Terms of Use of Yango Delivery

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an agreement of Yango Delivery Israel Ltd. (hereinafter referred to as Yango) with an Internet user (hereinafter referred to as the User) to use Yango Delivery Platform (hereinafter referred to as the Platform).

1.2. The use of the Platform by the User is also governed by these Terms and documents of YANDEX LLC (16, Leo Tolstoy St., Moscow, 119021, Russia):

1.3. By starting to use the Platform / its certain functions, the User is deemed to have accepted these Terms and provisions of regulatory documents, in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms and/or regulatory documents, the User may not use the Platform.

1.4. Yango may, at any time, assign and (or) amend provisions hereof, and YANDEX LLC may, at any time without notice to the User, amend provisions of the regulatory documents. The current version hereof is available at: https://yandex.com/legal/yango_termsofuse. Yango will make best efforts to notify the User of any material change to the Terms however it shall not be obligated to notify the User of any immaterial changes to the Terms. The User bears a risk of failure to review a new version of the Terms and regulatory documents. Any continued use of the Platform after the Terms or regulatory documents have been changed will qualify as the acceptance of the new version.

1.5. The User shall stop using the Platform, if he or she disagrees with any amendments to these Terms Yango made as prescribed by cl. 1.4 hereof.

1.6. Any use of the Platform by a minor (under 18) requires the consent of the minor’s parent or legal guardian. If such consent is not received, the minor may not use the Platform.

1.7. The Platform enables the User to place information, free of charge, on the User’s potential demand for passenger and baggage transportation services, look through offers of organizations providing services in the said field, and search for such offers using parameters set by the User. All currently available functions of the Platform along with any developments and/or newly added functions are subject to these Terms.

1.8. Depending on the User’s region, any or all functions of the Platform can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Platform inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Platform in a certain region shall be provided to the User upon his or her request sent to Yango.

1.9. For the avoidance of doubt, Yango does not provide passenger and baggage transportation services and help desk services and shall not be responsible for the actions or omission of the Service Partners (as defined below).

1.10. By using the Platform, the User consents to receive promotional messages. The User may unsubscribe from promotional messages by using relevant functions of the Platform or following instructions specified in a promotional message received.

1.11. If the User changes the destination, make multiple stops, or make any other deviation(s) as a result of which the parameters of the ride no longer comply with the information provided through the Platform, the agreed fee for the services might be increased or the order might be cancelled.

1.12. The User agrees and acknowledges that by choosing the corporate method of payment, the provisions of the relevant agreement for corporate services shall prevail on these Terms.

2. Use of the Platform. Certain Functions of the Platform

2.1. The Platform is provided to the User for personal non-commercial use.

2.2. Information on passenger and baggage transportation services (hereinafter referred to as the “Information”) is provided by partners of the Platform (referred to herein as “Service Partners”). The contact details of a Service Partner are available on request through the Platform. For more information about the services offered, the User may contact the Service Partners or provide their contact details through the functions of the Platform for the Service Partners to independently contact the User and provide information about the services offered.

2.3. Yango shall not be held liable for the content and/or relevance of information provided by the Service Partners, including information on the cost and current availability of the partners’ benefits. The User shall independently (without the participation of Yango) discuss the acquisition of services with the partners in accordance with the partners’ rules on the provision of services. Yango shall not be held liable for financial and any other transactions effected by the User and the partners and for any consequences of the acquisition of the partners’ services by the User.

2.4. The User may access functions of rating the services of the Service Partners and commenting / leaving feedback on the Platform and/or services of the Service Partners. Users ratings and feedback are posted on the Platform website and can be available on third-party websites. Yango reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason.

2.5. Yango reserves the right, at own discretion, to limit User access to the Platform (or to certain functions of the Platform, if technologically feasible) using the User's account and(or) block the User’s entire account and take any other measures upon violations of these Terms, legislative requirements, Yango or third-party rights and legitimate interests, concerns for public safety, or in case of legal obligations of Yango.

2.6. When demand for delivery and(or) other services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service Partners can be raised. Yango informs of higher tariffs by posting the relevant notice by sending an information message to the User’s mobile phone number or through the Platform or in any other way.

2.7. The User may cancel an order through the Platform. If the cancellation is made before the Service Provider arrived to its destination, no payment will be charged from the user.

