License Agreement for Yango for Mobile Devices

Before using the program, please read terms and conditions of the below license agreement.

Any use of the program means that you fully and unconditionally accept the terms and conditions of this license agreement.

If you do not accept the license agreement in full, you may not use the program for any purpose.

 

1. General Provisions

1.1. This License Agreement (hereinafter referred to as the License) set the terms of use of Yango for mobile devices (hereinafter referred to as the Program) and is signed with any person using the Program, with the exception of persons in the territory of the Russian Federation or the Republic of Belarus (hereinafter referred to as the User) and Yandex.Go Israel Ltd., being a body authorized to grant the rights to use the Program (hereinafter referred to as the Rightholder).

1.2. By copying the Program, installing it on its mobile device or using the Program in any way, the User expresses its full and unconditional consent to all terms and conditions of the License.

1.3. It is permitted to use the Program only under the terms and conditions of this License. If the User does not accept the terms and conditions of the License in full, the User may not use the Program for any purpose. It is prohibited to use the Program in violation of (failing to fulfill) any of the terms and conditions of the License.

1.4. The Program can be used by the User under the terms and conditions of this License for personal non-commercial purposes free of charge. It is only possible to use the Program under terms and in ways not covered by this License based on a separate agreement with the Rightholder.

1.5. When using the Program, you agree that the following document forms an integral part of this License for the Program:

1.5.1. The Terms of Use of Yango Taxi available at https://yandex.com/legal/yango_termsofuse

1.5.2. The Terms of Use of Yango Delivery available at: https://yandex.com/legal/yango_delivery_termsofuse

as well as documents of YANDEX LLC (16, Leo Tolstoy St., Moscow, 119021, Russia), which terms and conditions fully cover the use of the Program:

1.5.3. The License to Use Yandex Search Engine available at https://yandex.com/legal/termsofuse;

1.5.4. The Privacy Policy available at https://yandex.com/legal/confidential.

The said documents (inter alia, any parts thereof) can be assigned and (or) amended by the Rightholder at any time. New versions of the documents shall come into effect upon their publication, unless otherwise stipulated by the version itself. Rightholder will make best efforts to notify the User of any material change to these documents, however it shall not be obligated to notify the User of any immaterial changes.

 

2. Rights to the Program

2.1. The exclusive right to the Program is vested in the Rightholder.

 

3. License

3.1. The Rightholder shall, free of charge and under an ordinary (non-exclusive) license, grant to the User the non-transferable right to use the Program in all countries of the world in the following ways:

3.1.1. to use the Program as intended, wherefore to copy and install (reproduce) it on the User’s mobile device/-s. The User may install the Program on an unlimited number of mobile devices;

3.1.2. to reproduce and distribute the Program for non-commercial purposes (free of charge).

3.2. The Program shall be used (inter alia, be distributed) under the name: Yango. The User may not change and/or delete the name of the Program, the copyright notice or any other references to the Rightholder.

 

4. Limitations

4.1. Except as used in the scope and in the ways expressly stipulated by this License, the User may not modify, decompile, disassemble, decrypt and perform any other actions with the object code and source code of the Program meant to obtain information on the implementation of algorithms used in the Program, create derivative works using the Program and otherwise use (allow to use) the Program and any components thereof, maps and other images and data stored by the Program on the User’s mobile device, without the Rightholder’s written consent.

4.2. The User may not reproduce and distribute the Program for commercial purposes (inter alia, for a fee), inter alia, as part of software product collections, without the Rightholder’s written consent.

4.3. The User may not distribute the Program in any form other than the form received, without the Rightholder’s written consent.

 

5. Special Provisions

5.1. Some functions of the Program can only be performed with the Internet available. The User shall independently get and pay for such access under terms and as per tariffs of its communication or Internet provider.

5.2. The Program enables the User to place information on the User’s potential demand for services involving the transportation of passengers and baggage, look through offers of organizations or individuals providing services in the said field, and search for such offers using parameters set by the User.

5.3. Information available to the User within the Program (hereinafter referred to as the Data) is provided by the Rightholder’s partners. To get more details on services offered (including the information on the availability of Wi-Fi hotspot inside the taxi, carrying out of photo/video recording inside the taxi by the Right Holder's partners or other information), the User can either address the Rightholder’s partners or provide its contact information through the functions of the Program, which can be used by the Rightholder’s partners to contact the User on their own and provide it with the information on services offered.

