Terms of use of Mail for Domains service

This document is a translation of Terms of use of Mail for Domains service in English. In case of conflict between the Russian version of Terms of use of Mail for Domains service and this translation - only the Russian version of Terms of use of Mail for Domains service is legally binding. 1. General provisions

1.1. YANDEX LLC (hereinafter — “Yandex”) offers the Internet user (hereinafter —“User”) to use the Mail for Domains service available at: https://domain.yandex.com (hereinafter — “Service”).

1.2. These Terms constitute an addition to the User Agreement for Yandex Services with respect to the use of the Service. In all matters not provided in these Terms, the relationship between Yandex and the User in relation to the use of the Service is governed by the User Agreement for Yandex Services (https://yandex.com/legal/rules) as well as the License to Use Yandex Search Engine (https://yandex.com/legal/termsofuse) and the Privacy Policy (https://yandex.com/legal/confidential).

1.3. By starting to use the Service or its individual features, the User shall be considered to have accepted these Terms as well as conditions of all the above documents in full, without any reservations or exceptions. If the User does not agree to any of the provisions of these documents, the User may not use the Service.

1.4. These Terms may be amended by Yandex without any notice. The new version of the Terms shall be effective upon publication on the Internet at the address specified in this section, unless otherwise provided in the new version of the Terms. The current version of the Terms is always available at https://yandex.com/legal/domain_termsofuse.

1.5. In the event that Yandex, in the manner provided in section 1.4 of these Terms, makes any changes to these Terms to which the User does not agree, the User shall stop using the Service.

1.6. Terms and definitions:

1.6.1. Address – an e-mail address in the Administrator’s Domain;

1.6.2. Mail System – a system that allows to arrange access to the mailbox and work with e-mail for Addresses in the Administrator's Domain;

1.6.3. Address User – a party registered with Yandex services through the Mail for Domains service;

1.6.4. Administrator User – (hereinafter, the “Administrator”) – a party that connected the Administrator’s Domain to the Mail for Domains service;

1.6.5. Address User’s Account – an account that belongs to the party using the Address in Yandex services and stores information (including username and password) for access to the Address;

1.6.6. Yandex.Mail - Yandex service that provides the e-mail functionality, including but not limited to giving users the ability to send, receive and store messages and maintain an address book;

1.6.7. Administrator’s Domain – a domain name registered for the Administrator or available for the Administrator's control on other grounds.

2. Use of the Service. Individual Features of the Service

2.1. The Service offers the Administrator free of charge the possibility to organize the work with the Addresses using the functionality of Yandex.Mail. All currently existing functions of the Service as well as any development thereof and/or addition of new features shall be governed by these Terms. The Service is a fully functional version of Yandex.Mail with a web interface at http://mail.yandex.ru/for/xyz.com (where “xyz.com” is the address of the User’s Domain) and with all its features, including the availability of POP3/IMAP/SMTP for each Address at the following addresses: pop.yandex.ru / imap.yandex.ru / smtp.yandex.ru.

2.1.1. After registration with the Service, the Address User shall be able to use the email functions and functions offered by other Yandex services under the terms and conditions of using the respective service and the Service User Agreement.

2.1.2. Some services or certain functions thereof may be unavailable to the Address User, in particular such services as registration with Yandex.Direct service (placement of ads and advertising campaigns); registration with Yandex.Market service (placement of product offers); registration with Yandex.Money (opening of an account); registration of the Administrator’s Domain with the Mail for Domains service; uploading of pictures to Yandex.Fotki service; registration with Moi Krug service; paid subscription for Yandex.Music service. Any other services and/or certain functions thereof may be unavailable to the Address User; Yandex may, at its own discretion, modify or supplement the list of services and/or certain functions thereof unavailable to the Address User at any time and with no prior notification.

2.2. By using the technical possibilities of Yandex.Mail, the Administrator creates Accounts for Addresses in Yandex.Mail, manages on his own (within the limits of the technical capabilities of the Service and based on the requirements provided in these Terms or documents stipulated in section 1.2 hereof) Accounts of such Addresses, creates, deletes and updates them at his own discretion.

2.3. The Administrator may not use the Service for any Administrator’s services requiring payment.

2.4. The Administrator may not use the Service to arrange mass e-mailing on the Administrator’s behalf or under its direction or permission (including but not limited to e-mailing to an indefinite range of e-mail addresses, to an automatically chosen set of e-mail addresses, e-mailing to an unusually large number of addresses and other cases which Yandex may, at its own discretion, identify as a mass e-mailing).

2.5. The Administrator shall be independently responsible for providing access to the Service’s functionality to third parties, including for providing access to the Accounts of Address Users in the Administrator’s Domain to third parties. The Administrator shall be liable for any actions of third parties to which the Administrator has provided access to the Service under these Terms. The Administrator shall bear full liability for familiarization of such third parties with these Terms and the documents mentioned in section 1.2 of these Terms, as well as all the risks, costs and expenses arising from non-familiarization or late familiarization of such third parties with these documents. Any use of the Service in relation to Addresses in the Administrator’s Domain shall be considered performed by the Administrator. The Administrator warrants that its actions of providing access to the Service to third parties are not in breach of the law, these Terms, the documents mentioned in section 1.2 of these Terms, or the rights of third parties.

2.6. The Administrator warrants that it legally owns the Administrator’s Domain as well as trade marks and other design elements allowed for use in accordance with the Service’s functionality in the version of Yandex.Mail for the Administrator’s Domain.

2.7. Except for the personalization features provided within the Service’s and/or Yandex.Mail’s functionality, Yandex independently determines the appearance and functionality of Yandex.Mail, including its version designed for the Administrator, and may independently decide on placement of advertising materials on the pages of Yandex.Mail and the formats of such placement.

2.8. By using the Service, the Administrator grants Yandex the right to use any logo, trade mark and/or trade name of the Administrator and/or the Administrator’s website for information, advertising and promotional purposes related to the Service and/or Yandex.Mail without the need for any additional approval of the Administrator and without payment of any remuneration to the Administrator for such use.

2.9. Yandex reserves the right to establish any limits and restrictions, including but not limited to on the number of Administrator’s Domains and/or Addresses available for use through the Service, and may amend them at its own discretion and without any prior notice.

2.10. Yandex may at any time, at its sole discretion, without any notice to the User and without giving any reason, change, reset, block, remove or perform any other acts in relation to any Account on demand of the Address User of the respective Account. The Administrator may commit himself to perform the foregoing acts with Accounts on his own, by using the technical tools provided by Yandex, in which case Yandex shall not perform the foregoing acts with Accounts and shall not respond to corresponding queries of the Address Users of such Accounts, and the Administrator shall furnish to Yandex valid Administrator contact details, to which such queries may be re-directed.

2.11. Notwithstanding and in addition to the above provisions of section 2.10 hereof, Yandex reserves the right, at its sole discretion, without any notice to the Administrator and without stating reasons, to at any moment block or delete any Accounts from the Service as well as to disconnect any Administrator’s Domain from the Service, or to perform at its discretion any other act in relation to any Account or any Administrator’s Domain on the whole, in order to comply with the legal requirements or rights and legitimate interests of third parties.

2.12. Yandex reserves the right, at its sole discretion, to limit or completely block the Administrator's access to the Service (or, if technically possible, to certain features of the Service) in case of repeated violation of these Terms, or to apply other measures to the Administrator in order to comply with the legal requirements or rights and legitimate interests of third parties, including to terminate the connection of any Administrator’s Domain to the Service and to prohibit the Administrator from connecting any other domains to the Service.
