Terms of Use of Yandex SourceCraft

This document contains specific terms of use of SourceCraft (the "Service") and is an integral part of Yandex Cloud Customer Agreement (the "Agreement") and Service Terms set forth at https://yandex.com/legal/cloud_service_terms. Capitalized terms used herein but not defined herein shall have the meanings set forth in Agreement and Linked Documents.

1. Service Functionality

1.1. The Service offers the Customer possibility to create source code, manage source code versions, test, build, deploy and maintain software products. A complete description of the Service’s functionality is contained in the Instructions for using the Service posted on the Site.

1.2. The Service provides the Customer with access to:

1.2.1. Storing and versioning of source code;

1.2.2. Automation of build and testing processes for software products;

1.2.3. Deployment and maintenance templates for software products;

1.2.4. Using the functions of the SourceCraft Code Assistant service without installing a special software module (Plugin).

1.2.5. Other functionalities of the Service that Yandex makes available to the Customer at its discretion. The full list of functionalities is available to the Customer on the Site and/or in the Management Console.

1.3. The Service Level provided during the Preview period is not determined.

2. Service Tariffication

2.1. The use of the Service is not charged at the Preview.

2.2. Yandex may from time to time provide Customer with additional functional features of the Service for an additional fee.

2.3. Within the framework of the Service, the Customer can take advantage of special price and discount offers, information about which is posted on the Site and/or in the Management Console (if applicable).

3. Processing of data

3.1. The Customer shall acknowledge and agree that the Service is not intended for the processing of personal data. If personal data or other information protected by law is submitted or stored by the Customer when using the Service, the Customer shall independently ensure the legality of the transfer of such data to Yandex, as well as their further processing, including for the purposes specified in this section.

3.2. Using the Service, the Сustomer:

  • accepts the Terms of Use of SourceCraft Code Assistant, posted at: https://yandex.com/legal/cloud_terms_code_assistant/, to the extent that does not contradict this Terms of Use, while considering the functional features of the Service;
  • agrees that the information submitted or stored when using the Service, with the exception of information from private repositories (the “Information”), may be used by Yandex and its affiliates for the purposes of debugging and training models (improving the quality of the Service);
  • represents and warrants that it has obtained all necessary consents and has all the necessary rights to transfer the Information to Yandex and its affiliates for the above purposes;
  • warrants that the Information does not contain data related to secrets protected by law, special categories of personal data, biometric personal data or data the processing of which is prohibited in accordance with the applicable law.

4. Intellectual Property

4.1. By posting Content on the Service, the Customer grants Yandex a worldwide, non-exclusive, free-of-charge license for the entire term of the copyright for the following rights in relation to the Content:

  • reproduction;
  • copying;
  • storage and computer memory recording.

If, within the functionality of the Service, the Customer makes the Content publicly available, in addition to the above rights, the Customer also grants Yandex the right of public display and making available to the public in relation to the Content.

4.2. If, within the functionality of the Service, the Customer makes the Content publicly available, the Customer grants other Customers a worldwide, non-exclusive, free-of-charge license for the entire term of the copyright for the following rights in relation to the Content:

  • reproduction;
  • copying;
  • storage and computer memory recording;
  • modification and creation of derivative works;
  • public display and making available to the public.

In this case, other Customers have the right to exercise these rights exclusively within the Service and solely through the implementation of the functionality of the Service. 4.3. The Customer has the right to post Content on an open license terms at their discretion by posting the text of such license as part of the Content. In this case, the terms of such license prevail over clause 4.2 of these Terms.

4.4. If the Customer, within the functionality of the Service, exercises their right to modify another Customer’s Content (Contribution), and another Customer approves such Contribution, then the Customer who made the Contribution grants the right to use the Contribution under the terms specified in clause 4.2 or 4.3 of the Terms, and the Customer — the copyright holder of the Content — has the right to use the Content containing the Contribution on the same terms. If the Customer — the copyright holder of the Content — posted the related agreement (Contributor License Agreement) as part of the Content, then the terms of such agreement are to be applied.

5. Additional Service Use Restrictions

5.1. The Service may contain a number of restrictions, a list of which is contained on the Site in the section "Quotas and limits"

5.2. The Customer agrees to comply with all the rules and Instructions for using the Platform and Service, including posted on the website: https://sourcecraft.dev and https://sourcecraft.dev/portal/docs/. In case the Customer breaches the aforementioned rules and Instructions, Yandex reserves the right to immediately suspend access to the Service and/or rename the Customer, resources, organizations, profiles and etc. in the Service, and/or take other measures as provided for in the Agreement and at the above-mentioned addresses.