5.4. The Rightholder shall not be held liable for the content and/or relevance of information provided by the partners, including information on the cost of the partners’ services and on their availability at the moment.

5.5. The User shall independently (without the participation of the Rightholder) discuss with the partners the acquisition of services in accordance with the partners’ rules on the provision of services. The Rightholder shall not be held liable for financial and any other transactions effected by the User and partners and for any consequences of the acquisition of the partners’ services by the User.

5.6. The User acknowledges and agrees that, subject to the terms of the Privacy Policy, the Rightholder can process the User’s personal information required to provide the services (including personal details), transfer the User’s personal details to the Rightholder’s partners (which may be located in the jurisdictions that may have not the same level of protection provided in the User's jurisdiction), and also agrees that the Rightholder’s partners can process personal information in order to provide services to the User within the Program. When the User uses the Program, the personal information is transferred to Yandex.Taxi LLC (16, Leo Tolstoy St., Moscow, 119021, Russia) and YANDEX LLC to be processed under the terms and for the purposes determined in the Privacy Policy of YANDEX LLC available at: https://yandex.com/legal/confidential. When the personal information is transferred to Rightholder’s partners, they will be subject to the terms of the Privacy Policy. The User hereby consents to the foregoing.

5.7. The User is hereby notified, understands and agrees that the Program can collect anonymized statistical data, which shall be owned exclusively by the Rightholder.

5.8. The Program shall be registered and used by applying the User’s mobile phone number. If the User deletes the Program from the User’s mobile device, then the User’s personal information obtained by the Rightholder during authorization in the Program with the use of the User’s mobile phone number and application of the Program will be saved in the Service for as long as it may be permitted pursuant to Section 9 of the Privacy Policy (Clause 1.5.3 of this License). If the Program is re-installed on the device and registered using the same mobile phone number as an identifier, the User’s personal information provided with the use of the said mobile phone number will be restored in full.

5.9. For the avoidance of doubt, the Rightholder does not provide services involving the transportation of passengers and baggage and help desk services.

 

6. Certain Functions of the Program

6.1. The Program may include certain functions that allow the User to use other services of the Right Holder and third parties.

6.2. When using Deli by Yango function that allows the User to get access to the Deli by Yango provided by the Rightholder through the Program, the User is considered to have accepted Deli by Yango’s Terms of Use posted on: https://yandex.com/legal/tou_deli, with the following additions:

6.2.1. When using the Deli by Yango function the User authorizes at the Deli by Yango service using the User's Program login details.

6.2.2. The User may make payments at the Deli by Yango service available through the Deli by Yango function of the Program using the Linked Card, as this term is defined in the Terms of Use of the Yango Delivery service (https://yandex.com/legal/yango_delivery_termsofuse).

In all other respects, when using the Deli by Yango function, the User shall be guided by the provisions of Deli by Yango Terms of Use.

6.3. When using Yango Locals function that allows the User to get access to the Yango Locals Platform through the Program, the User is considered to have accepted Terms of Use of Yango Locals posted on: https://yandex.com/legal/yangolocals_termsofuse/?lang=he, with the following additions:

6.3.1. When using Yango Locals function the User authorizes at Yango Locals Platform using the User's Program login details.

6.3.2. The User may make payments at the Yango Locals Platform available through the Yango Locals function of the Program using the Linked Card, as this term is defined in the Terms of Use of the Yango Delivery service (https://yandex.com/legal/yango_delivery_termsofuse).In all other respects, when using the Yango Locals function, the User shall be guided by the provisions of Terms of Use of Yango Locals.

 

7. Liability under the License

7.1. The Program is provided “as is”. The Rightholder provides no guarantees of error- and trouble-free operation of the Program or its certain components and/or functions, fitness of the Program for specific goals of the User, does not guarantee the reliability, accuracy, completeness and timeliness of the Data, and provides no other guarantees, which are not expressly stated in this License.

7.2. The Rightholder shall not be held liable for any direct or indirect consequences of any use of or inability to use the Program (including the Data) and/or any losses incurred by the User and/or third parties as a result of any use of, failure to use or inability to use the Program (including the Data) or its certain components and/or functions, inter alia, due to possible errors or failures in their operation, except as expressly stipulated by laws.

