Terms of use of the Yandex Cloud Notification Service

This document contains specific Terms of Use of Yandex Cloud Notification Service (“the Service”) and is an integral part of Yandex.Cloud Customer Agreement (”Agreement”) and Service Terms set forth at https://yandex.com/legal/cloud_service_terms. Capitalized terms used herein but not defined herein shall have the meanings set forth in Agreement and Linked Documents.

1. Functional Features of the Service

1.1. Yandex provides the Customer with the Service that allows a range of services for setting up and managing notification channels and/or processing notification events, as well as for technical support of the Service. A full description of the functionality of the Service is provided in the Instructions for using the Service posted on the Website.

1.2. Functional Features of the Service:

1.2.1. setting up and managing channels for push notifications on iOS and Android devices and in web browsers;

1.2.2. setting up and managing channels for SMS messages (notifications) (hereinafter referred to as Notifications) by mobile phone number to subscribers registered with mobile operators in the Russian Federation;

1.2.3. formation of requests for registration of the Sender's Name (alpha name) among subscribers of mobile operators registered in the territory of the Russian Federation, and setting up a channel for using this Sender's Name (alpha name);

1.2.3. other functional features of the Service, which Yandex makes available to Customer. Functional features of the Service are described in Documentation on Site.

1.3. To be able to send a PUSH notification to iOS/Android or a web browser, the Service can be provided provided that the Customer has configured the appropriate notification channel, the description and configuration instructions of which are located at: https://yandex.cloud/en/docs/notifications/concepts/#channelsand I subscribed the device according to the Instructions: https://yandex.cloud/en/docs/notifications/quickstart-push#create-endpoint.

1.4. In order to ensure the operation of the Service and the provision of services, Yandex has the right to involve a telecom operator.

1.5. By agreeing to these Terms, the Customer confirms that he has read and agrees with Section 4, which defines the procedure for providing Customer with the opportunity to form and (or) send and (or) receive information in the form of Notifications (alerts) by processing, as well as other services by Yandex LLC.Telecom (hereinafter referred to as Performer).

1.6. The Service Level Agreement defines the Service Level.

2. Pricing

2.1. The use of the Service is chargeable.

2.2. The cost of using the Service is determined in accordance with the tariffs and billing units indicated on the Website. Yandex has the right to change tariffs in accordance with the procedure stipulated in the Agreement.

2.3. Yandex has the right to provide additional Service features to the Customer from time to time for an additional fee.

2.4. Within the framework of the Service, the Customer can use special price and discount offers, information about which is posted on the Website and/or in the Management Console (if applicable).

3. Additional restrictions on the use of the Service

3.1. The Service may contain a number of restrictions, the list of which is contained on the Website in the "Quotas and limits" section.

3.2. Yandex has the right to unilaterally and without notifying the Customer restrict the use of the Service in whole or in part, or slow down the use of the Service, or reduce the available Quotas, until the Customer eliminates the reasons for the restriction, if:

– suspicion of sending Notifications without the prior consent of the Notification recipients,

– receiving complaints or claims from government agencies, telecom operators and other third parties regarding the Customer or his actions, regarding Customer Notifications, including their content, regarding the use of the Customer's Sender's Name, or the Customer's activities on the Platform, as well as in other cases indicating any violations of the Customer;

– suspicion of violation by the Customer of other Terms of Use of the Platform Services.

3.3. Yandex has the right to unilaterally and without notifying the Customer to lift the restrictions, provided that the Customer eliminates the reasons that were the basis for the restrictions.

3.4. The relevant restrictions may be lifted upon the Customer's request to the Yandex support service if the Customer eliminates the reasons that gave rise to the restrictions. In this case, Yandex has the right to unilaterally resolve the issue of lifting restrictions without notifying the Customer.

4. Rules for the provision of services

Registering the Sender's name

4.1. In order to register the Sender's name, the Customer undertakes to send a request to Yandex and provide documents confirming the right to use the sender's name/trademark/domain (hereinafter referred to as the registration request). The Customer undertakes to use only the Sender's Names that are agreed with Yandex. Yandex has the right to refuse to register the Sender's Name to the Customer without explaining the reasons. Registration of the Sender's Name is available only to Clients who are legal entities and individual entrepreneurs.

