Terms of Use of the «Skazbuka» Service

Terms

For the purposes hereof, the following terms shall have the following meanings:

License - the license agreement that is publicly available on the Internet at: https://yandex.ru/legal/skazbuka_mobile_agreement

Terms - this agreement that is publicly available on the Internet at: https://yandex.ru/legal/skazbuka_termsofuse.

Skazbuka Service (Service) - the Skazbuka service, accessible through the Software, the holder of the exclusive rights to which is Yandex. The right to use the Skazbuka service is granted in accordance with the Terms.

Content - a set of any materials included in the Software, presented in a graphic, audio, video, audiovisual and other format available through the Software, as well as other materials available within the Skazbuka Service.

Software - Skazbuka computer sofware for mobile devices (iOS) or Skazbuka computer software for mobile devices (Android), respectively. The right to use the Skazbuka computer software for mobile devices is granted under the terms and conditions of the License.

Yandex -Yandex Music, LLC, a legal entity (OGRN 1077759854919) registered at: 82 Sadovnicheskaya St., building 2, office 10A05, 115035 Moscow, Russia.

User - any Internet user.

1. General Provisions

1.1. These Terms define the procedure for and terms and conditions of the use of the Skazbuka Service provided by Yandex for Users.

1.2. These Terms shall constitute a supplement to the User Agreement for the services of YANDEX, LLC, regarding the procedure for using the Service. In all respects not covered herein, the relations between Yandex and the User in connection with the use of the Service shall be governed by the following documents of YANDEX, LLC, and Yandex Plus, LLC:

1.3. By starting to use the Service/its individual functions, the User shall be considered to have accepted these Terms, as well as the terms and conditions of the Governing Documents, in full, without any reservations or exceptions. If the User does not agree with any of the provisions of the above documents, the User shall have no right to use the Service.

1.4. These Terms may be amended by Yandex without any special notice. The new version of the Terms shall come into force from the moment it is posted on the Internet at the address specified in this clause, unless otherwise provided for by the new version hereof. The current version of the Terms is always available at: https://yandex.com/legal/skazbuka_termsofuse.

1.5. If Yandex has introduced any amendment hereto, in accordance with the procedure provided for in Clause 1.4. hereof, with which the User does not agree, she/he shall have no right to use the Service.

1.6. By using the Service, the User gives her/his consent to receive informational and advertising messages. The User may refuse to receive advertising messages by using the appropriate features of the Service or following the instructions specified in the advertising message received.

2. Use of the Service. Individual Functions of the Service

2.1. The ability to use certain functionality of the Service, Content is possible only by purchasing the following types of subscriptions and/or additional option (hereinafter - "Subscription", "Additional Option"):

2.2. The User may be given the opportunity to use certain functionality of the Service, Content, without charging a fee when conducting marketing activities aimed at attracting attention to the Service. By participating in such activities, the User agrees to the Terms and Conditions.

2.3. The User shall be granted access to all the functions of the Service only as a result of authorization using a Yandex ID. The terms of registration and use of the Yandex ID are established by the User Agreement for Yandex Services at https://yandex.com/legal/rules. In this case, the functionality of the Service for the User who has been authorized on the Service but does not have a valid (active) Subscription, Additional Option or one of the Subscriptions is limited, except for the cases specified in clause 2.2. of the Terms.

2.4. Any Content is an intellectual property object of the respective rightholder and is protected by law.

2.5. When using the Service, the User has the opportunity to view and play the Content posted in the Service catalog, as well as the function of downloading files containing Content to her/his device for graphics rendition of such files in the Skazbuka mobile application.

2.6. When using the Service, the User can select the displayed Content in the Service catalog and the game timer, for which the User shall enter a number that is displayed in a separate section of the Service.

2.7. The rights to all objects that make up the design of the Service as a whole and its individual elements, Programs and Content are owned by their rightholders.

3. Miscellaneous

3.1. The Service is provided on the “as is” basis. Yandex does not provide any warranties regarding the error-free and uninterrupted operation of the Service or its individual functions, compliance of the Service with specific goals and expectations of the User.

Yandex does not warrant that the Content available on the Service will be available at any time, or will not be deleted.

3.2. The Service bears no liability for any direct or indirect consequences of any use of or impossibility to use the Service, and/or damage caused to the User and/or third parties as a result of any use, non-use of or impossibility to use the Service, or its individual functions, including due to possible errors or failures of the Service.

3.3. The Service and Content are intended exclusively for personal, non-commercial use within the framework of the direct functional purpose of the Service and the functionality provided by the Service. As a result of gaining access to the Content, the User agrees to use the Content and the Service exclusively for her/his personal non-commercial purposes. Any copying, reproduction, processing, distribution, making available to the public, as well as any other use of the Service/its individual parts or components, Content, including, for example, use for advertising and promotion of third-party goods and services without the consent of Yandex, as well as any other use of the Service for commercial purposes, is prohibited.

3.4. Yandex reserves the right to establish any rules, limits, and restrictions (technical, legal, organizational or other) on the use of the Service as a whole and its individual components (including, for example, the Content), and may change them at its own discretion, without a prior notice to Users. The specified rules, limits, and restrictions may be different for different categories of Users.

3.5. The User’s data obtained when using the Service shall be processed under the terms and conditions specified in the Privacy Policy available at: https://yandex.com/legal/confidential.

3.6. The law of the Russian Federation shall apply to the relations between the User and Yandex regarding the provision of the Service by Yandex. In case of inquiries, statements or complaints, the User may report them using the appropriate features of the Yandex Service. If Yandex and the User fail to reach agreement, the issue can be resolved in court at Yandex’s location.