7.3. All issues and claims related to the use of / inability to use the Program or the Data and possible violations of laws and/or third-party rights by the Program or the Data shall be sent through the feedback form to support@yango.yandex.com.

7.4. This License and all relations associated with the use of the Program shall be governed by laws of the State of Israel.

 

8. Updates / New Versions of the Program

8.1. This License covers all future updates / new versions of the Program. By agreeing to install an update / new version of the Program, the User accepts the terms and conditions of this License for relevant updates / new versions of the Program, if there is no other license agreement for the update / new version of the Program.

 

9. Amendments to this License

9.1. This license agreement may be unilaterally amended by the Rightholder. User notification of the amendments introduced to the terms and conditions of this License is posted at: https://yandex.com/legal/yango_mobile_agreement. The said amendments to the terms and conditions of the license agreement shall come into effect from the date of their publication, subject to Section 1.5 above, unless otherwise specified in the relevant publication.

 

10. Interpretation

10.1. Wherever used herein, a pronoun in the masculine gender shall be considered as including the feminine gender unless the context clearly indicates otherwise.

10.2. This License is a translation from Hebrew into English. However, in the event of a conflict between the License in Hebrew and its translation, the Hebrew version of the License shall be legally binding.

בכל שימוש בתוכנה אתה מסכים באופן מלא ובלתי מותנה לתנאי הסכם רישיון זה.

אם אינך מקבל את הסכם הרישיון במלואו, אינך רשאי לעשות שימוש בתוכנה, לכל מטרה שהיא.

1. הוראות כלליות

1.1. הסכם הרישיון (להלן: "הרישיון") קובע את תנאי השימוש ב- Yango למכשירים ניידים (להלן: "התוכנה"), והוא נעשה בין כל אדם שעושה שימוש בתוכנה, למעט כל אדם בטריטוריה של הפדרציה הרוסית או הרפובליקה של בלארוס (להלן: "המשתמש") לבין יאנדקס.גו ישראל בע"מ , שהינו גוף שמוסמך לתת את הזכויות לעשיית שימוש בתוכנה (להלן: "בעלת הזכויות").

1.2. בהעתקת התוכנה, התקנתה על מכשיר נייד או השימוש בה בכל דרך שהיא, המשתמש נותן את הסכמתו המלאה והבלתי מותנית לכל תנאי הרישיון.

1.3. מותר לעשות שימוש בתוכנה רק בהתאם לתנאי רישיון זה. ככל שהמשתמש אינו מסכים לתנאי הרישיון במלואם, הוא אינו רשאי לעשות שימוש בתוכנה לכל מטרה שהיא. השימוש בתוכנה תוך הפרה של כל תנאי מתנאי הרישיון הינו אסור.

1.4. המשתמש רשאי לעשות שימוש בתוכנה, בהתאם לתנאי הרישיון למטרות פרטיות ולא מסחריות, ללא תשלום. ניתן לעשות שימוש בתוכנה בתנאים ובדרכים שאינם כלולים ברישיון זה, אך ורק על פי הסכם נפרד עם בעלת הזכויות.

1.5. בשימוש בתוכנה, אתה מסכים שהמסמך שלהלן מהווה חלק בלתי נפרד מרישיון זה לגבי התוכנה:

1.5.1. תנאי השימוש ב-Yango Taxi, הזמינים בכתובת: https://yandex.com/legal/yango_termsofuse.

1.5.2. תנאי השימוש ב-Yango Delivery הזמינים בכתובת:

https://yandex.com/legal/yango_delivery_termsofuse.

וכן המסמכים של של YANDEX LLC (אשר כתובתה רחוב לאו טולסטוי 16, מוסקבה 119021, רוסיה), כאשר התנאים כאמור מסדירים באופן מלא את השימוש בתוכנה:

1.5.3. רישיון לעשיית שימוש במנוע החיפוש של Yandex, הזמין בכתובת:

1.5.4. מדיניות הפרטיות, הזמינה בכתובת:

https://yandex.com/legal/confidential.

בעלת הזכויות רשאית להמחות ו/או לתקן את המסמכים כאמור (ובין היתר, כל חלק מהם)בכל עת. הנוסח החדש של המסמכים יכנס לתוקפו עם פרסומו, למעט אם נקבע אחרת בנוסח עצמו. בעלת הזכויות תנקוט במירב המאמצים להודיע למשתמש על כל שינוי מהותי במסמכים האמורים, אולם היא לא תהיה חייבת להודיע על שינוי שאינו מהותי.