4.1.1. If the Sender's Name contains a trademark or service mark, other means of individualization and/or the results of intellectual activity (hereinafter referred to as "Objects "), the corresponding Objects must be legally used by the Customer. The Customer bears full responsibility to the Performer, Yandex, other Operator, recipients of Messages, copyright holders and other third parties for the use of the Sender's Name and ensures, at its own expense, the protection of Yandex and the Performer from any claims and claims of third parties related to the use of the Sender's Name.

In case of receiving a request from Yandex or the Operator, the Customer is obliged to submit documents confirming the Customer's rights to use the Objects and other results of intellectual activity used in the Customer's Notifications (including the Names of the Sender) within 1 (one) business day.

4.2. The request to register the Sender's Name is sent by the Customer via the Console. Yandex has the right to review the registration request within 7 calendar days from the date of receipt of the registration request. Yandex has the right to refuse to satisfy the request unilaterally and unconditionally without notifying the Customer about it.

4.3. The Customer undertakes not to use information in the Names of Senders that identifies and/or relates to persons recognized as foreign agents in accordance with Federal Law No. 255-FZ dated 07/14/2022 "On Control over the Activities of Persons under Foreign Influence" or other applicable regulatory legal acts, including names, brand names the names of the specified persons, the names of the resources, links to the resources belonging to the specified persons.

4.4. Notification of termination of use of the Sender's Name must be sent to Yandex via the Console 30 (thirty) business days before the planned date of termination of use of such Sender's Name. In the absence of the above-mentioned notification or if the Customer sends a notification in violation of the deadline for sending it, the Customer independently bears the negative consequences of this inaction in full (including possible additional costs). At the same time, Yandex and the Performer are not obligated in any way to monitor the fact that the Customer has not used the Name(s). The sender.

4.5. Yandex has the right to block (and also not approve) the Customer's use of any Sender's Name, as well as to suspend the provision of the Service in case of violation by the Customer of the above conditions, and (or) upon receipt of complaints from recipients, requests and claims of government agencies or third parties whose rights are violated by the use of the Sender's Name. The fact of a violation of the use of the Sender's Name is confirmed by any means, including the indications of the Yandex software and hardware systems or the Performer.

Notification Content

4.6. The Customer confirms and guarantees that the content of the Notification text complies with all applicable regulations and requirements of the legislation of the Russian Federation, including, but not limited to, provisions in the field of:

  • Advertising;

  • personal data ;

  • Countering the legalization (laundering) of proceeds from crime, as well as the financing of terrorism;

  • Intellectual property, including copyrights and related rights;

  • Prohibition of propaganda or calls for extremist activities, terrorism, violence, discrimination.

as well as social, moral, ethical norms and principles (not to offend human dignity, not to promote violence, racial or national hostility, etc.), not to violate the constitutional rights of citizens.

4.6.1. Yandex or the Performer has the right at any time to request documents and other information confirming the legality and compliance of the notifications sent with the above requirements. Such information may include:

  • Notification text;

  • sender's details (name, INN, contact information and other relevant information);

  • information about recipients (confirmation of voluntary consent to receive messages, if applicable);

  • documents confirming the right to use the alpha name;

  • other materials necessary to verify the legality of sending SMS messages.

4.6.2. The Customer undertakes to provide the requested documents and information within 1 calendar day from the date of receipt of the relevant request from Yandex. Failure to provide or untimely provision of information may result in the suspension or termination of the provision of the Service, as well as the application of other measures provided for in the agreement and legislation.

4.6.3. The provisions of paragraphs 4.6.1. – 4.6.2. are valid for the entire period of use of the Service and remain in force after the end of use of the Service in terms of obligations related to the verification of sent Notifications.

4.6.4. The Customer independently (without any intervention by Yandex and the Performer) determines the content of Notifications, the recipients of Notifications and the time of sending Notifications. The Customer is solely responsible to Yandex and the Performer, recipients and third parties, in particular, the competent government authorities, for the content of Notifications and the fact of their receipt and transmission.

4.6.5. Yandex does not edit or otherwise influence the content of the Customer's Notifications, except for restrictions on the number of characters allowed in Notifications, and does not moderate or use the content of Notifications.

