän oleskelualueesta riippuen kaikki Palvelun toiminnot tai jotkin näistä saattavat olla pois käytöstä tai rajoitettu. Toimintoja katsotaan tietyltä alueelta oleviksi pois käytöstä/rajoitetuiksi Käyttäjälle, mikäli ko. Käyttäjä ei voi hyödyntää näitä suoranaisina. Mitään teknillisiä ja ohjelmallisia konsteja ko. rajoitusten ohittamiseksi ei saa käyttää. Näiden Ehtojen lausekkeita, jotka säätelevät Käyttäjän käytöstä pois olevia/rajoitettuja Ohjelmiston toimintoja, ei sovelleta niin kauan, kunnes ko. toiminnot ovat Käyttäjän käytettävissä suoranaisina. Käyttäjän toimintojen saatavuuteen kullakin alueella liittyvä tietoa Käyttäjä saa lähettämällä Yandex.Taxille ko. yhteydenottopyynnön.

1.8. Epäilysten välttämiseksi: Yandex.Taxi ei tuota henkilökuljetuspalveluita, ei tee matkatavaran kuljetuksia tai muita palveluita, mukaan lukien toimituspalveluita eikä toimi taksikeskuksena.

1.9. Mahdollisesti tallennamme kaikki Käyttäjän ja asiakastukipalvelun väliset sekä myös Käyttäjän ja Paluvelun yhteistyökumppanin kuljettajan väliset puhelut laadunvalvontatarkoituksiin ja palvelun laadun kehittämiseksi.

1.10. Käyttämällä Palvelua Käyttäjä suostuu siihen, että hänelle lähetetään mainosviestejä. Käyttäjä voi kieltäytyä vastaanottamasta mainosviestejä käyttämällä asiaankuluvaa Palvelun toiminnallisuutta tai seuraamalla näissä viesteissä olevia ohjeita.

2. Palvelun käyttö. Palvelun toiminnot

2.1. Palvelua tuotetaan Käyttäjälle ei-kaupallisia ajoja varten, yksityistarkoituksiin.

2.2. Tieto matkustajien ja matkatavaran kuljetuspalveluista, tai muista palveluista, mukaan lukien toimituspalveluista (jäljempänä Tieto), on Palvelun yhteistyökumppaneiden antama. Luettelo yhteistyökumppaneista on osoitteessa https://yango.yandex.com/partners. Saadakseen tarkempaa tietoa tarjottavista palveluista (mukaan lukien tieto wi-fi -yhteyden saatavuudesta auton matkustamossa ja onko matkustamossa valokuvausta/videovalvontaa Palvelun yhteistyökumppanin toimesta) Käyttäjä voi joko ottaa yhteyttä Palvelun yhteistyökumppaneihin tai Palvelun toiminnallisuutta hyödyntäen antaa omat yhteystietonsa, joilla yhteistyökumppanit pystyvät itse ottamaan yhteyttä Käyttäjään ja toimittamaan hänelle tietoa tarjottavista palveluista.

2.3. Yandex.Taxi ei ole vastuussa Palvelun yhteistyökumppaneiden toimittaman tiedon sisällöstä ja/tai ajantasaisuudesta, mukaan lukien kumppaneiden hintatiedon sekä palveluiden kulloisen saatavuuden. Käyttäjä itse hoitaa vuorovaikutuksen yhteistyökumppaneiden kanssa palveluiden hankkimiseksi, ilman Yandex.Taxin osallistumista, yhteistyökumppaneiden omien käytäntöjen mukaisesti. Yandex.Taxi ei ole vastuussa varainhoito- eikä mistään muista toiminnoista, joita Käyttäjä ja yhteistyökumppanit toteuttavat, eikä mistään seurauksista Käyttäjän tekemästä yhteistyökumppaneiden palvelujen hankkinasta.

2.4. Käyttäjän saatavilla voi olla Palvelun yhteistyökumppaneiden arvostelutoimintoja sekä Palveluun ja/tai Palvelun yhteistyökumppaneiden palveluihin liityvien kommenttien/palautteiden jättäminen -toiminto. Käyttäjäjien arvostelut ja palautteet julkaistaan Palvelun sivustolla, ja ne voivat myös näkyä kolmansien tahojen sivuilla. Yandex.Taxi pidättää itselleen oikeuden hylätä mitä tahansa arvostelua/palautetta ja milloin tahansa poistaa/estää näkymästä Käyttäjän jättämää arvostelua/palautetta Yandex.Taxin oman harkintansa mukaan ja kertomatta syitä.

2.5. Yandex.Taxi pidättää itselleen oikeuden rajoittaa oman harkintansa mukaan käyttäjätilin kautta toteutettavaa Käyttäjän pääsyä Palveluun tai sen tiettyihin osiin, sikäli se on teknisesti toteutettavissa, taikka kokonaan lukita käyttäjätili, jos näitä Ehtoja on rikottu useampaan kertaan, tai tehdä Käyttäjän suhteen muita toimenpiteitä lainvaatimusten tai kolmannen osapuolen oikeutettujen etujen toteuttamiseksi.

2.6. Kuljetuksen tai muiden palvelujen huippukysynnän aikaan, mukaan lukien juhla-aattoina, joukkotilaisuuksien päivinä sekä muissa tilanteissa, Palvelun yhteistyökumppaneiden taksat saattavat olla korotettu. Hintojen korotuksesta Yandex.Taxi tiedottaa julkaisemalla ilmoituksen sivustossa https://yango.yandex.com tai muilla Yandex.Taxin oman harkintansa mukaisin keinoin, kuten lähettämällä tekstiviestin.

2.7. Matkustajien ja matkatavaran kuljetuspalvelut Economy-, Comfort-, Business- ja muissa Palvelun esittämissä luokissa toteutetaan eri luokkien autoilla. Auto luokitellaan automaattisesti sen tiedon perusteella, mitä Palvelun yhteistyökumppanit antoivat auton ominaisuuksista.

2.8. Taksiliike perii Käyttäjältä peruutusmaksun, mikäli peruutus on tapahtunut sen jälkeen kun auto on tullut Käyttäjän määräämään paikkaan. Ko. maksun suuruus määräytyy samalla tavalla kuin matkan/palvelun hinta taksan mukaisesti siltä ajalta, mikä alkaa auton tullessa tilatulle paikalle, tai siitä kellonajasta, mikä oli taksiliikkeen toimesta ilmoitettu Käyttäjälle hänen tilaamansa taksikuljetuspalvelun/Käyttäjän paketin toimituspalvelun suhteen (riippuen siitä, kumpi näistä tulee myöhemmin), ja päättyy, kun Käyttäjä on peruuttanut matkan/palvelun. Käyttäjä peruuttaa matkan/palvelun lähettämällä taksiliikkeelle ilmoituksen Palvelun kautta. Käyttäjää, joka ei ole noussut taksiliikkeen lähettämän auton kyytiin kymmenen (10) minuutin kuluessa, tilatun taksan mukaista maksutonta odotusaikaa sisältäen, katsotaan peruuttaneeksi matkan/palvelun, ellei muuta ole määrätty ko. taksiliikkeen käyttöehdoissa tai Käyttäjän ja taksiliikkeen edustajan/kuljettajan välisellä sopimisella. Käyttäjän peruuttaessa matkan lentokentältä, peruutusmaksun suuruus lasketaan edellämainitulla menettelyllä sekä peritään lisä kaupungin ulkopuolelle lähdöstä.

2.9. Käyttäjä antaa Yandex.Taxille suostumuksen Käyttäjän henkilötietojen käsittelyyn, siirtoon/luovutukseen Yandex.Taxin yhteistyökumppaneiden käsiteltäviksi sekä Yandex.Taxin yhteistyökumppaneiden toimesta tapahtuvaan henkilötietojen käsittelyyn Palvelun sisältämien palveluiden tuottamiseksi. Palvelua käyttäessä Käyttäjän henkilötietonsa siirretään YANDEX OOO:lle käsiteltäväksi tämän Tietoturvapolitiikassa määrättyjen ehtojen ja tarkoitusten mukaisesti, joihon voi tutustua osoitteessa (https://yandex.com/legal/confidential).

2.10. Jos Käyttäjä tilaa toimituspalvelut Yandex.Taxin yhteistyökumppaneilta, hän sitoutuu olemaan toimittamatta seuraavia tuotteita:

  • kädessä pidettävät taisteluaseet, ei-sotilaalliset aseet ja virka-aseet, ampumatarvikkeet, varaosat ja komponentit, urheilujouset ja varsijouset, aseet, jotka ovat suunniteltu valo-, savu- ja äänisignaaleja varten, sähköaseet, sähköshokkilaitteet ja kipinäpurkaimet, teräaseet, ryhmysauvat, nyrkkiraudat, heittotähdit, rautatangot, bumerangit ja muut sopeutetut esineet lyömiseen, murskaamiseen, heittämiseen, lävistykseen ja leikkaamiseen, paitsi urheiluvälineet, erityiset kaksikäyttöiset tekniset laitteet ja komponentit;
  • huumausaineet, psykotrooppiset aineet, esiasteet ja niiden analogit;
  • ydinmateriaalit, radioaktiiviset, superpotentiaaliset, syövyttävät, räjähtävät ja syttyvät aineet, polttoaineet, pyrotekniset aineet ja niihin liittyvät esineet sekä muut vaaralliset aineet;
  • myrkyt, myrkylliset eläimet, myrkylliset aineet, myrkylliset kasvit ja myrkyllisten kasvien siemenet;
  • kansallinen valuutta ja ulkomaan valuutta;
  • painetut julkaisut, graafiset materiaalit, elokuva-, valokuva-, ääni- ja videomateriaalit, jotka sisältävät perustuslain mukaisen väkivaltaisen muutoksen propagandaa tai edistämistä, kansallisen turvallisuuden tuhoamista, sotaa, sosiaalista, rodullista, kansallista, uskonnollista, luokka- ja klaanityylitystä, julmuutta, väkivalta ja pornografia;
  • pilaantuvat elintarvikkeet ilman erityispakkausta;
  • esineet ja aineet, jotka luonteeltaan tai pakkaamisesta johtuen voivat olla vaaraksi yleisölle, voivat saastuttaa tai vahingoittaa (tuhota) muita tavaroita, ympäröiviä ihmisiä tai esineitä;
  • eläimet ja kasvit, biologiset materiaalit;
  • esineet, jotka edellyttävät erityisvarustetun ajoneuvon kuljetusta, mukaan lukien elintarvikkeet;
  • nesteet avoimissa astioissa;
  • ylisuuret tavarat, joiden kokonaispituus, -leveys (kaksi halkaisijaa tai akseli telan pohjassa) ja korkeusmitat (erityisiä poikkeuksia lukuun ottamatta) ylittävät 150 cm; pitkät tavarat yli 150 cm; siirrettyjen tavaroiden paino saa olla enintään 20 kg;
  • särkyvät tavarat ilman erityispakkauksia;
  • muut tavarat, joiden jakelu on kielletty tai rajoitettu toimituspalvelun tarjoajamaan alueella.