 

2. הזכויות בתוכנה

2.1. הזכות הבלעדית בתוכנה מוקנית לבעלת הזכויות.

 

3. הרישיון

3.1. בעלת הזכויות, תעניק למשתמש, ללא תשלום ועל פי רישיון רגיל (לא בלעדי), זכות בלתי ניתנת להעברה לשימוש בתוכנה בכל העולם, בדרכים שלהלן:

3.2. להשתמש בתוכנה באופן שיועד לה, משום כך להעתיק ולהתקין (לשכפל) אותה במכשיר הנייד של המשתמש. המשתמש רשאי להתקין את התוכנה במספר בלתי מוגבל של מכשירים ניידים;

3.3. לשכפל ולהפיץ את התוכנה למטרות לא מסחריות (ללא תשלום).

3.4. השימוש בתוכנה (ובין היתר, ההפצה שלה) יתבצעו תחת השם Yango. המשתמש אינו רשאי לשנות ו/או למחוק את שם התוכנה, הודעת זכויות היוצרים או כל התייחסות אחרת לבעלת הזכויות.

 

4. מגבלות

4.1. למעט שימוש בהיקף ובדרכים המפורטות במפורש ברישיון זה, המשתמש אינו רשאי לשנות את קוד האובייקט וקוד המקור של התוכנה, או לבצע בהם פירוק, שחזור, פיענוח או כל פעולה אחרת שמטרתן לקבל מידע על יישום האלגוריתמים בהם נעשה שימוש בתוכנה, ליצור כל יצירה נגזרת תוך שימוש בתוכנה, או לעשות (או להתיר לעשות) כל שימוש אחר בתוכנה או בכל רכיב בה, או במפות, תמונות אחרות או בנתונים המאוחסנים באמצעות התוכנה במכשיר הנייד של המשתמש, ללא הסכמתה בכתב של בעלת הזכויות.

4.2. המשתמש אינו רשאי לשכפל ולהפיץ את התוכנה למטרות מסחריות (בין היתר, בתשלום), בין היתר, כחלק מאוסף מוצרי תוכנה, ללא הסכמתה של בעלת הזכויות בכתב.

4.3. המשתמש אינו רשאי להפיץ את התוכנה בכל צורה שהיא מלבד הצורה בה היא התקבלה, ללא הסכמתה של בעלת הזכויות בכתב.

 

5. הוראות מיוחדות

5.1. ניתן להפעיל פונקציות מסוימות של התוכנה רק עם גישה לאינטרנט. על המשתמש לקבל ולשלם באופן עצמאי עבור גישה כזו, בהתאם לתנאים ולתעריפים של ספק התקשורת או האינטרנט שלו.

5.2. התוכנה מאפשרת למשתמש למסור מידע בנוגע לדרישה פוטנציאלית שלו לשירותים הקשורים להסעת נוסעים וכבודה, לעיין בהצעות של ארגונים או יחידים שמספקים שירותים בתחום זה, ולחפש הצעות כאמור תוך שימוש בפרמטרים הנקבעים על ידי המשתמש.

5.3. הנתונים הזמינים למשתמש בתוכנה (להלן: "הנתונים") נמסרים על ידי השותפים של בעלת הזכויות. על מנת לקבל פרטים נוספים על השירותים המוצעים (לרבות מידע על זמינותן של נקודות גישה ל- Wi-Fi בתוך המונית, ביצוע צילומי תמונות/הקלטות וידיאו בתוך המונית על ידי השותפים של בעלת הזכויות, או מידע אחר), המשתמש יכול לפנות לשותפים של בעלת הזכויות, או למסור פרטי קשר באמצעות הפונקציות של התוכנה, שבאמצעותם יוכלו השותפים של בעלת הזכויות ליצור קשר עם המשתמש בעצמם, ולמסור לו את המידע על השירותים המוצעים.

5.4. בעלת הזכויות לא תישא באחריות בשל התוכן ו/או הרלוונטיות של המידע שנמסר על ידי השותפים, לרבות מידע על עלות השירותים של השותפים ועל זמינותם באותו המועד.