2.8. The User authorizes Yango, subject to the terms of the Privacy Policy of YANDEX LLC (available as described below), to process personal information (including personal details) of the User of Yango, to transfer personal information of the User to Yango’s partners, and to process personal information for Yango’s partners to provide services to the User on the Platform. When the User turns to the Platform, their personal information is transmitted to YANDEX LLC to be processed under the terms and for the purposes determined in the Privacy Policy of YANDEX LLC available at: (https://yandex.com/legal/confidential)

3. Requests for Delivery service

3.1. The User may request a quote ("Delivery Request") for the delivery services through the Platform to order the Delivery Service with respect to a specific delivery that meets the following criteria ("Delivery"):

3.1.1. Pick-up location: Tel Aviv and the surrounding area, other locations as they may become available;

3.1.2. Destination location: Tel Aviv and the surrounding area, other locations as they may become available;

3.1.3. Payment method: credit card only.

3.2. The User may make a Delivery Request for a Delivery only after the parcel subject of the Delivery is properly packaged and ready to be delivered ("Parcel").

3.3. When making a Delivery Request , the User will specify the shipping information, including the exact address of the Parcel delivery destination (“Delivery Destination”), the recipient of the Parcel (“Recipient”) and Recipient information including name and telephone number (“Recipient Details”) and any information relevant to the Parcel. A Parcel should not be larger in its dimensions than a suitcase that can fit in the trunk of a standard vehicle. If the Parcel has fragile content, this should be explicitly stated in the Delivery Request and on the packaging of Parcel, and the Parcel should be packaged accordingly.

3.4. Following a Delivery Request, the User will see a quoted fee for the Delivery Request. The quote is subject to change until the Delivery Request is confirmed by a Service Partner.

3.5. The fees quoted for the same ride in the Platform depend upon the demand, traffic conditions, pick-up and (or) destination location, time of the Delivery Request and other factors. They also may differ from the fees quoted by the Service Partner for services rendered outside the Platform.

3.6 It is herby clarified, that further payments will be demanded, other than the price shown in the Platform, as waiting fee and the starting point or destination point. These fees are shown in the Platform, and Yango may change it from time to time. By using the Platform, the user approves that he read all the relevant tariffs, considered them and agreed to pay these prices by using the Platform.

3.7. If the User changes the destination of the Delivery, make multiple stops, or make any other deviation(s) as a result of which the parameters of the delivery no longer comply with the information provided in the Delivery Request, the fee charged for the Delivery Services might be increased or the Delivery might be cancelled.

3.8. If the Parcel is not ready for the Delivery, if the Recipient is unavailable to collect the Parcel, in case of cancellation, or if the information provided by the User in the Delivery Request is inaccurate and (or) insufficient, the User may be charged a fee as calculated by the Platform. 3.9. It is clarified that the Service Partners are obligated to respond to any Delivery Request made by the User provided that they have necessary capacity and availability to provide the Delivery at the time of the relevant request.

3.10. Prior to handing the Parcel to the Service Partner, the User will be responsible for verifying the contents of the Parcel, and the proper packaging of the Parcel, including sealing, and protection appropriate to the contents of the Parcel, as well as specifying any relevant details for the Parcel Delivery at the Delivery Destination, including the Recipient Details.

3.11. The User will hand the Parcel to the Service Partner upon arrival at the pick-up point, after having performed identification of the Service Partner arriving to collect the Parcel before Delivery. It is clarified that the User is responsible for the handing of the Parcel to the Service Partner.

3.12. The User is responsible for the Recipient to be present when the Parcel arrives at the Delivery Destination and that the Recipient accepts the Parcel. In the event the Recipient is unavailable or does not accept the Parcel, the Service Partner may contact the User and return the Parcel to the User, or if the Service Partner is unable to coordinate returning the Parcel to the User, it may put the Parcel in storage or reasonably act otherwise.

3.13. It is hereby agreed that 30 days after the Parcel is put in storage as aforementioned, the Parcel will be destroyed. Yango and (or) the Service Partners are not responsible for guarding the Parcels that are not accepted by the Recipient as aforementioned.