Yandex.Taxin yhteistyökumppanit voivat asettaa muita rajoituksia toimitettaville tuotteille.

Yandex.Taxin yhteistyökumppanit eivät tarjoa postipalveluja eivätkä vastaanota postia (lähetetty kirjeenvaihto, postipaketit, kontit, painetut julkaisut asiaankuuluvissa pakkauksissa) jakeluun.

Kuljettaja, joka toimii Yandex.Taxin yhteistyökumppanin edustajana, voi laatia kuljetusasiakirjan Käyttäjän kanssa tai hän voi tehdä sopimuksen olla tekemättä kuljetusasiakirjaa.

Käyttäjä on tietoinen ja vahvistaa, että jos hän ei täytä yllä olevia toimitettavia tavaroita koskevia vaatimuksia, Käyttäjä on yksin vastuussa kaikista kielteisistä vaikutuksista, joita voi ilmetä, kun Yandex.Taxin yhteistyökumppani tarjoaa toimituspalveluita. Samanaikaisesti Yandex.Taxin yhteistyökumppani voi kieltää toimituspalvelun Käyttäjälle, jos Yandex.Taxin yhteistyökumppani / Yandex.Taxin yhteistyökumppanin edustajat löytävät toimittamattomia tuotteita.

3. Kuljetuksen ja muiden palveluiden, mukaan lukien toimituspalveluiden etämaksaminen

3.1. Käyttäjä voi maksaa Palvelun kautta tehdyn tietopyyntönsä mukaisesti toteutetun taksikuljetuksen tai muiden palveluiden seuraavasti:

3.1.1. Suoraan taksiliikkeelle (mm. käteisellä tai muilla mahdollisilla taksiliikkeen hyväksymillä maksuvälineillä, jäljempänä Käteinen näissä Ehdoissa sekä Palvelun käyttöliittymässä). Ko. maksutapaa käytetään ilman, että Yandex.Taxi on mukana, eikä sitä säädellä näissä Ehdoissa. Mainittua maksutapaa voidaan rajoittaa toimituspalveluille.

3.1.2. Käyttäjän käytettävissä olevana maksuvälineenä voi olla etämaksaminen tallennetulla kortilla, jäljempänä kortimaksu, ks. k. 3.2 näistä Ehdoista, jolloin Yandex.Taxi toimii ko. taksiliikkeen toimeksiannosta tai muilla perustein, käyttäen maksuoperaattoria tai muuta sähköisen rahaliikenteen operaattoria, ja Yandex.Taxi on tällöin maksunsaaja taksilpalvelun välittäjänä tai muuna maksuliikenteen toimijana. Yandex.Taxi ei takaa sitä, että etämaksaminen -ominaisuuden toteuttamisessa Palvelun toiminta on häiriötöntä ja virheetöntä.

Käyttäjän oleskelualueesta riippuen etämaksaminen voi tapahtua ilman Yandex.Taxin osallistumista maksunsaajana tai käyttäen Yandex.Taxia muuna maksuliikenteen toimijana tai tiedonvaihtoon ja tietokantojen yhteiskäyttöön osallistujana.

Käyttäjä valitsee maksuvälineen Palvelun käyttöliittymässä. Kuitenkin jos mistä tahansa syystä etämaksaminen ei ole toteutettavissa, myös jos ko. toiminnon käyttö on tilapäisesti estynyt, tallennetulla kortilla maksaminen on tilapäisesti tai vakinaisesti pois käytöstä tai tallennetulla kortilla ei ole riiittävästi katetta, niin Käyttäjä on velvollinen maksamaan Käteisellä.

Etämaksun yhteydessä voidaan kuljetuksen tai muun palvelun hinta veloittaa joko kerrallaan tai useammassa palvelun osakohtaisessa erässä. Tällöin etämaksua voidaan hoitaa millä tahansa mainituista maksutavoista matkan/palvelun aikana tai matkan/palvelun päättyessä.

Etämaksua suorittaessa Käyttäjä voi kuljetusmaksun tai muun palvlumaksun päälle tehdä kortilla oman harkintansa mukaan myös lisämaksun taksiliikkeelle prosenttisuhteessa maksettavan kuljetuspalvelun tai muun palvelun hintaan, jäljempänä näissä Ehdoissa ja Palvelun käyttöliittymässä Juomaraha.

3.2. Käyttäjä syöttää Tallennetun maksukortin tiedot Palvelun käyttöliittymässä seuraavasti:

  • maksukortin numero
  • kortin voimassaoloaika
  • tarkistusnumero

Jos maksukortin tiedot ovat oikein, voimassa ja sen käyttö on Palvelun puitteissa teknisesti mahdollista, niin ko. kortista tulee Tallennettu kortti ja sitä voi käyttää etämaksamisessa, ks. kohta 3.1.2. Kaikki Takkennetut Kortit näkyvät Palvelun käyttöliittymässä, ja käytön helpottamiseksi näkyvissä on Tallennetun kortin numeron 4 viimeistä numeroa.

3.3. Lisätessä Tallennettua korttia ja myös valitessa etämaksamista tietyn matkan maksuvälineeksi, Käyttäjän kortilta vähennetään enintään 5 Venäjän ruplaa tai muu summa Käyttäjän oleskelualueen valuutassa, mikä tehdään Tallennetun kortin tietojen oikeiksi ja voimassaoleviksi todentamiseksi. Ko. tilitapahtuman onnistuttua ko. summa palautetaan Käyttäjälle. Ko. maksun hylkääntyminen tarkoittaa sitä, että ko. Tallennettua korttia ei voi lisätä ja/tai kortilla maksaminen -toiminto ei ole käytettävissä vastaavasti.

3.4. Tallennettua korttia lisättäessä ja myös millon tahansa kortin lisättyä Käyttäjällä on mahdollisuus Palvelun kautta määrätä ja/tai muuttaa Juomarahan oletussuuruus. Käyttäjä voi myös muuttaa Juomarahan määrän Palvelun käyttöliittymän kautta kullekin matkalle/palvelulle ko. Matkan/palvelun päätyttyä.

3.5. Juomaraha oletuksen mukaisessa määrässä tai Käyttäjän erikseen ko. Matkalle/palvelulle määräämässä määrässä veloitetaan Tallennetulta kortilta, jos 30 minuutin kuluessa matkan/palvelun päätyttyä Käyttäjä antoi sille myönteisen arvostelun eli 4 tai 5 tähteä, ja painoi Valmis -painikkeen Palvelun käyttöliittymässä, tai ei antanut myönteistä eikä kielteistä arvostelua eli ei syöttänyt tähtien lukumäärää ja painoi Valmis -painikkeen.

3.6. Jos 30 minuutin kuluessa matkan/palvelun päätyttyä Käyttäjä antoi sille kielteisen arvostelun eli 1 tai 3 tähteä, ja painoi Valmis -painikkeen Palvelun käyttöliittymässä, ei Juomarahaa veloiteta Tallennetulta kortilta.

3.7. Jos 30 minuutin kuluessa matkan/palvelun päätyttyä Käyttäjä ei ole painanut Valmis -painiketta, Juomarahan oletuksen mukaisessa määrässa tai Käyttäjän määräämänä erikseen ko. Matkalle/palvelulle varataan Tallennetulta kortilta 24 tunnin ajaksi, jonka kuluessa Käyttäjällä on mahdollisuus muuttaa Juomarahan määrää tälle matkalle/palvelulle isommaksi tai pienemäksi. Em. ajan kuluttua Juomaraha vähennetään kortilta Käyttäjän määräämän suuruisena eli oletuksen mukaisessa määrässä tai ko. Matkalle/palvelulle määrättynä.

3.8. Käyttäjän suoritettava etämaksu toteutetaan käyttäen maksuoperaattoria tai sähköisen rahaliikenteen operaattoria, ja maksamiseen sovelletaan kansainvälisten maksujärjestelmien, pankkien, mm. Tallennetun kortin myöntäneen pankin, ja muiden maksuliikenteen toimijoiden sääntöjä.

3.9. Omia tietojaan syöttäessä kohdan 3.2 mukaisesti ja Tallennettua korttia jatkossa käytettäessä Käyttäjä vakuuttaa ja vahvistaa sen, että maksukortista annetut tiedot ovat oikeat ja kattavat, kortti on voimassa ja myönnetty hänen nimellään, sekä sen, että hän noudattaa kansainvälisten maksujärjestelmien sääntöjä ja Tallennetun kortin myöntäneen pankin vaatimuksia, mukaan lukien kortilla maksamista koskevat vaatimukset.

3.10. Käyttäjä ymmärtää ja hyväksyy sen, että kaikkia Palvelun puitteissa Käyttäjän tunnistettua puhelinnumeroa käyttäen tehtyjä toimenpiteitä, mm. etämaksamista Tallennetulla kortilla, katsotaan Käyttäjän tekemiksi toimenpiteiksi.

3.11. Mikäli Käyttäjä ei hyväksy tapahtunutta etämaksua ja/tai sen suuruutta sekä myös Palvelussa tapahtuvasta Tallennetun kortin käytöstä aiheutuvissa muissa asioissa Käyttäjä voi ottaa yhteyttä Yandex.Taxiin Palvelussa maintulla puhelinnumerolla ja/tai tukipalvelun/yhteydenottopyynnön lomakkeen kautta 14 päivän kuluessa siitä, kun korttimaksu on suoritettu, tai siitä, kun muut yhteydenottopyynnön syynä olevat toimenpiteet tai tapahtumat ovat toteutuneet.

Jos ko. yhteydenoton syyt tarkastettua Yandex.Taxi tekee päätöksen etämaksun summan kokonaisesta tai osittaisesta palauttamisesta, ko. palautus tehdään sille pankkitilille, johon maksukortti on sidottu. Rahanpalautus tehdään käyttäen maksuoperaattoria tai sähköisen rahaliikenteen operaattoria, ja maksamiseen sovelletaan kansainvälisten maksujärjestelmien, pankkien, mm. Tallennetun kortin myöntäneen pankin, ja muiden maksuliikenteen toimijoiden sääntöjä. Tilanteissa, kun Yandex.Taxi ei ole Tallennettun korttiin liittyvän maksuliikenteen toimija, voi Yandex.Taxi toimia välittäjätahona, joka siirtää em. aiheiset Käyttäjien yhteydenottopyynnöt taksiliikkeille, taksikeskuksille tai muulle taholle, joka on maksunsaajana edellämainituissa Tallennetun kortin maksutapahtumissa.