5.5. המשתמש באופן עצמאי (ללא השתתפות בעלת הזכויות) ידון מול השותפים בנוגע לרכישת שירותים בהתאם לכללי השותפים לגבי מתן השירותים. בעלת הזכויות לא תישא באחריות לעסקאות פיננסיות ואחרות שבוצעו על ידי המשתמש והשותפים, ולהשלכות כלשהן של רכישת שירותים של השותפים על ידי המשתמש.

5.6. המשתמש מסכים, בכפוף לתנאי מדיניות הפרטיות, שבעלת הזכויות רשאית לעבד את המידע האישי של המשתמש הנחוץ למתן השירותים (לרבות פרטים אישיים), להעביר את הפרטים האישיים של המשתמש לשותפים של בעלת הזכויות (אשר יכולים להיות ממוקמים בתחומי שיפוט אשר אינם מספקים רמת הגנה המסופקת בתחום שיפוטו של המשתמש), וכי השותפים של בעלת הזכויות יכולים לעבד את המידע האישי לצורך מתן השירותים למשתמש באמצעות התוכנה. כאשר המשתמש עושה שימוש בתוכנה, המידע האישי שלו מועבר ל- Yandex.Taxi LLC (16, Leo Tolstoy St., Moscow, 119021, Russia), ול- Yandex LLC, כדי שיעובד בהתאם לתנאים ולמטרות שנקבעו במדיניות הפרטיות של Yandex LLC, הזמינה בכתובת: https://yandex.com/legal/confidential. כאשר מידע אישי מועבר לשותפים של בעלת הזכויות, הם יהיו כפופים לתנאים של מדיניות הפרטיות. המשתמש נותן את הסכמתו לאמור לעיל.

5.7. נמסר בזאת למשתמש, והמשתמש מבין ומסכים, כי התוכנה עשויה לאסוף נתונים סטטיסטיים אנונימיים, אשר יהיו בבעלות בלעדית של בעלת הזכויות.

5.8. התוכנה תירשם, ותיעשה בה שימוש, באמצעות מספר הטלפון הנייד של המשתמש. כאשר המשתמש מוחק את התוכנה מן הזיכרון של המכשיר הנייד שלו, המידע האישי של המשתמש שהתקבל על ידי בעלת הזכויות במהלך ההרשאה בתוכנית, תוך שימוש במספר הטלפון הנייד של המשתמש ויישום התוכנה, יישמר על ידי השירות למשך התקופה המותרת בהתאם לסעיף 9 למדיניות הפרטיות (סעיף 1.5.3 לרישיון זה). אם התוכנה תותקן מחדש במכשיר ויבוצע רישום תוך שימוש באותו מספר טלפון נייד כמזהה, המידע האישי של המשתמש שנמסר תוך שימוש באותו מספר טלפון ישוחזר במלואו.

5.9. למען הסר ספק, בעלת הזכויות אינה נותנת שירותים הקשורים להסעת נוסעים וכבודה, ולשירותי מרכז תמיכה.

 

6. פונקציות מסוימות של התוכנית

6.1. התוכנה עשויה לכלול פונקציות מסוימות המאפשרות למשתמש להשתמש בשירותים אחרים של בעלת הזכויות ושל צדדים שלישיים.

6.2. בעת שימוש בפונקציה Deli by Yango המאפשרת למשתמש לקבל גישה ל- Deli by Yango המסופקת על ידי בעלת הזכויות באמצעות התוכנה, המשתמש ייחשב כאילו קיבל את תנאי השימוש של Deli by Yango זמינים בקישור: https://yandex.com/legal/tou_deli עם התוספות הבאות:

6.2.1. בעת שימוש בפונקציה Deli by Yango המשתמש מרשה בשירות Deli by Yango באמצעות פרטי הכניסה של המשתמש בכניסה.

6.2.2. המשתמש רשאי לבצע תשלומים בשירות Deli by Yango באמצעות פונקציית Deli by Yango של התוכנה באמצעות כרטיס הבנק המקושר כהגדרתו בתנאי השימוש בשירותYango Delivery (https://yandex.com/legal/yango_delivery_termsofuse)

בשאר היבטי שירות Deli by Yango, בעת השימוש בפונקציה Deli by Yango המשתמש יפעל בהתאם לתנאי שימוש של שירות Deli by Yango.