4.7. Due to the fact that Yandex and the Performer are not the creator (manufacturer) and distributor of Notifications, starting from the moment of preparing the text of the Notification, editing it and ending with sending it to the recipients, all responsibility provided by law for the improper and illegal distribution of Notifications and their contents is fully borne by the Customer.

4.8. The Parties acknowledge that in the case of the content of advertising information in the Notifications, the Customer independently bears all the responsibilities of the advertiser and the advertiser, established by the legislation of the Russian Federation.

4.8.1. The Customer hereby guarantees that the advertising information does not contain information that makes the distribution of the Customer's Notifications unacceptable or unfair advertising, and also does not contain information that contradicts the legislation on advertising in any other way. If the information is subject to labeling in accordance with the requirements of current legislation (including Federal Law No. 436-FZ dated December 29, 2010 "On the Protection of Children from information harmful to their health and Development"), the Customer is obliged to ensure that such information is labeled in accordance with the requirements of the law. In case of non-fulfillment or improper fulfillment by the Customer of the specified requirement, if this has resulted in bringing the Performer or Yandex and/or a third party to administrative responsibility and imposing an administrative penalty by the competent authority on Yandex or the Performer or a third party, the Customer undertakes to compensate the relevant person for the losses incurred in this regard in full, including compensation for fines paid by Yandex or the Performer, and possible court costs.

4.8.2. The technical interaction of Yandex or the Performer, which consists in ensuring the possibility of sending messages at the direction of the Customer to specific recipients, does not entail the transfer to Yandex and the Performer of the status of advertiser or advertiser, nor does it give rise to corresponding rights and obligations for them in advertising activities.

Consent of Notification Recipients (OPT-IN)

4.9. The Customer undertakes not to send Notifications to recipients who have expressed unwillingness to receive any types and types of messages from the Customer. In order to comply with this clause, the Customer undertakes to create appropriate stop lists, including on the basis of information received from Yandex or the Performer.

4.10. The Customer is obliged to collect confirmations of consent (OPT-IN) of recipients to receive Notifications and SMS messages in accordance with the procedure provided for by the legislation of the Russian Federation, including compliance with the requirements of Law No. 152-FZ "On Personal Data". At the same time, the Parties specifically agreed that the Customer's consent is considered not received if the Customer has not provided the explicit consent of the Notification recipients required by applicable law.

4.11. The Customer is obliged to store and provide, upon request from Yandex, within 1 calendar day.:

  • the text of the consent indicated in the "Recipient's Consent" section

  • The URL of the page where the consent was received;

  • confirmation format (for example, a checkbox, SMS confirmation);

  • duration of consent;

  • a link to a description of the consent process;

  • information about the location and method of storing consents.

4.12. In the event of a lack of consent (OPT-IN), evidence of consent collection (OPT-IN), or failure to provide the requested data, the Customer pays a fine of 50,000 rubles for each detected violation, as well as reimburses all losses and expenses of Yandex caused by such violation, including, but not limited to, the imposed Yandex is subject to penalties imposed by government agencies, telecom operators, and other third parties in connection with violations committed by the Customer.

4.13. The Customer undertakes to provide Yandex and/or the Operator with documents confirming that the Customer has fulfilled the requirements for obtaining the consent of recipients within 1 calendar day from the date of receipt of the relevant request from Yandex or the Operator.

Definitions

Capitalized terms used in these terms and conditions and not defined in the Offer or the terms of use of other Services have the following meanings:

Notification is a short text message (up to 160 characters in Latin and up to 70 characters in Cyrillic in the case of SMS) that can be sent and received by the Recipient's terminal orA Subscriber or a pop-up message in the Customer's application or browser.

Notification delivery channel is an object in the Service, the configuration of which determines the type/method of interaction with the platform for which the delivery of messages/notifications is configured.

The Alpha name/Sender's name is the unique name of the sender, which is displayed in the header of SMS messages instead of the phone number.

OPT-IN is a form of voluntary subscription, when the recipient of SMS messages expresses his consent to receive informational or promotional mailings from the Customer.

An Template of Notifications is a blank text of an Sms Message and/or Notification messages and/or Notifications and/or Notifications received from the Customer for sending it to the Customer's subscribers.