3.12. Yandex.Taxi pidättää itselleen oikeuden vaatia Käyttäjää milloin tahansa osoittamaan oikeiksi Palvelun kautta esitettyjä tietoja, mm. Tallennetun kortin tietoja, ja pyytää tästä johtuen myös todentavia asiakirjoja, mm. henkilöllisyystodistuksia, joita esittämättä jättämistä voidaan Yandex.Taxin harkintansa mukaan rinnastaa epäluotettavan tiedon antamiseen, mikä saattaa johtaa näiden Ehtojen kohdassa 2.5 tarkoitettuihin seurauksiin.

3.13. Tässä osassa taksikuljetuspalvelun tai muiden palveluiden, mukaan lukien toimituspalveluiden, maksamisen ehdoista ja menettelyistä annettuja lausekkeita ei sovelleta, kun ko. maksun suorittaa Käyttäjän puolesta kolmas henkilö Yandex.Taxin ja tämän kolmannen henkilön välisen erillisen sopimuksen mukaisesti.

4. Markkinointietujen ja kampanjoiden ehdot ja rajoitukset

Terms of Use of Yango

(the English version prevails)

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of Yandex.Go S.R.L. (hereinafter referred to as Yandex.Go) to an Internet user (hereinafter referred to as the User) to use Yango service (hereinafter referred to as the Service).

1.2. The use of the Service by the User is governed by these Terms and documents of YANDEX LLC (16, Leo Tolstoy St., Moscow, 119021, Russia):

1.3. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms and provisions of Regulatory Documents, in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms and/or Regulatory Documents, the User may not use the Service.

1.4. Yandex.Go may, at any time without notice to the User, amend provisions hereof, and YANDEX LLC may, at any time without notice to the User, amend provisions of the Regulatory Documents. The current version hereof is available at: https://yandex.com/legal/yango_termsofuse. The User bears a risk of failure to review a new version of the Terms and Regulatory Documents. Any continued use of the Service after the Terms or Regulatory Documents have been changed will qualify as the acceptance of the new version.

1.5. The User shall stop using the Service, if he or she disagrees with any amendments to these Terms Yandex.Go made as prescribed by cl. 1.4 hereof.

1.6. The Service enables the User to place information, free of charge, on the User’s potential demand for passenger and baggage transportation services, look through offers of organizations providing services in the said field, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.

1.7. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to Yandex.Go.

1.8. For the avoidance of doubt, Yandex.Go does not provide passenger and baggage transportation services and help desk services.

1.9. All conversations the User holds with the support team and drivers of partners of the Service can be recorded to control quality and improve services.

1.10. By using the Service, the User consents to receive promotional messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use.

2.2. Information on passenger and baggage transportation services (hereinafter referred to as the Information) is provided by partners of the Service. The list of partners is available at https://yango.yandex.com/partners. For more information about the services offered (including Wi-Fi access point availability in the cabin, in-cabin photo / video surveillance by the Rightholder's partner, and other information), the User may contact the partners of the Service or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide their with information about the services offered.

2.3. Yandex.Go shall not be held liable for the content and/or relevance of information provided by the partners of the Service, including information on the cost and current availability of the partners’ benefits. The User shall independently (without the participation of Yandex.Go) discuss the acquisition of services with the partners in accordance with the partners’ rules on the provision of services. Yandex.Go shall not be held liable for financial and any other transactions effected by the User and the partners and for any consequences of the acquisition of the partners’ services by the User.

2.4. The User may access functions of rating the services of the Service partners and commenting / leaving feedback on the Service and/or services of the Service partners. Users ratings and feedback are posted on the Service website and can be available on third-party websites. Yandex.Go reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason.

2.5. Yandex.Go reserves the right, at own discretion, to limit user access to the Service (or to certain functions of the Service, if technologically feasible) using the User's account or block the User’s entire account upon multiple violations hereof, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

2.6. When demand for transportation services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service partners can be raised. Yandex.Go informs of higher tariffs by posting the relevant notice on the Service website https://yango.yandex.com or otherwise as Yandex.Go thinks fit, inter alia, by sending an information message to the User’s mobile phone number.

2.7. Passenger and baggage transportation services as per Economy, Comfort, Business, and other tariffs available in the Service are rendered by different types of vehicles. Vehicles are ranked automatically based on vehicle performance data provided by the partners of the Service.

2.8. A transportation provider charges fees for a trip cancelled by the User, if such cancellation took place after the vehicle's arrival to the place the User had appointed. The amount of such fees is calculated the same way as the cost of trip as per tariff for a period of time from when the vehicle actually arrived to the pick-up place or from the time of arrival specified in information the transportation provider submitted to the User regarding the transportation the User ordered (whichever comes later) until the User cancelled the trip. The User shall cancel a trip by sending a relevant notice to the transportation provider via the Service. A User that has not boarded a vehicle served by the transportation provider within ten (10) minutes taking into account no-charge waiting time specified in a respective tariff is deemed to have cancelled a trip, unless otherwise stipulated by the relevant transportation provider's rules or agreements between the User and a representative (driver) of the transportation provider. The cancellation fee for airport-to-city transfers is calculated as described above plus an additional fee charged for out-of-town ride as per tariff.

2.9. The User authorizes Yandex.Go to process personal information (including personal details) of the User of Yandex.Go, to transfer personal information of the User to Yandex.Go’s partners, and to process personal information for Yandex.Go’s partners to provide services to the User in the Service. When the User turns to the Service, their personal information is transmitted to YANDEX LLC to be processed under the terms and for the purposes determined in the Privacy Policy of YANDEX LLC available at: (https://yandex.com/legal/confidential).

3. Function of Cashless Payment for Passenger and Baggage Transportation Services

3.1. The User can pay for passenger and baggage transportation services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:

3.1.1. Directly to a transportation provider (inter alia, by cash or by any other means stipulated by the said transportation provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Yandex.Go being involved and shall not be governed by these Terms.

3.1.2. The User can access the function of cashless payment by a Linked Bank Card (cl. 3.2 hereof); in this case, Yandex.Go acts in the name of the relevant transportation provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the transportation provider or otherwise (including directly) (hereinafter referred to as cashless payments). Yandex.Go does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

Depending on the User's region, cashless payments can be made without Yandex.Go acting as a payment recipient or with Yandex.Go involved as another party to settlements or a party to information exchange.

The User shall choose the relevant form of payment in the Service interface. In this respect, if it is impossible to make cashless payments for any reason (including, but not limited to temporary technical inaccessibility of this function, temporary or constant impossibility to make cashless payments using the Linked Card, insufficient funds in the Linked Card), the User undertakes to pay by Cash.

For cashless payments, it is possible to effect both one transaction for the entire cost of passenger and baggage transportation and several transactions for certain parts of the cost of the service. Cashless payments can be effected by any of the above means during the trip or when the trip is over.

In case of cashless payments, the User can, along with payment for passenger and baggage transportation, make an additional cashless payment to the transportation provider as a percentage of the cost of the paid passenger and baggage transportation (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.

3.2. The User shall specify the Linked Bank Card in the Service interface indicating the following details:

  • Bank card number
  • Valid through
  • Verification code

If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.

3.3. When a Linked Card is added and when the User chooses the function of cashless payment for a certain trip, the amount limited to RUB 5 (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.4. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips via the Service interface; the User can change the amount of Tips for a certain trip in the Service interface, when the trip is over.

3.5. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip) will be charged from the Linked Card, if the User, within 30 minutes after the trip is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip (specifies no number of stars) and clicks "Done".

3.6. If within 30 minutes after the trip is over the User assigns a low rating to the trip (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.

3.7. If within 30 minutes after the trip is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip).

3.8. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.

3.9. When indicating their details pursuant to cl. 3.2 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.

3.10. The User understands and agrees that all actions performed in the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.

3.11. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact Yandex.Go by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

If, following the inspection caused by such a request, Yandex.Go decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If Yandex.Go is not a party to settlements made via the Linked Card, Yandex.Go can act as a body that transfers above user requests to transportation providers, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.

3.12. Yandex.Go reserves the right to require at any time that the User confirm the details they specified in the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated by cl. 2.5 hereof, if Yandex.Go thinks fit.

3.13. The provisions on the terms and procedure of payment for passenger and baggage transportation services specified in this Section shall not apply, when a third party pays for such transportation services instead of the User under a separate contract Yandex.Go signed with such third party.

4. Terms and restrictions of marketing benefits and campaigns

The terms and restrictions presented in connection with advertisements and campaigns of Yango are always applied to such advertisements and campaigns. Additionally, to each advertisement or campaign are applied the terms and restrictions concerning it, presented in address yango.yandex.com/legal/ro.

1. Dispoziții generale

1.1. Acești Termeni (denumiți în continuare Termeni) constituie o ofertă a Yandex.Go S.R.L. (denumită în continuare Yandex.Go) unui Utilizator de Internet (denumit în continuare Utilizator) pentru a utiliza serviciul Yango (denumit în continuare Serviciul).

1.2. Utilizarea Serviciului de către Utilizator este reglementată de acești Termeni și documente ale companiei YANDEX LLC (str. Lev Tolstoi 16, Moscova, 119021, Rusia):

1.3. Odată cu începerea utilizării Serviciului / anumitor funcții ale acestuia, se consideră că Utilizatorul a acceptat în totalitate acești Termeni și prevederile Documentelor de reglementare, fără rezerve și excepții. Dacă Utilizatorul nu este de acord cu oricare dintre prevederile Termenilor și/sau Documentelor de reglementare, Utilizatorul nu are dreptul de a folosi Serviciul.

1.4. Yandex.Go poate modifica în orice moment, fără să notifice Utilizatorul, prevederile prezentului document, iar YANDEX LLC poate modifica în orice moment, fără să notifice Utilizatorul, prevederile Documentelor de reglementare. Versiunea actuală a acestui document este disponibilă la adresa: https://yandex.com/legal/yango_termsofuse. Există riscul ca Utilizatorul să nu ia cunoștință de o nouă versiune a Termenilor și a Documentelor de reglementare. Orice continuare a utilizării Serviciului după modificarea Termenilor sau Documentelor de reglementare se va califica drept acceptarea noii versiuni.

1.5. Utilizatorul va înceta să utilizeze Serviciul, dacă nu este de acord cu oricare dintre modificările acestor Termeni Yandex.Go aduse în conformitate cu clauza 1.4 din prezentul document.