3.14. The User declares and acknowledges that the User has received the Recipient's explicit prior consent to (a) use the Recipient Details for the purpose of providing the Delivery Service, (b) provide the Recipient Details to Yango, who may provide them to the Service Partners and the drivers and(or) couriers associated with the Service Partners, and (c) the use of the Recipient's information and Recipient Details by Yango, the Service Partners and (or) the drivers and(or) couriers associated with the Service Partners, for the purpose of providing the Delivery Service, including sending the Recipient messages in connection with the Delivery Service.

3.15. In some cases, Yango, through the Platform, may batch several orders to one delivery, that is for improvement of services provided, considering the delivery time and without damaging any of Yango’s service standards. If the user notices a rare delivery path, the user may approach Yango’s costumer service center, with the order number, for checking the motion. In anyway, it is herby clarified that Yango may batch deliveries and the user will not claim anything regarding.

4. Function of Cashless Payment for Delivery Services

4.1. It is clarified that Yango is charging the payment for the delivery services from the user (“the Payment”), and the user will receive a receipt right after the payment.

4.2 Tax invoice will be sent once a month.

The date of payment to the Service Providers will be as agreed between the Service Providers and Yango.

In addition to the payment, the user might be charged with extra payments, such as credit card commission, and Yango is not a part of any further charges.

4.3. Using the Platform is valid credit card only. The User shall specify a Linked Bank Card in the Platform interface indicating the following details:

4.3.1. Bank card number

4.3.2. Valid through

4.3.3. Verification code

4.4. The payment shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements.

4.5. When indicating their details pursuant to cl. 4.3 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.

4.6. The User understands and agrees that all actions performed in the Platform using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.

4.7. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Platform, they may contact Yango by phone numbers specified by the Platform and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

4.8. If, following the inspection caused by such a request, Yango decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If Yango is not a party to settlements made via the Linked Card, Yango can act as a body that transfers above user requests to Service Partners, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.

4.9. Yango reserves the right to require at any time that the User confirm the details they specified in the Platform, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated by cl. 2.5 hereof, if Yango thinks fit.

4.10. The provisions on the terms and procedure of payment for passenger and baggage transportation services specified in this section shall not apply, when a third party pays for such transportation services instead of the User under a separate contract Yango signed with such third party.

5. Permitted Uses of the Delivery Service

5.1. The Delivery Service class is provided to the User for personal non-commercial use.

5.2. The User may not order the Delivery Service for any illegal or unauthorized purpose nor may the User, in the use of the Delivery Service, violate any laws in the User’s jurisdiction. The User will comply with all applicable laws, rules and regulations in the User’s use of the Delivery Service class and the User’s performance of obligations on the Platform.

5.3. The User may not order the Delivery Services with respect to any of the following items:

  • narcotic drugs; psychotropic, potent, toxic, radioactive, explosive, poisonous, caustic, flammable, and other dangerous substances, including those under pressure;
  • firearms; pneumatic, gas or cold weapons and their parts, ammunition, fireworks, flares and bullets;
  • foreign currency and banks notes;
  • items and substances which, due to their nature or packaging may constitute a danger to people, or soil or ruin (damage) other cargo, surrounding people or items;
  • items requiring transportation in specially equipped vehicles, including but not limited to, refrigerated goods, food and beverages, and consumables;
  • fragile items without special packaging;
  • items that are not wholly owned by The User, or that the User does not have the legal right to deliver;
  • objects with a monetary value exceeding 500 NIS, or items of special personal value such as crafts, jewelry, gold and silver coins;
  • hazardous substances or substances that may harm or endanger human or animal life;
  • objects that are prohibited from being sent under any law, or that a special license is required to be sent, including, but not limited to drugs, pharmaceuticals, biological and chemical materials;
  • objects and items exceeding 20 kilos and/or 150 cm in length, width and height in total; long objects exceeding 150 cm in length.
  • any other items for which delivery is prohibited or limited in Israel.

6. Interpretation

6.1. Wherever used herein, a pronoun in the masculine gender shall be considered as including the feminine gender unless the context clearly indicates otherwise.

6.2. This is a translation of the Terms from Hebrew into English. However, in the event of a conflict between the Terms in Hebrew and its translation, only the Hebrew version of the Terms shall be legally binding.