6.3. בעת שימוש בפונקציה Yango Locals המאפשרת למשתמש לקבל גישה לפלטפורמתYango Locals באמצעות התוכנה, המשתמש ייחשב כמי שקיבל את תנאי השימוש של זמינים בקישור: https://yandex.com/legal/yangolocals_termsofuse/?lang=he עם התוספות הבאות:

6.3.1. בעת שימוש בפונקציה Yango Locals המשתמש מרשה בפלטפורמת Yango Locals באמצעות פרטי הכניסה של המשתמש בכניסה.

6.3.2. המשתמש רשאי לבצע תשלומים בפלטפורמת Yango Locals באמצעות פונקציית Yango של התוכנה באמצעות כרטיס הבנק המקושר כהגדרתו בתנאי השימוש בשירות Yango (https://yandex.com/legal/yango_delivery_termsofuse/) בשאר היבטי פלטפורמת Yango Locals, בעת השימוש בפונקציה Yango Locals, המשתמש יפעל בהתאם לתנאי שימוש של שירות Yango Locals

 

7. אחריות על פי הרישיון

7.1. התוכנה מסופקת כפי שהיא (as is). בעלת הזכויות אינה נותנת כל התחייבות או אחריות לפעולה ללא שגיאות או בעיות של התוכנה או של רכיבים ו/או פונקציות מסוימות בה, להתאמה של התוכנה למטרות המסוימות של המשתמש, אינה מתחייבת או אחראית להיות הנתונים אמינים, מדוייקים, מלאים או מעודכנים, או כל התחייבות או אחריות אחרת שאינה מפורטת במפורש ברישיון זה.

7.2. בעלת הזכויות לא תישא באחריות בשל כל תוצאה, ישירה או עקיפה, של כל שימוש או אי יכולת לעשות שימוש בתוכנה (לרבות הנתונים), ו/או כל הפסדים או אובדן שיגרמו למשתמש ו/או לצדדים שלישיים כתוצאה מכל שימוש, אי שימוש או אי יכולת לעשות שימוש בתוכנה (לרבות הנתונים) או ברכיבים ו/או בפונקציות המסוימות שלה, בין היתר, כתוצאה משגיאות או כשלים אפשריים בפעולותיהם, למעט כקבוע במפורש בחוק.

7.3. כל תלונות, טענות ותביעות בנוגע לשימוש / אי היכולת לעשות שימוש בתוכנה או בנתונים, או הפרות אפשריות של הדין ו/או של זכויות של צדדים שלישיים על ידי התוכנה או הנתונים ישלחו באמצעות טופס המשוב לכתובת: support@yango.yandex.com.

7.4. על רישיון זה ועל כל היחסים הקשורים בשימוש בתוכנה יחולו דיני מדינת ישראל.

 

8. עדכונים / גרסאות חדשות של התוכנה

8.1. רישיון זה חל לגבי כל העדכונים העתידיים או גרסאות חדשות של התוכנה. בהסכמה להתקנת עדכון / גרסה חדשה של התוכנה, המשתמש מסכים לתנאי רישיון זה לגבי העדכונים או הגרסאות החדשות הרלוונטיים של התוכנה, ככל שלא יהיה הסכם רישיון אחר לגבי העדכון / גרסה חדשה של התוכנה.

 

9. תיקון הרישיון

9.1. בעלת הזכויות רשאית לתקן הסכם רישיון זה באופן חד צדדי. הודעה למשתמשים על התיקונים שהוכנסו בתנאי רישיון זה תפורסם בכתובת https://yandex.com/legal/yango_mobile_agreement. תיקונים כאמור לתנאי רישיון זה יכנסו לתוקפם במועד פרסומם, בכפוף לסעיף 1.5 לעיל, למעט אם צוין אחרת בפרסום הרלוונטי.

 

10. פרשנות

10.1. בכל מקום ברישיון זה בו נעשה שימוש בלשון זכר, הכוונה היא לכלול את לשון הנקבה, זולת אם תוכן הדברים במפורש מראה כוונה אחרת.

10.2. רישיון זה תורגם מעברית לאנגלית. בכל מקרה של סתירה בין נוסח רישיון זה בעברית לבין נוסח רישיון זה בשפה האנגלית, רק נוסח הרישיון

בעברית יהיה מחייב מבחינה משפטית.