1.6. Serviciul îi permite Utilizatorului să plaseze în mod gratuit informații privind cererea potențială a Utilizatorului pentru servicii de transport de pasageri și bagaje, să caute oferte ale organizațiilor care furnizează servicii în domeniul menționat și să caute astfel de oferte utilizând parametrii stabiliți de Utilizator. Toate funcțiile Serviciului disponibile actualmente, împreună cu orice elaborări și/sau funcții nou adăugate fac obiectul acestor Termeni.

1.7. În funcție de regiunea Utilizatorului, oricare sau toate funcțiile Serviciului pot fi inaccesibile sau limitate. Funcțiile sunt considerate inaccesibile (limitate) Utilizatorului dintr-o anumită regiune în cazul în care un astfel de Utilizator nu le poate utiliza în mod explicit. Este interzisă aplicarea oricăror metode tehnice și bazate pe software pentru a eluda aceste limitări. Prevederile prezentului document care reglementează funcțiile Serviciului inaccesibile (limitate) Utilizatorului se vor aplica până când aceste funcții vor deveni accesibile Utilizatorului în mod explicit. Informațiile privind accesibilitatea funcțiilor Serviciului într-o anumită regiune vor fi furnizate Utilizatorului la cererea acestuia, transmisă către Yandex.Go.

1.8. Pentru a evita orice îndoială, Yandex.Go nu furnizează servicii de transport de pasageri și de bagaje sau servicii de asistență.

1.9. Toate conversațiile pe care le ține Utilizatorul cu echipa de asistență și șoferii partenerilor de servicii pot fi înregistrate pentru a controla calitatea și a îmbunătăți serviciile.

1.10. Prin utilizarea Serviciului Utilizatorul consimte să primească mesaje promoționale. Utilizatorul se poate dezabona de la mesajele promoționale utilizând funcțiile relevante ale Serviciului sau urmând instrucțiunile specificate într-un mesaj promoțional primit.

2. Utilizarea Serviciului. Anumite Funcții ale Serviciului

2.1. Serviciul este furnizat Utilizatorului pentru uz personal necomercial.

2.2. Informațiile privind serviciile de transport de pasageri și bagaje (denumite în continuare "Informații") sunt furnizate de partenerii Serviciului. Lista partenerilor este disponibilă la adresa https://yango.yandex.com/partners. Pentru mai multe informații despre serviciile oferite (inclusiv disponibilitatea unui punct de acces Wi-Fi în cabină, supravegherea foto / video în cabină de către partenerul Titularului de drepturi și alte informații), Utilizatorul poate contacta partenerii Serviciului sau poate furniza detaliile sale de contact folosind funcțiile Serviciului pentru ca partenerii Serviciului să-l poată contacta pe Utilizator din propria inițiativă pentru a-i furniza informații despre serviciile oferite.

2.3. Compania Yandex.Go nu va fi considerată responsabilă pentru conținutul și/sau relevanța informațiilor furnizate de partenerii Serviciului, inclusiv informații despre costul și disponibilitatea actuală a beneficiilor oferite de parteneri. Utilizatorul va discuta în mod independent (fără participarea Yandex.Go) achiziționarea serviciilor cu partenerii în conformitate cu normele partenerilor privind prestarea serviciilor. Compania Yandex.Go nu va fi considerată responsabilă pentru tranzacțiile financiare și pentru orice alte tranzacții efectuate de Utilizator și parteneri sau pentru orice consecințe ale achiziției de către Utilizator a serviciilor partenerilor.

2.4. Utilizatorul poate accesa funcțiile de evaluare a serviciilor furnizate de partenerii Serviciului și de comentare / lăsare a feedback-ului cu privire la Serviciu și/sau la serviciile partenerilor Serviciului. Evaluările Utilizatorilor și feedback-ul sunt publicate pe site-ul Serviciului și pot fi disponibile pe site-uri ale părților terțe. Yandex.Go își rezervă dreptul de a refuza publicarea oricăror evaluări / mesaje de feedback și de a șterge / bloca în orice moment orice evaluare / mesaj de feedback postat de Utilizator la discreția sa și fără a indica un motiv.

2.5. Yandex.Go își rezervă dreptul de a limita, la propria discreție, accesul Utilizatorului la Serviciu (sau la anumite funcții ale Serviciului, dacă este fezabil din punct de vedere tehnologic), de a limita utilizarea contului Utilizatorului sau de a bloca întregul cont al Utilizatorului în cazul mai multor încălcări ale prevederilor acestui document, precum și de a lua oricare alte măsuri împotriva Utilizatorului pentru a respecta cerințele legislative sau drepturile și interesele legitime ale părților terțe.

2.6. Atunci când cererea pentru servicii de transport este mai mare (inclusiv în zilele înainte de sărbători, în zilele evenimentelor în masă și în alte cazuri), tarifele partenerilor Serviciului pot crește. Yandex.Go informează despre creșterea tarifelor publicând un mesaj corespunzător pe site-ul Serviciului https://yango.yandex.com sau în alt mod considerat potrivit de către Yandex.Go, inclusiv prin trimiterea unui mesaj de informare la numărul de telefon mobil al Utilizatorului.

2.7. Serviciile de transport de pasageri și bagaje conform claselor tarifare "Econom", "Confort", "Business" și alte clase tarifare disponibile în cadrul Serviciului sunt oferite cu diferite tipuri de vehicule. Vehiculele sunt clasate în mod automat pe baza datelor privind performanța acestora, furnizate de partenerii Serviciului.

2.8. Un furnizor de servicii de transport percepe taxe pentru o călătorie anulată de Utilizator, în cazul în care o astfel de anulare a avut loc după sosirea vehiculului la locul desemnat de Utilizator. Mărimea unor astfel de taxe se calculează în același mod ca și costul cursei conform clasei tarifare pentru perioada de timp din momentul în care vehiculul a sosit efectiv la locul de preluare sau de la ora sosirii specificată în informațiile transmise Utilizatorului de către furnizorul serviciilor de transport privind transportul comandat de Utilizator (în funcție de evenimentul care are loc mai târziu) până în momentul anulării cursei de către Utilizator. Pentru a anula o cursă, Utilizatorul va trimitere o notificare corespunzătoare furnizorului de servicii de transport prin intermediul Serviciului. În cazul în care un Utilizator nu a urcat în vehiculul oferit de către furnizorul serviciilor de transport în decurs de zece (10) minute, cu luarea în calcul a timpului de așteptare gratuit, specificat pentru clasa tarifară respectivă, se consideră că Utilizatorul a anulat cursa, cu excepția cazurilor în care în normele furnizorului serviciilor de transport sau acorduri între Utilizator și un reprezentant (șofer) al furnizorului serviciilor de transport este prevăzut alfel. Taxa de anulare în cazul transferurilor de la aeroport în oraș se calculează conform descrierii de mai sus plus o taxă suplimentară percepută pentru deplasarea mașinii în afara orașului conform clasei tarifare.

2.9. Utilizatorul autorizează Yandex.Go să proceseze informațiile personale (inclusiv datele personale) ale Utilizatorului Yandex.Go, să transmită informațiile personale ale Utilizatorului partenerilor Yandex.Go și să prelucreze informațiile personale pentru ca partenerii Yandex.Go să poată oferi servicii Utilizatorul în cadrul Serviciului. Atunci când Utilizatorul folosește Serviciul, informațiile sale personale sunt transmise către YANDEX LLC pentru a fi procesate în condițiile și în scopurile stabilite în Politica de confidențialitate a YANDEX LLC, disponibilă la adresa: (https://yandex.com/legal/confidential).

3. Funcția de plată fără numerar pentru servicii de transport de pasageri și bagaje

3.1. Utilizatorul poate plăti pentru serviciile de transport de pasageri și bagaje, furnizate Utilizatorului, în conformitate cu informațiile privind cererea potențială pentru serviciul respectiv, plasată de Utilizator prin intermediul Serviciului:

3.1.1. Direct furnizorului serviciilor de transport (inclusiv în numerar sau prin orice altă metodă prevăzută de respectivul furnizor de servicii de transport, dacă este cazul, modalitate denumită în continuare în acești Termeni și interfața Serviciului "În numerar"). Plata menționată va fi efectuată fără implicarea Yandex.Go și nu va fi reglementată de acești Termeni.

3.1.2. Utilizatorul poate accesa funcția de plată fără numerar prin intermediul unui Card bancar asociat (clauza 3.2 de mai jos); în acest caz, Yandex.Go acționează în numele furnizorului serviciilor de transport corespunzător sau în alt mod (inclusiv direct) folosind un procesor de plată autorizat, un procesor de bani electronici sau colaborând cu orice altă parte pentru efectuarea operațiunilor implicate și primește plăți în calitate de agent al furnizorului serviciilor de transport sau în alt mod (inclusiv direct) (funcție denumită în continuare "Plăți fără numerar"). Yandex.Go nu garantează faptul că Serviciul va funcționa fără erori și fără defecțiuni în ceea ce privește efectuarea plăților fără numerar.

În funcție de regiunea Utilizatorului, plățile fără numerar pot fi efectuate fără ca Yandex.Go să acționeze în calitate de destinatar al plății sau fără implicarea Yandex.Go implicată ca o participant al operațiunilor sau al schimbului de informații.

Utilizatorul va alege forma de plată corespunzătoare în interfața Serviciului. În acest sens, în cazul în care efectuarea plăților fără numerar este imposibilă din orice motiv (inclusiv, dar fără a se limita la inaccesibilitatea tehnică temporară a acestei funcții, imposibilitatea temporară sau constantă de a efectua plăți fără numerar utilizând Cardul asociat, fonduri insuficiente pe Cardul asociat), Utilizatorul se obligă să plătească În numerar.

În cazul plăților fără numerar, este posibilă efectuarea atât a unei singure tranzacții pentru întregul cost al transportului de pasageri și bagaje, cât și a mai multor tranzacții pentru anumite părți din costul serviciului. Plățile fără numerar pot fi efectuate prin oricare dintre mijloacele de mai sus în timpul sau după finalizarea cursei.

În cazul plăților fără numerar Utilizatorul, dacă găsește de cuviință, poate efectua, împreună cu plata pentru transportul de pasageri și bagaje, o plată suplimentară fără numerar furnizorului serviciilor de transport ca procent din costul achitat al transportului respectiv de pasageri și bagaje (denumită în continuare în acești Termeni și interfața Serviciului "Bacșiș").

3.2. Utilizatorul va specifica Cardul bancar asociat în interfața Serviciului indicând următoarele date:

  • Numărul cardului bancar
  • Data expirării
  • Codul de verificare

Dacă datele cardului bancar sunt corecte, valabile și este posibil din punct de vedere tehnic să se utilizeze acest card în cadrul Serviciului, cardul bancar respectiv va deveni cel Asociat și va putea fi utilizat pentru plăți fără numerar (clauza 3.1.2 a prezentului document). Toate Cardurile asociate vor fi afișate în interfața Serviciului; pentru comoditatea Utilizatorului, în interfață se afișează ultimele 4 cifre ale numărului Cardului asociat.

3.3. În momentul adăugării unu Card asociat și selectării de către Utilizator a opțiunii de plată fără numerar pentru o anumită cursă, va fi debitată o sumă de până la 5 RUB (sau orice altă sumă în valuta regiunii Utilizatorului) pentru a confirma că datele Cardului asociat sunt corecte și valabile; dacă tranzacția este efectuată cu succes, suma respectivă va fi rambursată Utilizatorului. În cazul în care debitarea sumei menționate eșuează, adăugarea cardului respectiv în calitate de Card asociat este imposibilă și/sau opțiunea de plată fără numerar, respectiv, nu este disponibilă.

3.4. În momentul adăugării Cardului asociat și în orice moment ulterior, Utilizatorul poate seta și/sau modifica suma implicită a Bacșișului din interfața Serviciului; Utilizatorul poate schimba suma Bacșișului pentru o anumită cursă în interfața Serviciului, după finalizarea cursei.

3.5. Bacșișul (suma implicită sau suma indicată în mod specific de către Utilizator pentru o anumită cursă) va fi debitat de pe Cardul asociat atunci când Utilizatorul, în decurs de 30 de minute de la finalizarea cursei, îi va da un rating înalt cursei (4–5 stele) în interfața Serviciului și va face clic pe butonul "Gata" sau nu va da cursei nici un rating înalt, și nici unul scăzut (nu va indica un număr anumit de stele) și va apăsa pe butonul "Gata".

3.6. În cazul în care, în decurs de 30 de minute de la finalizarea cursei, Utilizatorul va da cursei un rating scăzut (1–3 stele) în interfața Serviciului și va apăsa pe butonul "Gata", de pe Cardul asociat nu va debitat niciun Bacșiș.

3.7. În cazul în care, în decurs de 30 de minute de la finalizarea cursei, Utilizatorul nu va apăsa pe butonul "Gata", suma Bacșișului (în mărime implicită sau cea specificată de Utilizator pentru cursa respectivă) va fi blocată pe Cardul asociat pentru 24 ore, perioadă în care Utilizatorul poate majora sau reduce suma Bacșișului pentru această cursă. După expirarea termenului menționat, Bacșișul va fi debitat în mărimea specificată de Utilizator (implicit sau specific pentru această cursă).

3.8. Plățile fără numerar ale Utilizatorului se vor efectua prin intermediul unui procesor de plată autorizat sau procesor de bani electronici implicat și vor fi reglementate de normele sistemelor internaționale de plată, ale băncilor (inclusiv ale băncii care a emis Cardul asociat) și ale altor părți participante la tranzacții.

3.9. Indicând datele sale în conformitate cu clauza 3.2 și utilizând în continuare Cardul asociat, Utilizatorul confirmă și garantează că a indicat informații corecte și complete cu privire la cardul bancar valabil, emis în numele său; și că respectă regulile sistemelor internaționale de plată și cerințele băncii care a emis Cardul asociat, inclusiv în ceea ce privește procedura de plată fără numerar.

3.10. Utilizatorul înțelege și este de acord că toate acțiunile efectuate în cadrul Serviciului cu utilizarea numărului de telefon mobil confirmat de Utilizator, inclusiv și plățile fără numerar cu utilizarea Cardului bancar asociat, sunt considerate a fi efectuate de către Utilizator.

3.11. Dacă Utilizatorul nu este de acord cu faptul și/sau suma plăților fără numerar sau are orice alte întrebări cu privire la modul de utilizare a Cardului asociat în cadrul Serviciului, acesta poate contacta Yandex.Go la numerele de telefon specificate de către Serviciu și/sau prin intermediul interfeței serviciului de asistență (forma de contact) în termen de 14 zile de la data efectuării plății respective fără numerar sau a oricăror alte acțiuni sau evenimente care au determinat solicitarea.

În cazul în care, în rezultatul inspecției cauzate de o astfel de solicitare, Yandex.Go decide să restituie integral sau parțial suma plății fără numerar, suma respectivă va fi rambursată în contul bancar al cardului bancar cu care a fost efectuată plata fără numerar. Rambursarea se va face prin intermediul unui procesor de plată autorizat sau procesor de bani electronici implicat și va fi reglementată de normele sistemelor de plăți internaționale, ale băncilor (inclusiv ale băncii care a emis Cardul asociat) și ale altor părți participante la tranzacții. În cazul în care Yandex.Go nu participă la tranzacțiile efectuate prin intermediul Cardului asociat, Yandex.Go poate acționa în calitate de organism care transmite solicitările Utilizatorilor descrise sus către furnizorii serviciilor de transport, dispecerate sau orice altă persoană care recepționează plățile în cadrul tranzacțiilor de mai sus efectuate cu Cardul asociat.

3.12. Yandex.Go își rezervă dreptul de a solicita în orice moment ca Utilizatorul să confirme datele indicate în cadrul Serviciului, inclusiv datele Cardului asociat și de a solicita documente justificative în acest sens (în special, documente de identitate); dacă Yandex.Go găsește acest lucru de cuviință, nefurnizarea acestor documente se poate califica drept furnizarea de informații nefiabile și poate avea implicațiile stipulate în clauza 2.5.

3.13. Dispozițiile privind condițiile și procedura de plată pentru serviciile de transport de pasageri și bagaje, specificate în această Secțiune, nu se aplică atunci când o parte terță plătește pentru astfel de servicii de transport în locul Utilizatorului, în baza unui contract separat semnat de Yandex.Go cu o astfel de parte terță.

4. Condiții și restricții privind beneficiile și campaniile de marketing

Condițiile și restricțiile prezentate în legătură cu reclamele și campaniile Yango sunt întotdeauna aplicabile unor astfel de reclame și campanii. Se aplică condiții și restricții suplimentare privind fiecare reclamă sau campanie, după cum pot fi disponibile pe pagina web: yango.yandex.com/legal/ro.

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of MLU Africa B.V. (hereinafter referred to as MLU Africa) to an Internet user (hereinafter referred to as the User) to use Yango service (hereinafter referred to as the Service).

1.2. The use of the Service by the User is governed by these Terms and documents of YANDEX LLC (16, Leo Tolstoy St., Moscow, 119021, Russia):

1.3. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms and provisions of Regulatory Documents, in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms and/or Regulatory Documents, the User may not use the Service.

1.4. MLU Africa may, at any time without notice to the User, amend provisions hereof, and YANDEX LLC may, at any time without notice to the User, amend provisions of the Regulatory Documents. The current version hereof is available at: https://yandex.com/legal/yango_termsofuse. The User bears a risk of failure to review a new version of the Terms and Regulatory Documents. Any continued use of the Service after the Terms or Regulatory Documents have been changed will qualify as the acceptance of the new version.

1.5. The User shall stop using the Service, if he or she disagrees with any amendments to these Terms MLU Africa made as prescribed by cl. 1.4 hereof.

1.6. The Service enables the User to place information, free of charge, on the User’s potential demand for passenger and baggage transportation services, look through offers of organizations providing services in the said field, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.

1.7. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to MLU Africa.

1.8. For the avoidance of doubt, MLU Africa does not provide passenger and baggage transportation services and help desk services.

1.9. All conversations the User holds with the support team and drivers of partners of the Service can be recorded to control quality and improve services.

1.10. By using the Service, the User consents to receive promotional messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use.

2.2. Information on passenger and baggage transportation services (hereinafter referred to as the Information) is provided by partners of the Service. The list of partners is available at https://yango.yandex.com/partners. For more information about the services offered (including Wi-Fi access point availability in the cabin, in-cabin photo / video surveillance by the Rightholder's partner, and other information), the User may contact the partners of the Service or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide their with information about the services offered.

2.3. MLU Africa shall not be held liable for the content and/or relevance of information provided by the partners of the Service, including information on the cost and current availability of the partners’ benefits. The User shall independently (without the participation of MLU Africa) discuss the acquisition of services with the partners in accordance with the partners’ rules on the provision of services. MLU Africa shall not be held liable for financial and any other transactions effected by the User and the partners and for any consequences of the acquisition of the partners’ services by the User.

2.4. The User may access functions of rating the services of the Service partners and commenting / leaving feedback on the Service and/or services of the Service partners. Users ratings and feedback are posted on the Service website and can be available on third-party websites. MLU Africa reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason.

2.5. MLU Africa reserves the right, at own discretion, to limit user access to the Service (or to certain functions of the Service, if technologically feasible) using the User's account or block the User’s entire account upon multiple violations hereof, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

2.6. When demand for transportation services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service partners can be raised. MLU Africa informs of higher tariffs by posting the relevant notice on the Service website https://yango.yandex.com or otherwise as MLU Africa thinks fit, inter alia, by sending an information message to the User’s mobile phone number.

2.7. Passenger and baggage transportation services as per Economy, Comfort, Business, and other tariffs available in the Service are rendered by different types of vehicles. Vehicles are ranked automatically based on vehicle performance data provided by the partners of the Service.

2.8. A transportation provider charges fees for a trip cancelled by the User, if such cancellation took place after the vehicle's arrival to the place the User had appointed. The amount of such fees is calculated the same way as the cost of trip as per tariff for a period of time from when the vehicle actually arrived to the pick-up place or from the time of arrival specified in information the transportation provider submitted to the User regarding the transportation the User ordered (whichever comes later) until the User cancelled the trip. The User shall cancel a trip by sending a relevant notice to the transportation provider via the Service. A User that has not boarded a vehicle served by the transportation provider within ten (10) minutes taking into account no-charge waiting time specified in a respective tariff is deemed to have cancelled a trip, unless otherwise stipulated by the relevant transportation provider's rules or agreements between the User and a representative (driver) of the transportation provider. The cancellation fee for airport-to-city transfers is calculated as described above plus an additional fee charged for out-of-town ride as per tariff.

2.9. The User authorizes MLU Africa to process personal information (including personal details) of the User of MLU Africa, to transfer personal information of the User to MLU Africa’s partners, and to process personal information for MLU Africa’s partners to provide services to the User in the Service. When the User turns to the Service, their personal information is transmitted to YANDEX LLC to be processed under the terms and for the purposes determined in the Privacy Policy of YANDEX LLC available at: (https://yandex.com/legal/confidential).

3. Function of Cashless Payment for Passenger and Baggage Transportation Services

3.1. The User can pay for passenger and baggage transportation services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:

3.1.1. Directly to a transportation provider (inter alia, by cash or by any other means stipulated by the said transportation provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without MLU Africa being involved and shall not be governed by these Terms.

3.1.2. The User can access the function of cashless payment by a Linked Bank Card (cl. 3.2 hereof); in this case, MLU Africa acts in the name of the relevant transportation provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the transportation provider or otherwise (including directly) (hereinafter referred to as cashless payments). MLU Africa does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

Depending on the User's region, cashless payments can be made without MLU Africa acting as a payment recipient or with MLU Africa involved as another party to settlements or a party to information exchange.

The User shall choose the relevant form of payment in the Service interface. In this respect, if it is impossible to make cashless payments for any reason (including, but not limited to temporary technical inaccessibility of this function, temporary or constant impossibility to make cashless payments using the Linked Card, insufficient funds in the Linked Card), the User undertakes to pay by Cash.

For cashless payments, it is possible to effect both one transaction for the entire cost of passenger and baggage transportation and several transactions for certain parts of the cost of the service. Cashless payments can be effected by any of the above means during the trip or when the trip is over.

In case of cashless payments, the User can, along with payment for passenger and baggage transportation, make an additional cashless payment to the transportation provider as a percentage of the cost of the paid passenger and baggage transportation (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.

3.2. The User shall specify the Linked Bank Card in the Service interface indicating the following details:

  • Bank card number
  • Valid through
  • Verification code

If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.

3.3. When a Linked Card is added and when the User chooses the function of cashless payment for a certain trip, the amount limited to RUB 5 (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.4. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips via the Service interface; the User can change the amount of Tips for a certain trip in the Service interface, when the trip is over.

3.5. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip) will be charged from the Linked Card, if the User, within 30 minutes after the trip is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip (specifies no number of stars) and clicks "Done".

3.6. If within 30 minutes after the trip is over the User assigns a low rating to the trip (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.

3.7. If within 30 minutes after the trip is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip).

3.8. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.

3.9. When indicating their details pursuant to cl. 3.2 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.

3.10. The User understands and agrees that all actions performed in the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.

3.11. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact MLU Africa by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

If, following the inspection caused by such a request, MLU Africa decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If MLU Africa is not a party to settlements made via the Linked Card, MLU Africa can act as a body that transfers above user requests to transportation providers, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.

3.12. MLU Africa reserves the right to require at any time that the User confirm the details they specified in the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated by cl. 2.5 hereof, if MLU Africa thinks fit.

3.13. The provisions on the terms and procedure of payment for passenger and baggage transportation services specified in this Section shall not apply, when a third party pays for such transportation services instead of the User under a separate contract MLU Africa signed with such third party.

4. Terms and restrictions of marketing benefits and campaigns

The terms and restrictions presented in connection with advertisements and campaigns of Yango are always applied to such advertisements and campaigns. Additionally, to each advertisement or campaign are applied the terms and restrictions concerning it, presented in address https://yango.yandex.com/legal/gh.

Terms of Use of Yango

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of Yandex.Go Israel Ltd. (hereinafter referred to as Yandex.Go) to an Internet user (hereinafter referred to as the User) to use Yango service (hereinafter referred to as the Service).

1.2. The use of the Service by the User is also governed by these Terms and documents of YANDEX LLC (16, Leo Tolstoy St., Moscow, 119021, Russia):

1.3. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms and provisions of regulatory documents, in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms and/or regulatory documents, the User may not use the Service.

1.4. Yandex.Go may, at any time, assign and (or) amend provisions hereof, and YANDEX LLC may, at any time without notice to the User, amend provisions of the regulatory documents. The current version hereof is available at: https://yandex.com/legal/yango_termsofuse. Yandex.Go will make best efforts to notify the User of any material change to the Terms however it shall not be obligated to notify the User of any immaterial changes to the Terms. The User bears a risk of failure to review a new version of the Terms and regulatory documents. Any continued use of the Service after the Terms or regulatory documents have been changed will qualify as the acceptance of the new version.

1.5. The User shall stop using the Service, if he or she disagrees with any amendments to these Terms Yandex.Go made as prescribed by cl. 1.4 hereof.

1.6. Any use of the Service by a minor (under 18) requires the consent of the minor’s parent or legal guardian. If such consent is not received, the minor may not use the Service.

1.7. The Service enables the User to place information, free of charge, on the User’s potential demand for passenger and baggage transportation services, look through offers of organizations providing services in the said field, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.

1.8. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to Yandex.Go.

1.9. For the avoidance of doubt, Yandex.Go does not provide passenger and baggage transportation services and help desk services and shall not be responsible for the actions or omission of the Service Partners (as defined below).

1.10. By using the Service, the User consents to receive promotional messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use.

2.2. Information on passenger and baggage transportation services (hereinafter referred to as the “Information”) is provided by partners of the Service (referred to herein as “Service Partners”). The contact details of a Service Partner are available on request. For more information about the services offered (including Wi-Fi access point availability in the cabin, in-cabin photo / video surveillance by the Rightholder's partner, and other information), the User may contact the Service Partners or provide their contact details through the functions of the Service for the Service Partners to independently contact the User and provide information about the services offered.

2.3. Yandex.Go shall not be held liable for the content and/or relevance of information provided by the Service Partners, including information on the cost and current availability of the partners’ benefits. The User shall independently (without the participation of Yandex.Go) discuss the acquisition of services with the partners in accordance with the partners’ rules on the provision of services. Yandex.Go shall not be held liable for financial and any other transactions effected by the User and the partners and for any consequences of the acquisition of the partners’ services by the User.

2.4. The User may access functions of rating the services of the Service Partners and commenting / leaving feedback on the Service and/or services of the Service Partners. Users ratings and feedback are posted on the Service website and can be available on third-party websites. Yandex.Go reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason.

2.5. Yandex.Go reserves the right, at own discretion, to limit User access to the Service (or to certain functions of the Service, if technologically feasible) using the User's account and(or) block the User’s entire account and take any other measures upon violations of these Terms, legislative requirements, Yandex.Go or third-party rights and legitimate interests, concerns for public safety, or in case of legal obligations of Yandex.Go.

2.6. When demand for taxi services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service Partners can be raised. Yandex.Go informs of higher tariffs by posting the relevant notice on the Service website https://yango.yandex.com or otherwise as Yandex.Go thinks fit, inter alia, by sending an information message to the User’s mobile phone number.

2.7. The Service Partners may charge the maximal rates and tariffs as established by Israeli Law at a relevant time.

2.8. Notwithstanding the previous section or anything to the contrary, if the Service Partners, or certain Service Partners, enter into an agreement with the User, they may, subject to the terms of such agreement, charge different prices for passenger and baggage transportation services performed under such agreement.

2.9. These Terms will govern also your use of the Service with respect to the passenger and baggage transportation services performed under any other agreement that may be entered into by you and the Service Partners, certain Service Partners or Yandex.Go, concerning the Service, unless otherwise specifically provided for in a relevant agreement.

2.10. Passenger and baggage transportation services as per Economy, Comfort, Business, and other available classes in the Service are rendered by different types of vehicles. Vehicles are ranked automatically based on vehicle performance data provided by the Service Partners.

2.11. The User may cancel a trip by sending a relevant notice to the Service Partner via the Service. A Service Partner may (but is not obliged to) cancel a trip if the User has not boarded the taxi served by the Service Partner within ten (10) minutes or more from the time the Service Partner sent a ‘waiting’ signal via the Service. In case of cancellation the User will be charged a transfer fee as calculated by the Service including a charge for any waiting time (which is calculated from the time a ‘waiting’ signal has been sent via the Service by a Service Partner).

2.12. The User authorizes Yandex.Go, subject to the terms of the Privacy Policy of YANDEX LLC (available as described below), to process personal information (including personal details) of the User of Yandex.Go, to transfer personal information of the User to Yandex.Go’s partners, and to process personal information for Yandex.Go’s partners to provide services to the User in the Service. When the User turns to the Service, their personal information is transmitted to YANDEX LLC to be processed under the terms and for the purposes determined in the Privacy Policy of YANDEX LLC available at: (https://yandex.com/legal/confidential).

3. Function of Cashless Payment for Passenger and Baggage Transportation Services

3.1. The User can pay for passenger and baggage transportation services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:

3.1.1. Directly to a Service Partner (inter alia, by cash or by any other means stipulated by the said Service Partner, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Yandex.Go being involved and shall not be governed by these Terms.

3.1.2. The User can access the function of cashless payment by a Linked Bank Card (cl. 3.2 hereof); in this case, Yandex.Go acts in the name of the relevant Service Partner or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the Service Partner or otherwise (including directly) (hereinafter referred to as cashless payments). Yandex.Go does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

Depending on the User's region, cashless payments can be made without Yandex.Go acting as a payment recipient or with Yandex.Go involved as another party to settlements or a party to information exchange.

The User shall choose the relevant form of payment in the Service interface. In this respect, if it is impossible to make cashless payments for any reason (including, but not limited to temporary technical inaccessibility of this function, temporary or constant impossibility to make cashless payments using the Linked Card, insufficient funds in the Linked Card), the User undertakes to pay by Cash.

For cashless payments, it is possible to effect both one transaction for the entire cost of passenger and baggage transportation and several transactions for certain parts of the cost of the transportation services. Cashless payments can be effected by any of the above means during the trip or when the trip is over.

In case of cashless payments, the User can, along with payment for passenger and baggage transportation, make an additional cashless payment to the Service Partner as a percentage of the cost of the paid passenger and baggage transportation (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.

3.2. The User shall specify the Linked Bank Card in the Service interface indicating the following details:

If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.

3.3. When a Linked Card is added and when the User chooses the function of cashless payment for a certain trip, the amount limited to NIS 5 will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.4. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips via the Service interface; the User can change the amount of Tips for a certain trip in the Service interface, when the trip is over but before the Tips are charged.

3.5. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip) will be charged from the Linked Card, if the User, within 30 minutes after the trip is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip (specifies no number of stars) and clicks "Done".

3.6. If within 30 minutes after the trip is over the User assigns a low rating to the trip (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.

3.7. If within 30 minutes after the trip is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip) will be blocked in the Linked Card for 24 hours during which the User can increase or reduce the amount of Tips for this trip. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip).

3.8. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.

3.9. 3.14. Unless otherwise specifically provided for in a relevant agreement or on the Service, the displayed amounts (as the full and discounted price) on the Service are non-binding estimates, and the actual price for the passenger and baggage transportation services may be higher or lower than the estimate. Unless otherwise specifically provided for in a relevant agreement or on the Service, the actual price will be determined pursuant to law, either by the car-integrated taximeter or as the fixed price (for inter-city rides, if you chose the fixed price) and subject to any discount, if applicable.

3.15. The provisions on the terms and procedure of payment for passenger and baggage transportation services specified in this section shall not apply, when a third party pays for such transportation services instead of the User under a separate contract Yandex.Go signed with such third party.

4. Interpretation

4.1. Wherever used herein, a pronoun in the masculine gender shall be considered as including the feminine gender unless the context clearly indicates otherwise.

4.2. This is a translation of the Terms from Hebrew into English. However, in the event of a conflict between the Terms in Hebrew and its translation, only the Hebrew version of the Terms shall be legally binding.

LLC YANDEX רשאית, בכל עת ללא הודעה למשתמש, לשנות את הוראות המסמכים הרגולטוריים. הגרסה הנוכחית של תנאים אלו זמינה בכתובת: https://yandex.com/legal/yango_termsofuse. יאנדקס.גו תנקוט את מירב המאמצים להודיע למשתמש על כל שינוי מהותי בתנאים, אולם לא תהיה חייבת להודיע למשתמש על כל שינוי שאינו מהותי בתנאים. המשתמש יישא בסיכון הנובע מאי קריאה של הגרסה המתוקנת של התנאים ושל המסמכים הרגולטוריים; המשך השימוש בשירות לאחר מועד תיקון התנאים ו/או המסמכים הרגולטוריים יהוו את הסכמתו של המשתמש לתנאי הגרסה המתוקנת.

1.5. המשתמש יפסיק להשתמש בשירות, בכל מקרה שבו אינו מסכים עם איזה מהתיקונים לתנאים שנעשו על ידי יאנדקס.גו באופן שנקבע בסעיף 1.4. לעיל.

1.6. כל שימוש על ידי משתמש קטין (מי שטרם מלאו לו 18 שנים), מחייב הסכמתו של הורה או אפוטרופוס על-פי חוק. ככל שהסכמה כאמור לא התקבלה, הקטין אינו רשאי להשתמש בשירות.

1.7. השירות מאפשר למשתמש למסור מידע, ללא תשלום, בנוגע לדרישה פוטנציאלית של המשתמש לשירותי הסעת נוסעים וכבודה, לעיין בהצעות של הארגונים שמספקים שירותים בתחומים האמורים ולחפש הצעות כאמור תוך שימוש בפרמטרים שנקבעו על ידי המשתמש. כל הפונקציות של השירות אשר זמינות כיום, יחד עם כל פיתוחים ו/או פונקציות שיתווספו בעתיד כפופות לתנאים אלו.

1.8. בהתאם לאזור מיקומו של המשתמש, פונקציות מסוימות או כל הפונקציות של השירות עלולות להיות בלתי נגישות או מוגבלות. פונקציות נחשבות כבלתי נגישות (מוגבלות) עבור משתמש מאזור מסוים, אם המשתמש אינו יכול להשתמש בהן במפורש. חל איסור על שימוש באמצעים טכנולוגיים או מבוססי תוכנה בכדי לעקוף הגבלות אלו. הוראות תנאים אלו המסדירות פונקציות בלתי נגישות (מוגבלות) עבור המשתמש יחולו עד שפונקציות אלו תיהפכנה נגישות למשתמש באופן מפורש. מידע על נגישות פונקציות השירות באזור מסוים יימסר למשתמש על פי בקשתו שתשלח ליאנדקס.גו.

1.9. למען הסר ספק, יאנדקס.גו אינה מספקת שירותים של הסעת נוסעים וכבודה ושירותי מרכז תמיכה, ולא תישא בכל אחריות למעשים ו/או למחדלים של שותפי השירות (כמוגדר להלן).

1.10. בשימוש בשירות, המשתמש מסכים לקבל הודעות פרסום. המשתמש רשאי להסיר את הסכמתו לקבלת הודעות פרסום באמצעות הפונקציות הרלוונטית של השירות או בהתאם להוראות המפורטות בהודעת הפרסום שהתקבלה.

2. שימוש בשירות. פונקציות מסוימות של השירות

2.1. השירות מסופק למשתמש לשימוש אישי שאינו מסחרי.

2.2. מידע על שירותי הסעת נוסעים וכבודה (להלן: "המידע"), מסופק על ידי שותפי השירות (להלן: "שותפי השירות"). פרטי הקשר של שותפי השירות זמינים לפי בקשתו של המשתמש. לקבלת מידע נוסף לגבי השירות (לרבות, זמינות הגישה ל- Wi-Fi במונית, ביצוע צילום / הקלטת וידאו בתוך המונית על ידי השותפים של בעל הזכות ומידע אחר), המשתמש רשאי לפנות לשותפי השירות או להשאיר את פרטי הקשר שלו באמצעות הפונקציות של השירות כדי ששותף השירות יצור קשר באופן עצמאי עם המשתמש וימסור מידע בנוגע לשירותים המוצעים.

2.3. יאנדקס.גו לא תישא באחריות לתוכן ו/או לרלוונטיות של המידע המסופק על ידי שותפי השירות, לרבות מידע על עלות שירותי שותפי השירות ועל זמינותם הנוכחית. המשתמש באופן עצמאי (ללא השתתפות יאנדקס.גו) ינהל שיחה בנוגע לרכישת שירותים עם שותפי השירות, בהתאם לכללי שותפי השירות למתן השירותים. יאנדקס.גו לא תישא באחריות לעסקאות פיננסיות ואחרות שבוצעו על ידי המשתמש ושותפי השירות ולהשלכות כלשהן של רכישת שירותי שותפי השירות על ידי המשתמש.

2.4. המשתמש יכול לגשת לפונקציות של דירוג השירותים שניתנו על-ידי שותפי השירות ולהגיב ו/או להשאיר משוב על השירות ו/או השירותים של שותפי השירות. דירוגי ומשובי המשתמשים מפורסמים באתר השירות ויכולים להיות זמינים באתרי של צדדים שלישיים. יאנדקס.גו שומרת על זכותה לסרב לפרסם כל דירוג ו/או משוב ולהסיר ו/או לחסום כל דירוג ו/או משוב שפורסם על ידי המשתמש, בכל עת, על פי שיקול דעתה הבלעדי וללא מתן סיבה לכך.

2.5. יאנדקס.גו שומרת על זכותה, על פי שיקול דעתה הבלעדי, להגביל גישת משתמש לשירות (או לפונקציות מסוימות של השירות, אם הדבר אפשרי מבחינה טכנולוגית), באמצעות שימוש בחשבון המשתמש או לחסום לחלוטין את חשבון המשתמש או לנקוט בכל אמצעי אחר בגין הפרות של התנאים, הוראות הדין, זכויות ואינטרסים של צדדים שלישיים ו/או יאנדקס.גו, חששות לביטחון הציבור או במקרה של ההתחייבויות המשפטיות של יאנדקס.גו.

2.6. כאשר הביקוש לשירותי מוניות גבוה יותר (לרבות ימים לפני חגים, ימי אירועים המוניים ומקרים אחרים), תעריפי שותפי השירות יכולים לעלות. יאנדקס.גו תודיע על העלאת התעריפים כאמור באמצעות פרסום הודעה רלוונטית באתר השירות http://yango.yandex.com או בדרך אחרת כפי שיאנדקס.גו תמצא לנכון, בין היתר, באמצעות שליחת הודעה למספר הטלפון הנייד של המשתמש.

2.7. שותפי השירות רשאים לגבות את התעריפים המקסימליים הקבועים על-פי הדין הישראלי במועד הרלוונטי.

2.8. מבלי לגרוע מהוראות הסעיף הקודם או כל הוראה נוגדת, אם שותפי השירות, כולם או חלקם, יכנסו להסכם עם המשתמש, הם רשאים, בכפוף לתנאי ההסכם, לגבות מחירים שונים עבור שירותי הסעה של נוסעים וכבודה שיבוצעו בהתאם להסכם כאמור.

2.9. תנאים אלו יחולו גם על השימוש שלך בשירות בנוגע לשירותי הסעת נוסעים וכבודה שיבוצעו בהתאם לכל הסכם אחר שיכול להיכרת בינך לבין שותפי השירות, כולם או חלקם, או יאנדקס.גו הנוגע לשירות, אלא אם נקבע אחרת במפורש בהסכם האמור.

2.10. שירותי הסעת נוסעים וכבודה מסוג Economy, Comfort, Business וכל רמת שירות אחרת שתהיה זמינה, ניתנים על ידי סוגי כלי רכב שונים. כלי הרכב מדורגים באופן אוטומטי על סמך נתוני ביצועי הרכב המסופקים על ידי שותפי השירות.

2.11. המשתמש רשאי לבטל נסיעה באמצעות שליחת הודעה רלוונטית לשותף השירות באמצעות השירות. שותף שירות רשאי (אבל לא חייב) לבטל נסיעה אם המשתמש לא עלה על המונית שסופקה על ידי שותף השירות בתוך 10 (עשר) דקות או יותר מהזמן ששותף השירות שלח הודעת 'המתנה' באמצעות השירות. במקרה של ביטול, ייגבה מהמשתמש תשלום נסיעה כפי שיחושב על ידי השירות, לרבות תעריף המתנה (אשר יחושב החל מהזמן שנשלחה הודעת 'המתנה' באמצעות השירות על-ידי שותף השירות).

2.12. המשתמש מסמיך את יאנדקס.גו, בכפוף לתנאי מדיניות הפרטיות של Yandex LLC (הזמינה בקישור להלן), לעבד מידע אישי (לרבות פרטים אישיים) של המשתמש, להעביר מידע אישי של המשתמש לשותפים של יאנדקס.גו, ולעבד מידע האישי בכדי ששותפים של יאנדקס.גו יספקו שירותים למשתמש במסגרת השירות. כאשר המשתמש משתמש בשירות, המידע האישי שלו מועבר ל-YANDEX LLC כדי שיעובד בהתאם לתנאים ולמטרות שנקבעו במדיניות הפרטיות של YANDEX LLC הזמינים בכתובת: (https://yandex.com/legal/confidential).

3. תשלום ללא מזומן עבור שירותי הסעת נוסעים וכבודה

3.1. המשתמש יכול לשלם עבור שירותי הסעת נוסעים וכבודה הניתנים למשתמש בהתאם למידע על דרישה פוטנציאלית לשירות הרלוונטי שהזין המשתמש באמצעות השירות:

3.1.1. ישירות לשותף השירות (בין היתר, במזומן או בכל דרך אחרת שנקבעה על ידי שותף השירות האמור, אם בכלל, שיקראו בתנאי שימוש אלה ובשירות: "מזומן"). התשלום האמור יתבצע מבלי שיאנדקס.גו תהיה מעורבת בכך ומבלי שתנאים אלה יחולו עליו.

3.1.2. המשתמש יכול לקבל גישה לממשק התשלום שלא במזומן באמצעות כרטיס בנק מקושר (כמפורט בסעיף 3.2 להלן); במקרה זה יאנדקס.גו פועלת בשם שותף השירות הרלוונטי או אחרת (לרבות באופן ישיר) באמצעות מעבד תשלום מורשה, מעבד כספים אלקטרוני או כל גוף אחר המעורב בהסדרת התשלום, ומקבלת את התשלומים כסוכן של שותף השירות או אחרת (לרבות באופן ישיר) (להלן: "תשלום שלא במזומן"). יאנדקס.גו אינה מתחייבת שפעולת השירות תתבצע ללא שגיאות או כשלים באשר לאפשרות תשלום שלא במזומן.

בהתאם לאזור של המשתמש, תשלום שלא במזומן יכול להתבצע מבלי שיאנדקס.גו תפעל כמקבלת התשלום או עם יאנדקס.גו מעורבת כצד אחר להסדרת התשלום או כצד להחלפת מידע.

המשתמש יבחר את אמצעי התשלום הרלוונטי בממשק השירות. בהקשר זה, במידה ולא ניתן יהיה לבצע תשלומים שלא במזומן מכל סיבה שהיא (לרבות אך ללא הגבלה, מגבלה טכנית זמנית של פונקציה זו, מגבלה טכנית זמנית או קבועה לביצוע תשלומים שלא במזומן באמצעות הכרטיס המקושר, מחסור באשראי בכרטיס המקושר), המשתמש מתחייב לשלם במזומן.

בעבור תשלומים שלא במזומן, ניתן לבצע הן עסקה אחת עבור סך עלות הסעת הנוסעים והכבודה והן מספר עסקאות עבור חלקים מסוימים של עלות שירותי ההסעה. תשלומים שלא במזומן יכולים להיות מבוצעים בכל אחד מהאמצעים הנזכרים לעיל במהלך הנסיעה ולאחר תום הנסיעה.

במקרה של תשלום שלא במזומן, הלקוח רשאי, בנוסף לתשלום בגין הסעת נוסעים וכבודה, לבצע תשלום נוסף שלא במזומן לשותף השירות כאחוז מעלות השירות ששולם עבור הסעת הנוסעים והכבודה (להלן בתנאים אלה ובממשק השירות: "טיפ") לפי שיקול דעתו האישי.

3.2. המשתמש יציין את כרטיס הבנק המקושר בממשק השירות תוך ציון הפרטים הבאים:

3.2.3. קוד אבטחה

אם פרטי כרטיס הבנק נכונים, תקפים וניתן מבחינה טכנית להשתמש בכרטיס זה במסגרת השירות, כרטיס הבנק האמור יהפוך להיות הכרטיס המקושר וניתן יהיה להשתמש בו לביצוע תשלומים שלא במזומן (סעיף 3.1.2. לעיל). כל הכרטיסים המקושרים מוצגים בממשק השירות; לנוחות המשתמש, הממשק מציג את 4 הספרות האחרונות של מספר הכרטיס המקושר.

3.3. כאשר כרטיס מקושר מתווסף וכאשר המשתמש בוחר בפונקציית התשלום שלא במזומן לנסיעה מסוימת, סכום המוגבל ל-5 (חמישה) ₪ ייגבה בכדי לאשר שפרטי הכרטיס המקושר נכונים ותקפים; אם העסקה תושלם בהצלחה, הסכום האמור יוחזר למשתמש. כישלון בגביית הסכום האמור משמעו כי אין אפשרות להוסיף את הכרטיס המקושר ו/או כי הפונקציה של תשלום שלא במזומן אינה זמינה, בהתאמה.

3.4. בעת הוספת הכרטיס המקושר ובכל מועד לאחר שהוסף, המשתמש יכול להגדיר ו/או לשנות את ברירת המחדל של הטיפ באמצעות ממשק השירות; המשתמש יכול לשנות את סכום הטיפ לנסיעה מסוימת בממשק השירות, כאשר הנסיעה הסתיימה אך לפני גביית הטיפ.

3.5. טיפ (בסכום ברירת המחדל או בסכום שצוין במפורש על ידי המשתמש עבור נסיעה מסוימת), יחויב מהכרטיס המקושר, אם המשתמש, תוך 30 דקות מסיום הנסיעה, ידרג בדירוג גבוה את הנסיעה (4 - 5 כוכבים) בממשק השירות וילחץ על "בוצע", או ידרג את הנסיעה בדירוג שאינו גבוה ואינו נמוך (ללא ציון של מספר כוכבים) וילחץ על "בוצע".

3.6. אם תוך 30 דקות לאחר סיום הנסיעה המשתמש ידרג את הנסיעה בדירוג נמוך (1-3 כוכבים) בממשק השירות וילחץ על "בוצע", הטיפ לא יחויב מהכרטיס המקושר.

3.7. אם תוך 30 דקות לאחר סיום הנסיעה המשתמש לא לחץ על "בוצע", סכום הטיפ (בסכום ברירת המחדל או בסכום שצוין במפורש על ידי המשתמש לנסיעה מסוימת), יחסם בכרטיס המקושר למשך 24 שעות, שבמהלכן המשתמש יכול להגדיל או להקטין את סכום הטיפ עבור נסיעה זו. כאשר הזמן האמור יפוג, הטיפ יחויב בסכום שצוין על ידי המשתמש (כברירת מחדל או במיוחד עבור נסיעה זו).

3.8. תשלומים של המשתמש שלא במזומן יתבצעו באמצעות מעבד תשלומים מורשה או מעבד כספים אלקטרוני שיהיה מעורב ויהיו כפופים לכללים של מערכות תשלומים בין לאומיות, בנקים (לרבות הבנק שהנפיק את הכרטיס המקושר) וגורמים אחרים המעורבים בהסדרת התשלום.

3.9. בציון פרטי הכרטיס המקושר בהתאם לסעיף 3.2 לעיל ובשימוש בכרטיס המקושר, המשתמש מאשר ומתחייב, כי הפרטים מהווים מידע אמין ומלא על כרטיס בנק תקף שהונפק על שמו; הם עומדים בכללי מערכות תשלום בינלאומיות ודרישות הבנק שהנפיק את הכרטיס המקושר, בין היתר, ביחס להליך התשלום שלא במזומן.

3.10. המשתמש מבין ומסכים שכל הפעולות שבוצעו במסגרת השירות באמצעות מספר הטלפון הנייד שאושר על ידי המשתמש, בין היתר, תשלומים שלא במזומן באמצעות כרטיס הבנק המקושר, ייחשבו כאילו בוצעו על ידי המשתמש.

3.11. אם המשתמש אינו מסכים עם העובדה ו/או סכום התשלום שלא במזומן ויש לו שאלות אחרות בנוגע לאופן השימוש בכרטיס המקושר במסגרת השירות, הוא רשאי ליצור קשר עם יאנדקס.גו באמצעות מספרי הטלפון שצוינו בשירות ו/או באמצעות ממשק מרכז התמיכה (משוב) בתוך 14 יום מתאריך התשלום שלא במזומן או כל פעולה או אירוע אחרים שהיוו מניע לבקשה.

3.12. אם בעקבות בדיקה שתתבצע בשל בקשה כאמור, יאנדקס.גו תחליט להחזיר את סכום התשלום שלא מזומן, במלואו או בחלקו, הסכום האמור יוחזר לחשבון הבנק של כרטיס הבנק שבאמצעותו בוצע התשלום שלא במזומן. ההחזר יבוצע באמצעות מעבד תשלומים מורשה או מעבד כספים אלקטרוני שיהיה מעורב, ויהיה כפוף לכללים של מערכות תשלום בינלאומיות, בנקים (לרבות הבנק שהנפיק את הכרטיס המקושר) וצדדים אחרים להסדרת התשלום. אם יאנדקס.גו אינה צד להסדרת התשלום שבוצע באמצעות הכרטיס המקושר, יאנדקס.גו יכולה לפעול כגוף שמעביר את בקשותיהם של המשתמשים לשותפי השירות, למשרד משלח או לכל אדם אחר שיקבל את התשלומים בעסקאות הנ"ל עם הכרטיס המקושר.

3.13. יאנדקס.גו שומרת על זכותה לדרוש, בכל עת, שהמשתמש יאשר את הפרטים שפרט בשירות, לרבות פרטי הכרטיס המקושר, ולבקש מסמכים תומכים בעניין זה (בפרט מסמכי זהות); אי מתן מסמכים אלו יכול להיחשב כמתן מידע לא מהימן ויהיו לכך השלכות כאמור בסעיף 2.5 לעיל, אם יאנדקס.גו תמצא זאת לנכון.

3.14. ככל שלא נקבע אחרת במפורש במסגרת הסכם רלוונטי או בשירות, הסכומים המוצגים בשירות (כמחיר המלא ומחיר בהנחה) הינו סכום מוערך ואינו מחייב, והמחיר הסופי עבור שירות הסעת הנוסעים והכבודה יכול להיות גבוה או נמוך מההערכה. ככל שלא נקבע אחרת במפורש במסגרת הסכם רלוונטי או בשירות, הסכום הסופי יקבע בהתאם לחוק, באמצעות המונה או כמחיר קבוע (לנסיעות בין-עירוניות, אם המשתמש יבחר במחיר הקבוע) ובכפוף לכל הנחה, ככל שתחול.

3.15. ההוראות בנוגע לתנאי ותהליך התשלום עבור שירות הסעת נוסעים וכבודה המפורטים בסעיף זה לא יחולו כאשר צד שלישי משלם עבור שירותי הסעה אלו במקום המשתמש במסגרת הסכם נפרד בין יאנדקס.גו לבין אותו צד שלישי.

4. פרשנות

4.1. בכל מקום בתנאים אלה בו נעשה שימוש בלשון זכר, הכוונה היא לכלול את לשון הנקבה, זולת אם תוכן הדברים במפורש מראה כוונה אחרת.

4.2. תנאים אלה תורגמו מעברית לאנגלית. בכל מקרה של סתירה בין נוסח תנאים אלו בעברית לבין נוסח תנאים אלה בשפה האנגלית, רק נוסח התנאים בעברית יהיה מחייב מבחינה משפטית.
